INVOICE INSTRUCTIONS

Invoicing and payments shall be administered IAW FAR 52.212-4(g) and 52.212-4(i). Payment shall be made for supply and/or services accepted by the government that have been delivered or performed at the location/s set forth in this contract.

(a) The Contractor shall prepare invoices in accordance with the instructions set forth in 52.212-4(i)1 "INVOICE

INFORMATION". Invoices shall be marked with the contract and delivery order numbers and submitted to address, which will be determined at time of contract award.

(b) The Contractor’s invoice shall list separately the gross price, amount of tax deducted, and net price charged.

(c) Payment will be made after performance and acceptance of services. An invoice can be submitted at the end of every month after performance. The Government will only pay for those services or portions thereof, which have been accepted in accordance with "INSPECTION AND ACCEPTANCE", herein.

(d) The contractor shall submit its invoices and coordinate all invoice and payments related matters with:

PERFORMANCE WORK STATEMENT

Performance Work Statement

Ambulance Services Naval Branch Health Clinic - Bahrain

SECTION 1 – SCOPE

1) BACKGROUND

a) The Contractor shall provide ambulance and patient transport services for Naval Branch Health Clinic

(NBHC), Bahrain (hereafter referred to as “the MTF”). The services to be provided by the Contractor are patient transportation services and emergency medical services with the scope of practice of an EMT-Paramedic (EMT-P) with Advanced Cardiac Life Support (ACLS) and Pediatric Advanced Life Support (PALS) capabilities. The ambulance services and staff shall be based on NSA (Naval Support Activity) Bahrain and bayed at Building 245, NSA Emergency Management Warehouse. Ambulance services will include patient transport to host nation hospitals within a 45 km radius of NSA Bahrain.

SECTION 2 - DUTIES

1) GENERAL DUTIES

a) The Contractor shall perform a full range of duties consistent with their profession, education, training, experience, and assigned position. General duties that apply to all Contractor employees are given below.

b) The Contractor shall proceed to and between the transport sites in accordance with the stipulations of the transport request. The Contractor shall drive in an expeditious, but safe, manner by the most expeditious route possible and in compliance with regional standards, without unnecessary deviance from that route, subject to mitigating unusual circumstances.

c) Upon arrival at the receiving hospital, the Contractor shall refer the patient to the appropriate personnel in accordance with stipulations of the service request.

d) Function with an awareness and application of safety procedures.

e) Work shall be performed in confined spaces. Contractor personnel shall be able to perform regular and recurring bending, lifting, stooping, stretching, and working in awkward positions. They shall be able to lift and reposition patients, be able to restrain and provide treatment for violent patients.

2) SPECIFIC DUTIES - RESPONSE PARAMETERS

a) The Contractor shall respond with a fully equipped and manned vehicle which is specifically designed for the transport of ill patients.

b) The transports may include a range of up to 45 km radius from NSA Bahrain.

c) The Contractor shall provide, at a minimum, one Emergency Vehicle Operator (EVO)/EMT-B and one EMT-P or as determined equivalent in Bahrain at the discretion of the US Government.

d) Next-of-kin or other persons, at the request of the patient, may ride in the ambulance at the discretion of the Contractor.

3) SPECIFIC DUTIES - PATIENT TRANSPORT SERVICES

a) The Contractor shall serve as certified, medical first responders for NSA Bahrain following Emergency

Services (EMS) activation. The Contractor shall perform ambulance transportation service from patient’s current location (e.g. branch health clinic, gymnasium, etc.) and shall deliver the patient to the appropriate medical facility throughout the Kingdom of Bahrain as determined by medical protocol.

b) The Contractor shall receive and respond to requests for patient transport services and emergency medical services within 5-10 minutes.

c) The Contractor shall provide patient transport services as needed 24 hours per day, 7 days per week, and 365 days per year.

d) In the event patient transport services commence and the ambulance and crew are required to exit NSA

Bahrain for transport to medical facilities outside of NSA Bahrain, the Contractor shall provide upon verbal or written request from the MTF authorized personnel a second ambulance if the event an additional ambulance is needed.

e) The contract personnel shall assess the nature and extent of the illness or injury, shall follow their established protocols as outlined by their respective Medical Director and shall contact their medical control for transport destination and further directions as needed for medical treatment.

f) The Contractor shall provide as many back-up ambulances and medical services as needed in the event of multiple medical emergency transport requirements.

