PERFORMANCE WORK STATEMENT
C1 SCOPE OF WORK/PWS
The contractor shall provide all the necessary personnel, supervision; management, equipment, materials and services to provide pilotage for Military Sealift Command (MSC) controlled vessels operating in the port of Charleston, SC. These services shall be made available to all MSC operated or contract operated vessels including such Government owned vessels that are Scientific, Oceanographic, Fleet Support or Cargo, providing direct support to the US Navy in Commission and manned by Navy personnel, are also included under this solicitation: This also includes USS Naval vessels and other public vessels (i.e. Army watercraft, USCG ships when requested).
C1.1 The contractor agrees to be on call 24 hours a day, 7 days a week including weekends and holidays. The contractor agrees to a minimum of two- (2) hour’s notice for ship’s arrival and a minimum of one (1) hour’s notice for cancellation of services without penalty.
C1.2 MSC vessels will be given priority in harbor movements in response to weather or national defense emergencies. Government vessels will also be given priority over commercial vessels when arriving to make a scheduled labor start time for cargo operations.
C1.3 The contractor shall transport pilots to and from the designated pilot station at Area “B” (NOAA Chart 11523) and conduct safe pilot embarkation and debarkation operations in a seaway.
C1.4 The contractor shall provide efficient communications, transportation coordination, and waterways system oversight to perform pilot services.
C1.5 The contractor will allow for extra time to gain access into port/government facilities during periods of increased security. The contractor shall arrange for all personnel badges/passes required for access to government facilities.
C1.6 The contractor shall promptly notify the Contracting Officer of his authorized representative if unable to meet or unable to complete an assignment. If the contractor fails or is unable to provide pilotage as requested, the Government may either perform the services itself or may employ others who are qualified, for the contractor’s account and excess costs to the Government, in either case, shall be charged to the contractor. The Government also reserves the right to use Government personnel to provide pilotage services during the duration of the contract.
C1.7 The contractor shall be compensated in accordance with prices on the schedule. MSC Publication P-504 provides a list of MSC operated, and contract operated USNS vessels, and MSC controlled ships which will be utilizing pilotage services under this statement of work, including Ready Reserve Fleet (RRF) vessels which may be used during periods of “heightened alert” during “expedited movement of the Rapid Deployment forces of the United States”, or during “Strategic Sealift Exercises”, and are included under the scope of this contract. The Government reserves the right to add or delete ships from the list in MSC Publication P-504.
C1.8 Contractors are required to possess either a Federal or State pilot license as required by law. Depending on type of vessel (time charter, commercial or public vessel) and where it is coming from (overseas/coastwise), a state license is required in some cases. Contractor is required to provide a pilot with the required license.
The rates to be charged shall be no greater than the rates charged to the quoter’s most favored customers.

VOLUME II: PAST PERFORMANCE
The Past Performance factor will be evaluated by the Procuring Contracting Officer (PCO) as a factor for award and used to evaluate quoter’s’ ability to perform the contract successfully.
A Quoter lacking relevant past performance or for whom past performance information is not available or incomplete will be given a “neutral” rating for past performance.
Quoters are required to provide information on no more than three (3) of the firm’s most recently completed Federal Government, State Government, Municipal Government, or commercial contracts (not to exceed five years since completion) for like or similar services to those to be provided under this RFP.
Quoters with relevant past performance information shall follow the instructions on the Past Performance Questionnaire attached to this solicitation for evaluation by the PCO. The Government shall not consider past performance information submitted by a quoter unless it is supported by a past performance questionnaire or a CPARS rating. The Government may review the Contractor Performance Assessment Reporting System (CPARS) ratings and other existing past performance ratings on relevant contracts. The Government may also review other relevant past performance information contained in either local or other MSFSC office’s files, or from other Government sources.
Trends in a contractor’s performance will also be considered as long as a minimum of one year of performance has been completed as of the closing date of this solicitation. Quoters who present similar contracts/orders should provide a detailed explanation demonstrating the relevance of the contract/order to the requirements of the solicitation. Relevance is defined as the similarity of services provided, i.e. similar size/dollar value and degree of administrative, managerial, and technical difficulty. The Government reserves the right to determine the relevancy of such information and to verify statements and representations made in a quoter’s quote. Any information provided must be in sufficient detail with completed past performance questionnaires to enable the Government to conduct an evaluation. Summary lists of contracts or incomplete data may not be considered.
In addition, the quoter may submit explanatory information of any substandard or poor performance and the corrective actions taken to prevent a recurrence.
VOLUME III: PRICE QUOTE
The PCO will evaluate price. The quoter’s proposed price will be evaluated on the basis of price reasonableness in accordance with FAR Subpart 13.106-2.
Price quotes will be due on the closing date of the RFP. Quoters are required to complete the SF 1449 and schedule of services. A separate unit price and extended price must be submitted for each contract line item number (CLIN) including the base period and all option periods. A quoter’s representations and certifications, i.e. reps and certs, shall be included in the price quote. Quoters are encouraged to register their representations and certifications online at https://orca.bpn.gov/login.aspx and provide confirmation in the price quote of the registration, as opposed to providing a hard copy of the reps and certs
Signed completed Standard Form (SF-1449) shall be scanned and included with the Price Quote.
Quotes must be realistic in both technical approach and total price. Quotes that are unrealistic in terms of technical or schedule commitments, or unrealistically low in price will be considered indicative of a lack of understanding of the complexity and risk in the solicitation requirements. The ability of the quoter to perform all aspects of the anticipated contract from inception to completion will be considered as part of the overall "realism" evaluation. Quoters unable to perform all aspects of the anticipated contract will not be considered for award. The total evaluated price shall consist of the extended price for all CLINs.
CLAUSES INCORPORATED BY FULL TEXT
EVALUATION--COMMERCIAL ITEMS
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate quotes:
1) Factor 1: Technical
2) Factor 2: Past Performance
3) Factor 3: Price
(b) Options. The Government will evaluate quotes for award purposes by adding the total price for all options to the total price for the basic requirement. (c) A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote's specified expiration time, the Government may accept a quote (or part of a quote), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
