3.3 The contractor is responsible for providing all computers, supplies, and facilities required to accomplish this effort.

3.4 Incurred cost proposals that are outside the submission deadline detailed in FAR 52.216-7(d)(2) entitled ‘Allowable Cost and Payment’ shall be submitted within 90 calendar days of award of this contract. The incurred cost submission that is currently outside of the submission deadline is FY 2013.

3.4.1 Incurred cost proposals shall be adequate as detailed in FAR 52.216-7(d). An inadequate cost proposal will result in rejection by the Government. Rejection of an incurred cost proposal shall require correction and resubmission within 30 calendar days of receipt of the rejection notice. Outstanding incurred cost proposals that are rejected more than once shall be considered unsatisfactory performance. Outstanding incurred cost proposal submissions that exceed 90 calendar days without a documented rejection or that exceed 30 calendar days after the first rejection shall be considered unsatisfactory performance.

3.5 The contractor shall submit monthly progress reports that shall identify, at a minimum, the status of incurred cost proposals (i.e. draft, submitted, rejected, etc.), outstanding fact finding questions, and data provided in response to fact finding questions.

3.5.1 Fact finding questions and responses shall be logged by date and contain the status of any follow up actions generated. An aging schedule shall be prepared that details the length of time a question remained outstanding before an adequate response was provided to the Government. An adequate response is defined as a response that answers the fundamental purpose behind a question and enables the Government to make a determination based on the information received. For example, the response received causes the Government to determine that a cost is allowable, unallowable, or requires further testing. An inadequate response would result in further requests for data that is identical, or near identical, to the original question.

3.5.1.1 All fact finding questions shall receive an adequate response within 30 calendar days. Responses received in excess of 30 calendar days shall be considered unsatisfactory performance unless a submission extension has been approved by the Contracting Officer. Responses requesting additional time beyond 30 calendar days are not adequate responses. However, such requests may be considered on a case by case basis to increase response time for an additional 30 calendar days and may be approved by the Contracting Officer. Questions granted extensions that are outstanding in excess of 60 calendar days beyond the initial receipt date shall be considered unsatisfactory performance.

3.5.1.2 For questions received prior to award, the award date of this contract shall serve as the question receipt date.

3.5.1.3 The first progress report shall be submitted no later than (NLT) 12 working days after the first full calendar month of performance. Subsequent reports shall be submitted NLT 12 working days after the end of each subsequent calendar month of performance. The contractor shall maintain detailed records of fact finding responses in electronic format to be made available to the Government upon request during the life of this contract. The report shall be prepared using Microsoft Office Products version 2003 or later (i.e. Word, Access, Excel, Project, etc.) or Adobe portable document format (.pdf) in contractor’s preferred format. The report shall be submitted electronically to: Charles R. Smith, Lead Price/Cost Analyst, Code 440 at Charles.r.smith13@navy.mil.