4) SPECIFIC DUTIES – PATIENT CARE

a) Performance of work and care rendered shall at all times be in accordance with established infection control practices and procedures as specified by the Centers for Disease Control (CDC), Atlanta, Georgia http://www.cdc.gov/contact/ and the Kingdom of Bahrain. In those emergencies where the patient's condition becomes critical during transport and requires immediate care, the EMS crew shall rapidly stabilize the patient, according to the level of the EMT provider’s level of certification and in accordance with regional protocols and EMS written Standard Operating Procedures (SOP) protocol, along with the Contractor’s guidelines for Ambulance Transports. The Contractor shall comply with the infection control requirements set forth in Section 2.

b) Strict hand washing techniques shall be utilized between vehicle transports. Antiseptic skin wipes shall be stocked on each ambulance and shall be used for hand washing during transport.

c) When assisting or transporting patient(s) who are suspected of or diagnosed as having Tuberculosis (TB), Meningitis, Varicella (Chicken Pox), Mumps, Rubella, Upper Respiratory Infection (URI), or any other infectious disease transmitted via the respiratory tract, patient(s) and Contractor personnel shall wear masks. The driver is not required to wear a mask while driving if the patient is in the rear of the ambulance. If the patient has an open and draining skin lesion, Contractor personnel shall wear leak proof gloves (e.g. latex free) when assisting the patient.

d) Oxygen masks, cannulas, and prongs shall be changed after each patient transport. Suction tubing and catheters shall be disposed of after each use.

e) Ambulance crews shall notify the receiving hospital while enroute of the patient's condition as the status of the patient permits in accordance with Kingdom of Bahrain established protocols. The Contractor will provide first aid, patient stabilization and treatment, and patient transport in accordance with the Kingdom of Bahrain Medical Director’s protocols.

f) Patient Assistance. As part of the response to a request for patient transport services, the Contractor shall provide patient assistance to include, but not limited to:

a. Lifting patient from, including but not limited to, bed/ground/floor and placing on litter/stretcher, or from litter/stretcher and placing in bed. There are number of scenarios in which a patient may initially be found. Do not walk patient to the ambulance.

b. Placing patient on appropriate equipment (e.g., monitors), administering medications, needles, IVS, 02, applying dressings and redressing patient’s wounds as appropriate. Patients with chest pain shall be on monitor.

c. Placing patient in and removing from vehicle.

d. Escorting patient to the receiving destination and remaining with non-ambulatory patient(s) until transferred to the care of the receiving facility.

e. Carrying patient records and presenting to the appropriate personnel at the receiving facility.

5) SPECIFIC DUTIES – DRILL PARTICIPATION

a) Contractor shall provide ambulance and personnel services as required to participate in scheduled medical emergency management and mass casualty drills.

6) SPECIFIC DUTIES – ADMINISTRATION

A) Dispatcher Log: The Contractor shall maintain a dispatcher log with a record for each patient transported. The log shall contain not less than the following information:

a) Requester's name and telephone number.

b) Time of request.

c) Name of physician ordering patient transfer.

d) Name of receiving facility.

e) Name of physician accepting patient.

f) Dispatch time.

g) Time of arrival and time of departure at the referral facility.

h) Time of arrival at the receiving facility.

i) Name of patient.

j) Problem of patient.

k) Vehicle Log

B) The Contractor shall maintain a log in each vehicle with a record for each patient transported. The log shall contain not less than the following information:

a) Dispatch time.

b) Time of arrival and time of departure at the referral facility.

c) Time of arrival at the receiving facility.

d) Name of patient.

e) Problem of patient.

C) The Contractor shall document all treatment provided to the patient during the patient transport. For each patient transported, the Contractor shall complete the Contractor run sheet of which a copy will be given to the MTF.

D) The Contractor shall verify the content and correctness of all prepared and transcribed reports by affixing an original signature to all copies of the document.

7) CONTAMINATED/INFECTIOUS WASTE.

a) Contractor is responsible for the control and disposal of all medical waste incurred during transport in accordance with paragraph Section 2 - Duties. The Contractor shall comply with medical waste disposal local laws and regulations of the Kingdom of Bahrain, NSA Bahrain and the MTF.

