About this file
This is a Memorandum for Use of Other Than Full and Open Competition (PR Number 1301217138) justifying sole-source procurement of Technical Support Specialists services for the period 01Mar-01Apr2025. The requirement is to open, inspect, repair, maintain, and certify forklifts, aerial work platforms, missile sideloaders (MSL 29-00070), and FJ-42338 support trailers.
Technical Support Specialists (located in Cave Creek, AZ) has been identified as the sole provider, as HUBTEX (the OEM) is no longer able to support the assets and has repeatedly engaged TSS&C for repairs due to their unique market position. The justification cites critical ship equipment concerns, noting that improperly serviced Material Handling Equipment (MHE) poses significant safety hazards to personnel and mission-essential equipment. The contractor must have access to proprietary diagnostic software codes and technical data required for proper maintenance. This procurement supports Military Sealift Command vessels and falls under MSC SMS Procedure 7.6-001.ALL Self-Propelled Material Handling Equipment (MHE) Program, with 29CFR 178 requiring qualified and certified technicians to perform maintenance and inspection on MHE.

HUBTEX is the manufacturer which has access to business sensitive proprietary technical manuals, drawings, and software rights.
HUBTEX is no longer able to support the asset and has repeatedly engaged TSS&C to conduct repairs on the MSC assets due to their uniqueness within the market. They have not maintained the internal expertise to be able to support the assets from an OEM perspective.

a. __X___ CRITICAL SHIP EQUIPMENT: The required item is critical ship equipment, the failure of which poses a hazard to the ship, the crew or the environment.
i. SMS Procedure Number: __MSC SMS Procedure 7.6-001.ALL Self- Propelled Material Handling Equipment (MHE) Program ______
ii. MHE is required for MSC vessels to perform stated missions. Improperly serviced and maintained MHE can pose a significant safety hazard to both personnel (through injury) and mission essential equipment (through direct damage). Non-operational MHE significantly degrades the mission readiness of deployed MSC vessels. 29CFR 178 requires qualified and certified technicians to perform maintenance and inspection on MHE.
iii. iii. This requirement is for an OEM authorized service provider, capable and able to perform maintenance on Material Handling Equipment (MHE) assets. SOW requires a technician thoroughly familiar with the repair and maintenance of listed MHE and experience to read proprietary diagnostic software codes. OEM software allows for the diagnosis of equipment issues, and identifies equipment faults allowing the repair activity to properly conduct the necessary repairs. Without these codes, the equipment cannot be properly maintained preventing the ship from executing its mission.

They have access to replacement parts, software, and technical data/drawings required for properly maintaining the equipment to provide technical support for routine/annual inspections. This will allow the ship to get underway with a full complement of operational certified MHE.
4. _____ UNUSUAL AND COMPELLING URGENCY: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:
