CONTRACTOR QUESTION: (ONE QUESTION PER PAGE)
Attachment J-1, Statement of Work (20 April 2015) in paragraph 1.1 states that the effort provides for the preparation, compilation, and support of the Final Incurred Cost Data for outstanding contractor fiscal years for contracts with Vigor Shipyard, Inc., and paragraph 1.2 states that the contractor shall provide all personnel, equipment, supplies, etc. in connection with the final incurred cost proposals for FY 2005 to the end of FY 2014. In paragraph 1.5, it is reiterated that the scope covers FY 2005 through FY 2015.
Item 12 of the Solicitation, Offer, and Award and Section F states that only costs after 27-Jul-2015 will be covered.
Our understanding was the proposal was to cover the costs incurred by Vigor Shipyards in FY 2015.
What changed and how are those costs to be reimbursed?

DATE OF REQUEST: May 6, 2015 QUESTION NO: 002
TITLE:
ISSUING OFFICE POC (CODE 440):
Attachment J-1, Statement of Work (20 April 2015) in paragraph 3.1 states that the contractor shall provide staffing to consist of four (4) individuals.
Section B of the Solicitation, Offer and Award provides for only three (3) individuals.
Why the inconsistency and which is correct?
The quantity for CLINs 0003 and 0006 of Section B are incorrect.
This Amendment corrects the quantity to read from 2,080 to 4,160 for CLIN 003 and 1,040 to 2,080 for CLIN 0006.
DATE OF REQUEST: May 6, 2015 QUESTION NO: 003
TITLE:
ISSUING OFFICE POC (CODE 440):
Without regard to Question No. 2, considering that purpose of the effort is the preparation, compilation and support the Final Incurred Cost Data, more than just the four (4) positions listed, are necessary.
How are the costs of these individuals to be reimbursed?
The cost for these individuals are reimbursed on a labor hour basis in accordance with solicitation provision 52.216-29. Establishment of personnel requirements was accomplished via market research, historical efforts, and in consultation with Vigor Shipyard’s Pete Wagner.

ISSUING OFFICE POC (CODE 440):
Page 46 of the Solicitation, Offer and Award states under the Clauses Incorporated by Full Text that
Clause 52.216-1 shall apply and that the government contemplates an award of a Labor Hour Service
Contract.
Prior discussions with the Contracting indicated that the Award would result in a fixed price contract.
We had submitted our expected resource needs to submit the Fin al Incurred Cost Data, and support the DCAA audits.
Why the change, and is a fixed price award open for discussion?
Prescription for Time & Material (T&M) type contracts can be found in FAR 16.601(c). Per this reference, it is not currently possible to estimate accurately the extent or duration of the work, or to anticipate costs to a reasonable degree for this effort.
Discussions regarding T&M contract type were held with Pete Wagner on or about 11 Dec 2014, and again on or about 25 Feb 2015.

Page 48 of the Solicitation, Offer and Award states under the Clauses Incorporated by Full Text that
Clause HQ L-2-0009 shall apply and that the proposal needed to include a small business contracting plan or a detailed explanation of why the goal cannot be met must be included.
As the proposal is to provide for the preparation, compilation and support of the Final Incurred Cost
Data, how is this at all relevant?
FAR 19.708(b) invokes FAR Clause 52.217-16 in solicitations and contracts that offer subcontracting possibilities and are expected to exceed $650,000. As a result HQ L-2-0009 directs the submission of a subcontracting plan.
It may be appropriate for the contractor to submit their corporate subcontracting plan, and if applicable, state that no subcontracting is anticipated.

Regulations state that solicitations requiring the submission of certified cost or pricing data shall have this Clause included.

TITLE:
ISSUING OFFICE POC (CODE 440):
Attachment J-1, Statement of Work (20 April 2015) in paragraphs 3.5 and subparagraphs provides for various reports to be filed.
Under the current program that has been in place and being followed today, none of this reporting is done.
How is this relevant and was this added as the government considers this a Labor Hour Service
Contract?

Discussions regarding these reports were held with Pete Wagner on or about 11 Dec 2014, and again on or about 25 Feb 2015.