8) MAINTENANCE OF VEHICLES, EQUIPMENT AND SUPPLIES.

a) Vehicles, vehicle security and vehicle restocking.

b) The Contractor shall ensure that vehicle security is maintained at all times by the vehicle crew.

c) The Contractor shall provide routine restocking, cleaning, and disinfection of the vehicle, equipment, and supplies.

d) The Contractor shall provide access to the ambulance and a list of medications to appropriate NBHC Bahrain pharmacist to conduct spot checks twice a month for required medications and supplies.

e) Vehicle Maintenance.

f) The Contractor shall ensure that the ambulances are safe to operate, sanitary, and properly functioning; the Contractor shall not operate unsafe vehicles.

g) The Contractor must ensure that the ambulance has a valid registration and vehicle access at all times.

h) The Contractor must provide valid registration and insurance pertaining to the vehicle at least 30 days in advance of expiration.

i) The Contractor shall provide routine, ongoing maintenance and inspection of ambulances for mechanical and safety systems. The Contractor shall provide a replacement vehicle if the vehicle breaks down.

j) Equipment and supplies.

k) The Contractor shall provide routine, ongoing maintenance and inspection of ambulance equipment.

l) The Contractor shall provide routine, ongoing inspection of ambulance supplies. The Contractor shall not use an item of supply if:

i. The expiration date has passed.

ii. The wrapper is damaged or the seal is broken.

iii. Water spots are on wrappers.

iv. Equipment and supplies shall be protected from exposure to dirt, dust and blood.

9) REPORTS

a) Contract personnel must complete, without exception, a written patient care report (PCR) on each patient contact. The PCR should be completed before the paramedic leaves the facility to which the patient was transported. Should the paramedic unit be dispatched prior to completing the PCR, every attempt should be made to complete the report as soon as possible.

b) All PCRs should be completed and submitted to the receiving facility and the MTF within four (4) hours of patient delivery. Without exception, a PCR must be completed and submitted to the receiving facility and the MTF before a contract employee goes off duty.

c) The Contractor shall provide the MTF Contracting Officer Representative (COR) quarterly updates of all contract personnel continuing medical education course completions, certifications and skills verifying training.

SECTION 3 – HOURS OF OPERATION

1) Patient transportation services shall be provided 24 hours per day, 7 days per week, and 365 days per year. Services shall be provided even during periods of increased threat conditions, natural / unnatural emergencies, and firefighter on scene medical support.

2) Contract personnel shall be considered essential personnel for the MTF.

4) The Contractor shall annually provide the MTF COR with a copy of the current EMT-B and EMT-P standing orders, guidelines, protocols and policies as outlined by their respective Medical Director.

The Contractor shall provide the MTF a copy of any EMT-B and EMT-P standing orders, guidelines, protocols and policy updates that occur prior to the annual update period.

5) All deliverables are to be provided in Contractor format.

2) CONTRACT EMPLOYEE PERFORMANCE DEFICIENCIES

a) The Secretary of the Navy has determined that the illegal possession or use of drugs and paraphernalia in a military setting contributes directly to military drug abuse and undermines Command efforts to eliminate drug abuse among military personnel. The policy of the Department of the Navy (including the Marine Corps) is to deter and detect drug offenses on military installations. Measures to be taken to identify drug offenses on military installations, and to prevent introduction of illegal drugs and paraphernalia, include routine random inspection of vehicles while entering or leaving, with drug detection dogs when available, and random inspection of personal possessions on entry or exit. If there is probable cause to believe that a worker has been engaged in use, possession, or trafficking of drugs, the worker may be detained for a limited period of time until he/she can be removed from the installation or turned over to local law enforcement personnel having jurisdiction. When illegal drugs are discovered in the course of an inspection or search of a vehicle operated by a worker, the worker and vehicle may be detained for a reasonable period of time necessary to surrender the individual and vehicle to appropriate civil law enforcement personnel. Action may be taken to suspend, revoke, or deny clinical privileges as well as installation driving privileges. Implicit with the acceptance of this contract is the agreement by the health care worker to comply with all Federal and State laws as well as regulations issued by the Commanding Officer of the military installation concerning illegal drugs and paraphernalia.

b) A contract employee demonstrating impaired judgment will be removed from providing services. The

Government reserves the right to require the Contractor to remove any contract employee who, in the judgment of the Government, is impaired by drugs or alcohol.

c) Contract employees with alcohol or drug abuse problems may be allowed to return to work under the terms of this contract only with prior approval from the Commanding Officer of the MTF.

