STATEMENT OF WORK
Contractors shall provide all services for the Inspection and Repair of one (1) Intermediate Shaft S/N 1791. The Intermediate Shaft is one of several shaft sections that make up the CVN-68CL shaft assembly. Due to the current workload of Norfolk Naval Shipyard (NNSY) inside machine shop, the work required to perform the needed repairs to Intermediate Shaft S/N 1791 will not be able to be supported. With the high schedule demands of ensuring this work is complete prior to the end of the drydocking period, an outside activity's help is requested.
One (1) Intermediate Shaft S/N 1791 shall be repaired to ready for issue (RFI) status that shall pass all technical requirements to be installed shipboard. Subsurface defects located near the AFT sleeve of the shaft shall be excavated and require a weld repair to bring all pertinent dimensions and components within specification. Delays to the completion of the refurbishment of Shaft S/N 1791 will result in delays to the undocking of the CVN-77.

SECURITY REQUIREMENTS
During the performance of this contract, Unclassified Naval Nuclear Propulsion Information (U-NNPI) may be developed or utilized. Documents provided that contain this sensitive information are considered NOFORN (not releasable to foreign nationals) and will have the word “NOFORN” on each page. Appropriate safeguards must be proposed by the contractor and approved by the Contracting Officer for the safeguarding from actual, potential or inadvertent release by the contractor, or any subcontractor, of any U-NNPI in any form. Such safeguards shall ensure that only governmental and contractor parties, including subcontractors that have an established need to know to have access in order to perform work under this contract, and are not foreign nationals (including immigrant aliens), will have such access and then only under conditions which assure that the information is properly protected.
A foreign national or immigrant alient is defined as a person not being a United States citizen or a United States national. United States citizens representing a foreign government, foreign private interests or other foreign nationals, are considered to be a foreign national for industrial security purposes and the purpose of this restriction.
In addition, any and all issue or release of such information beyond such necessary parties, whether or not ordered through an administrative or judicial tribunal, shall be brought to the attention of the Contracting Officer for his/her prior review and concurrence.
The Contracting Officer shall be immediately notified of any litigation, subpoenas, or requests which either seek or may result in the release of U-NNPI information.
In the event that a court or administrative order makes immediate review by the Contracting Officer impractical, the contractor agrees to take all necessary steps to notify the court or such administrative body of the Navy’s interest in controlling the release of such information through review and concurrence in any release.
The Contracting Agency reserves the right to audit contractor facilities for compliance with the above restrictions.
Exceptions to these requirements may only be obtained with prior approval from the Commander, Naval Sea Systems Command (08B).

(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless an agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that--
(1) It is [ ] is not [ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability; and
(2) It is [ ] is not [ ] a corporation that was convicted of a felony criminal violation under a Federal law within the preceding 24 months.
(End of provision)
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Award will be made to the lowest priced, technically acceptable quoter representing the best value to the Government.
Technical Acceptability (10 Page Limit): Technical Acceptability will be evaluated to determine an overall rating of “acceptable” or “unacceptable”. This will be determined by evaluating the ability of the quoter to provide a sound, compliant approach that meets all requirements and demonstrates a thorough knowledge and understanding of the Specification requirements. It is the contractor’s responsibility to ensure that their quotation clearly demonstrates their ability to perform these requirements.
All quoters must provide the following minimum information and documentation with their quotations:
Ability of the quoter to meet the NAVSEA Standard Item requirements as agreed to.
Ability to meet the period of performance as agreed to.
Detailed explanation of any requirement that cannot be successfully accomplished by the quoter.
NAVSEA’s Shaft Refurbishment Facility Certification, or Industry Standard.
Price: The quoter shall provide pricing as requested on the standard form SF1449 with unit prices for each line item.
Any quantity price discounts and discounts for prompt payment should be included in this section. The quoter’s quotation will be evaluated using one or more of the techniques defined in FAR 13.106-3, in order to determine fair and reasonable.
Contractors responding to this RFQ are advised that prior to award, the Government may request submission of additional information or data to support price reasonableness. Failure to submit the requested information may result in disqualification of a quotation.
Award may or may not be made without any type of discussions or negotiations. This is based on the Contracting Officer’s determination after an evaluation has been completed on all quotations.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability.
Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