SECTION 6 – PERSONNEL QUALIFICATIONS

1) GENERAL QUALIFICATIONS THAT APPLY TO ALL CONTRACTOR PERSONNEL

a) The Contractor shall provide EMT-Bs and EMT-Ps personnel having certain minimum levels of training and experience. This section is in no way intended to dictate a staffing plan to the Contractor for the performance of the services delineated in this performance work statement. The services require that contract employees possess the following minimum qualifications to meet contract requirements.

i. All personnel who perform under this contract shall speak, read, and write fluent English.

ii. Contract personnel shall maintain current certification in American Heart Association Basic Life

Support (BLS); American Heart Association Healthcare Provider Course or equivalent in accordance with BUMEDINST 1500.15E CH-1. Training shall be the responsibility of the Contractor and is at no cost to the Government. Contract employees not in possession of current certification must acquire certification prior to initiating contract performance. Web based classes do not meet these standards. 2) SPECIFIC QUALIFICATIONS FOR EMT-P and EMT-B PERSONNEL

a) Contract EMT-P and EMT-B personnel shall have a minimum of one (1) year experience. The EMT-P and EMT-B shall possess current certifications that are commensurate with U. S. medical standards.

b) The contract personnel shall have successfully completed an Emergency Medical Technician Basic Program and the advanced certification program for the paramedic scope of practices that are commensurate with U. S. medical standards found at the National Highway Traffic Safety Administration, EMS Scope of Practice Model for Emergency Medical Technicians and Paramedics.

c) Contract personnel shall possess and maintain a current certification in Pediatric Advanced Life

Support (PALS) and Advanced Cardiac Life Support (ACLS).

SECTION 7 – PERSONNEL QUALIFICATIONS PACKAGE

1) The Contractor shall submit a personnel qualifications package for each EMT-B and EMT-P personnel proposed for performing services under the contract. The personnel qualifications package shall include:

a. Documentation to demonstrate compliance with the qualifications in Section 6

b. Health certifications requirements in Section 10.

c. A letter of commitment to work for the Contractor under the contract

d. A resume for the qualified personnel that demonstrates the individual’s certifications attained, the date the certifications were attained, name of current and/or past employer(s), two (2) professional references to include full name, position title, telephone number and e-mail address, a description of ambulance services performed as an EMT-B or EMT-P for a minimum of one (1) year and the name of the company for which these services were performed.

2) Prior to Contractor employees providing services, the COR will verify the compliance of each employee with the qualification requirements appropriate to their employment category. The COR shall inform the Contractor of compliance of the qualification package or any discrepancies contained therein.

3) The Contractor shall at all times ensure that current proof of appropriate qualifications and health certification requirements are provided to the COR.

4) The Contractor shall maintain a list of all individuals who are approved for service under the contract. The

Contractor shall provide a copy of the list to the COR within seven (7) days prior to performance of services under this contract and as required to maintain currency of the information. The list shall include the employee’s name and evidence of current EMT-B certification or EMT-P certification to include Pediatric Advanced Life Support (PALS) and Advanced Cardiac Life Support (ACLS) certification prior to the start of the performance under this contract under the designated personnel category. Personnel who are later designated by the Contractor to perform under this contract as qualified personnel must have a qualifications package sent for review by the COR no less than seven (7) days in advance of the planned performance date. Qualified personnel additions/substitutions and those personnel who were originally designated, but are due for renewal, shall have evidence of their current EMT-B certifications and/or EMT- P certifications with PALS and ACLS certification sent to the COR during normal Sunday to Thursday business hours prior to performance under this contract. Additionally, any other required certifications or training documentation such as for ACLS and PALS, shall be provided to the COR upon request for quality assurance checks that appropriately trained/certified personnel were utilized during performance of the contract.

5) The Contractor shall inform the COR of any terminations of employment within 24 hours of the action.

6) The Contractor shall provide required documents for NSA Bahrain base access and driving privileges no later than 30 days prior to expiration of current base access identification.

SECTION 8 - GOVERNMENT AND CONTRACTOR FURNISHED ITEMS.

A) GOVERNMENT FURNISHED ITEMS

1) The Government will provide motor vehicle decals and base access cards for all qualified contract employees to be used in accordance with base and MTF policy during the initial check-in procedure with the COR as per Section 10.

2) The contract employees shall comply with the military base policies and instructions for gaining access to the military base. The identification badge shall be worn during performance of work and anytime the Contractor is on the premises.

3) The vehicle decal shall be displayed appropriately according to the base instruction. The Contractor shall ensure that each employees ID badge and base vehicle decal are returned during a proper check-out with the COR when the contract employee is no longer providing services under this contract due to termination/expiration of the contract.

4) The Contractor shall ensure all employees maintain vehicle licensure.

5) Any instances in which Government property is in any way damaged by a contract employee, a written report of the circumstances and extent of damage shall be submitted to the COR within 24 hours of occurrence.

6) While on duty ambulance staff shall be provided with a suitable climate controlled waiting area proximate to the ambulance.

B) CONTRACTOR FURNISHED ITEMS

1) The Contractor shall furnish all labor, supervision, uniforms, training, continuing medical education, ambulance, medical waste sustainment, communication equipment and medical equipment to include consumables and medications required to perform services under this contract at no additional cost to the Government.

2) INSURANCE: This is a non-personal service contract, so the Contractor is required to have their own insurance in accordance with the laws and regulations of the Kingdom of Bahrain and shall demonstrate such insurance to NSA Bahrain as required if applicable.

a) AUTOMOBILE LIABILITY INSURANCE.

b) VEHICULAR AND GENERAL PUBLIC LIABILITY INSURANCE

c) WORKERS’ COMPENSATION AND EMPLOYER’S LIABILITY

d) MALPRACTICE INSURANCE

1. The Government will not be liable for malpractice allegations against contract employees based upon performance under the contract.

2. The Contractor shall be required to carry at a minimum $250,000.00 of malpractice insurance for each employee, seven (7) days prior to commencement of services.

3. Evidence of such insurance, demonstrating the required coverage, shall be provided to the Contracting Officer prior to the start of contract services.

4. In accordance with the Federal Acquisition Regulation (FAR) clause 52.237-7, the Contractor will indemnify the Government for any liability producing act or omission by the Contractor, its employees and agents occurring during contract performance.

5. If the Contractor uses subcontractors in the performance of this contract, the Contractor is required to ensure that its subcontracts for provisions of healthcare services contain the requirements of FAR clause 52.237-7, including the maintenance of medical liability insurance.

C) SERVICES

a) During the term of the contract, the contract employee shall provide, on behalf of the Government, ambulance and patient transport services for the MTF to active duty military personnel, their dependents, eligible Navy civilian employees, and other eligible beneficiaries, in accordance with the terms and conditions of the contract.

b) Bahrain ambulance services shall include care provided by EMT-Paramedics (EMT-P) with Advanced

Cardiac Life Support (ACLS) certification in compliance with the Kingdom of Bahrain, Ministry of Health "Mobile Intensive Care Unit" type of ambulance services.

c) The Contractor is responsible to ensure that all equipment and personnel are comparably equivalent with

American industry standard and the Department of Navy (DON), Bureau of Medicine and Surgery (BUMED) regulations and the employed personnel are available on the ambulance to respond to each call.

The Contractor shall be prepared to provide the services which may include care for physically, emotionally, or mentally disabled patients in the form of medical service functions, cardiopulmonary resuscitation, or other life-saving functions.

d) The Contractor shall provide to the Contracting Officer’s Representative (COR) a 24-hour point of contact for service.

e) For all patients, the Contractor shall provide life-supporting medical care, as required by the patient. The Contractor personnel performing the transport will make the determination whether or not to use red lights and/or siren. In the event of an emergency during transport, contract personnel shall assess the nature and extent of the illness or injury, shall follow their established protocols, and shall contact their medical control for further directions needed.

D) SUPPLIES

a) The Contractor is responsible for maintaining operational status of medical equipment and medical supplies according to the inventory requirements contained in the Primary Ambulance Daily Check-Off Sheet and Jump Bag Daily Check-Off Sheet. This inventory shall be updated daily and turned in to the NBHC Bahrain Administrative Officer every Sunday following completion of the weekly sheet.

b) The ambulances shall be no more than eight (8) years old with no more than 80,000 km and capable of being operated in compliance with all local laws and regulations of the Kingdom of Bahrain and NSA Bahrain. An ambulance shall be on NSA Bahrain 24 hours per day 365 days per year unless engaged in patient transport services.

c) The Contractor Medical Director shall be notified of patient transport services being initiated and shall place a secondary ambulance on standby in the event additional services are required and requested by authorized MTF personnel and/or dispatch. The response time of the secondary ambulance shall not exceed 20 minutes.

d) Vehicles provided as ambulances under this contract shall have the following requirements: must accommodate a minimum of two (2) seat belted ambulatory and one (1) litter patient, positioned so that at least one (1) patient can be given intensive life support during transport, and as per the Kingdom of Bahrain law.

e) All of the vehicles provided under this contract shall carry equipment and medical supplies for optimal care; have a primary two-way radio communications system and a cellular back-up system; and shall be construed to afford maximum patient safety and comfort, avoid aggravation of the patient’s condition, prevent exposure to an environment that may cause complication and threat to survival.

f) The Contractor shall be responsible for maintenance and repair of their vehicles at no additional charge to the Government. The Contractor shall operate vehicles in compliance with local laws and regulations.

g) All vehicles shall be fully air-conditioned.

h) The ambulance supplied by the Contractor shall provide seat belts to accommodate all people on board.

i) A cellular phone shall be available on the ambulance and shall be available to Government personnel to request emergency support from the receiving medical treatment facility, to arrange for emergency assistance in travel, or to check status of a patient that the team is going to retrieve.

j) The Contractor shall provide accurate directions to all referring hospitals, to include regional trauma centers, to the ambulance drivers.

SECTION 9 – QUALITY CONTROL

A) GENERAL

a) The Contractor shall complete all necessary steps to assist each contract employee performing services under this contract in obtaining documentation required to obtain access to the MTF and DoD information systems.

B) QUALITY OF SERVICE

a) This is a non-personal services contract that supports the MTF mission to oversee and coordinate the delivery of economical and effective medical, dental and other health care services. The ambulance services required by the contract supports the provision of patient care in the medical treatment facilities within the Area of Responsibility (AOR) and ensure proper ambulance services are available to overcome staffing shortfalls within the MTF. Contracting has been chosen as a strategy to provide ambulance services to support clinical patient care requirements.

b) The Contractor shall comply with applicable provisions of the law, rules and regulations of all

Governmental authorities, including but not limited to, the regulations and standards of the MTF. The Contractor shall adhere to and comply with all Department of Navy (DON), Bureau of Medicine and Surgery (BUMED) and MTF Instructions and notices which may be in effect during the term of the contract.

c) The Contractor shall comply with all laws and regulations governing the provision of ambulance services in the Kingdom of Bahrain where transport is being provided, including motor vehicle operations, maintenance of equipment, qualifications and training of employees.

d) To achieve the MTF mission, the Contractor shall establish, submit for Government approval and implement a Quality Control (QC) Plan which is consistent with the MTF Quality Control Program.

The Contractor shall also actively participate in the established medical Quality Improvement (QI) Plan of the MTF. Current copies of this contract, the Contractor’s QC plan, and the MTF’s QI plan shall be maintained on-site for ready reference by the Contractor during the term of the contract.

Contract employees shall read, be familiar with, and implement the contract, including the Contractor’s technical proposal, QC Plan, medical QI Plan, and any revisions.

e) After contract award, but not later than commencement of services, the Contractor shall submit a

Quality Control Plan to the COR and the Contracting Officer for review. The Contractor’s QCP shall be consistent with Joint Commission standards and the MTF Quality Control Program. The QCP shall, at a minimum, include (a) a plan for providing services for the required hours by appropriately qualified personnel that includes a specific methodology for doing so; (b) a plan to ensure maintenance and enforcement of Standards of Conduct for Contractor employees as specified in Section 11.2; and

(c) a plan for a patient relations program that is compliant with the MTF's patient relations protocols and which includes a notification process for all patient compliments and complaints.

f) Upon receipt of the Contractor's QCP, the MTF will review and provide comments to the Contractor. If the MTF finds deficiencies in any portion of the proposed QCP, the Contractor shall have five (5) working days to correct the deficiencies. The MTF COR will provide final approval of the QCP.

g) Sixty (60) days prior to exercising any option year under this contract, the Contractor shall submit to the COR an updated QCP that is consistent with updated Joint Commission standards and updated

MTF

h) Quality Control Program. The revised QCP shall be subject to the same review process as that required at the time of contract award.

SECTION 10 - START OF SERVICES

1) GENERAL

a) The Contractor shall recognize the importance of a successful start-up of contract services and the timely recruitment of qualified personnel to meet all contract requirements.

b) The Contractor shall provide no later than five (5) days after award of the contract the ambulances and qualified personnel.

2) BACKGROUND INVESTIGATION

a) The Contractor shall report to the NSA Bahrain security officer within two (2) days after contract award to initiate a local background check in accordance with policies of the Kingdom of Bahrain and NSA Bahrain.

3) OCCUPATIONAL HEALTH REQUIREMENTS

a) HUMAN IMMUNODEFICIENCY VIRUS (HIV)

b) MANAGEMENT OF HIV POSITIVE CONTRACT EMPLOYEES

i. HIV positive contract employees will be managed in accordance with the current Centers for

Disease Control (CDC) guidelines and Section 503 of the Rehabilitation Act (29 U.S.C. Section

793) and its implementing regulations (41 CFR Part 60-741).

ii. PREVENTION OF THE TRANSMISSION OF HIV Contract employees shall comply with the CDC’s Universal Precautions for the prevention of the transmission of HIV.

iii. All contract employees shall comply with infection control guidelines to include the proper handling, storage, and disposal of infectious wastes and the use of universal precautions to prevent the spread of infections.

4) MANAGING THE CLINICAL RISK IN THE WORK ENVIRONMENT

a) The work environment inherently involves risks typically associated with the performance of job duties. The contract employee may be exposed to contagious diseases, infections and flying debris, requiring the wearing of personal protection equipment such as scrub attire, gloves, masks, and eye protection.

b) All accidents which may arise out of or in connection with the performance of services required herein, and which result in injury, death or property damage, shall be reported to the Safety Department and the COR immediately and to the MTF QI Department within 24 hours.

c) Verbal reports shall be followed with written reports within 24 hours. Statements of witnesses shall be included. If any claim is made by a third party against the Contractor on account of any accident which occurs in connection with the performance of this contract, the Contractor shall promptly report the facts in writing to the Command Legal Advisor, the MTF QI Department, the Command Safety Department, and the COR.

5) TURNOVER OF CONTRACT EMPLOYEES

a) The Contractor shall recognize the potentially negative impact on the MTF created by staff turnover and the expense incurred by the Government for orientation and approval of new workers.

6) PRIOR WRITTEN PERMISSION REQUIRED FOR SUBCONTRACTS.

a) None of the services required by this contract shall be subcontracted to or performed by persons other than the Contractor or the Contractor's employees without the prior written consent of the Contracting Officer.

7) RESTRICTION ON THE USE OF GOVERNMENT-AFFILIATED PERSONNEL.

a) Except in very limited cases, the federal criminal statutes at 18 USC 203 and 18 USC 205 bar Government personnel, both active duty and civil service, from working as a Contractor employee in a Government workplace, including a medical treatment facility, either as a second job ("moonlighting") or while on terminal leave. The Contractor agrees that, before making an employment offer to an active duty member or a civil servant, it shall inform the individual of the potential applicability of these statutes and further agrees to encourage that individual to seek an advisory opinion from his/her local ethics counsel before accepting an employment offer.

SECTION 11 - STANDARDS

A) STANDARDS OF CONDUCT

a. The Contractor shall maintain and enforce written Standards of Conduct for contract employees.

The document shall address the source of standards of ethical conduct and ethics guidance, including direction in the areas of employment disclosure systems, post-employment rules and enforcement of those rules, training and corrective action. The Contractor shall take appropriate corrective action in cases of violations of the Standards of Conduct. A report of the corrective action taken shall be provided to the Commanding Officer, via the COR, for concurrence.

b. Contract employees shall comply with Executive Order 12731, October 17, 1990, (55 Fed. Reg.

42547),

c. Principles of Ethical Conduct for Government Officers and Employees, and shall also comply with Department of Defense (DOD) and other government regulations implementing this Executive Order.

d. All financial, statistical, personnel, and technical data which are furnished, produced, or otherwise available to the Contractor during the performance of this contract are considered confidential business information and shall not be used for purposes other than performance of work under this contract. Such data shall not be released by the Contractor without prior written consent of the COR. Any presentation of any statistical or analytical materials, or any reports based on information obtained from studies covered by this contract, will be subject to review and approval by the COR before publication or dissemination. All inquiries from the media shall be forwarded to the Command Public Affairs Officer via the COR.

e. All records produced in the performance of this contract and all evaluations of patients are the property of, and subject to the exclusive control of, the Government. The Contractor may retain a copy of all such records or evaluations, but may not provide further copies or disclose the information from such records or evaluations to third parties. All requests from other treatment facilities or other individuals for patient records shall be handled in accordance with procedures specified by applicable MTF instructions.

f. The Contractor shall comply with all laws and regulations governing the provision of ambulance services in the Kingdom of Bahrain where transport is being provided, including motor vehicle operations, maintenance of equipment, qualifications and training of employees.

B) CONTRACT EMPLOYEE STANDARDS

a) Contract employees shall be neat, clean, well groomed, and in appropriate clothing during the performance of this contract. All clothing shall be free of visible dirt and stains and shall fit correctly.

Fingernails shall be clean and free from dirt, and hair shall be neatly trimmed and combed. Contract employees shall display an identification badge, which includes the contract employee’s full name (furnished by the Government) on outer clothing. Security badges provided by the Government shall be worn when on duty.

b) The Contractor and all contract employees shall comply with all MTF checkout processes. These processes include returning government property, e.g., identification badges, pagers, etc., to the MTF upon a contract employees last day of service. Failure to do so promptly may result in delay of payment to the Contractor.

c) Eating by contract employees is prohibited in patient care areas/clinics and is restricted to designated areas. Smoking is prohibited in all clinic facilities.

C) CONFLICT OF INTEREST

a) The Contractor shall not, while performing services under this contract, advice, recommend, or suggest to persons eligible to receive medical care at the Government’s expense that such persons should receive care from the Contractor at any place other than a Government facility.

SECTION 12 - DEFINITIONS

ACTIVE DUTY MEMBER: Full-time duty in uniformed service of the United States, including the United States Coast Guard, the Commissioned Corps of the United States Public Health Service and the National Oceanic and Atmospheric Administration. This includes full-time training duty, annual training duty and attendance while in the active service at a school designated as a service school by law or by the Secretary of the Military Department concerned. It does not include full-time National Guard duty.

ACUTE CONDITION (or ACUTE ILLNESS): A disease, or disease symptoms, which begins abruptly with marked intensity or severity, then subsides after a relatively short period.

COMMANDER/COMMANDING OFFICER: The individual Naval Officer who has responsibility for the operation of the medical treatment facility (MTF) for which the contract services are provided.

CONTRACTING OFFICER: The Government employee responsible for negotiating changes in terms, conditions, or amounts cited in this contract.

TECHINCAL POINT OF CONTACT (COR): The Government employee responsible for assuring the Contractor’s performance through audit, documentation, and liaison with the Contracting Officer. The COR has no authority to resolve disputes or obligate funds.

CONTRACT EMPLOYEE: For the purpose of this contract, “contract employee” means an individual employed by the prime or subcontractor.

CONTRACTOR: That entity or its representative responsible for the delivery of the services or materials specified in this contract, as designated by contract award.

DOCUMENT (verb): To completely, accurately and legibly record information, using prescribed forms or a computer terminal, as appropriate.

ELIGIBLE BENEFICIARY: Those listed in the Defense Enrollment Eligibility Reporting System (DEERS).

EQUIPMENT: A moveable object, such as a typewriter which is used to perform a procedure(s) that results in a work product.

JOINT COMMISSION ON ACCREDITATION OF HEALTHCARE ORGANIZATIONS (JOINT

COMMISSION): A national organization dedicated to improving the care, safety, and treatment of patients in healthcare facilities; publishers of the Joint Commission Accreditation Manual for Hospitals and the Ambulatory Healthcare Standards Manual.

PERSONNEL: A skilled and experienced professional and/or technical person who is essential for successful accomplishment of the work to be performed under this contract.

MAINTENANCE: The upkeep of buildings, fixtures, furniture, and/or equipment that is required to keep these items fully functional and/or to produce an acceptable level of performance or quality of operation.

MEDICAL DIRECTOR: Contracted Medical Director shall hold a license to practice medicine or osteopathy and be board certified in emergency medicine or board eligible. The Medical Director is resident in the medical treatment facility that the ambulance brings the patient to and is not required to be posted on base.

MEDICAL TREATMENT FACILITY (MTF): Unless otherwise specified, "the MTF" refers to the Naval MTF at which services are being performed under this contract. The MTF includes all activities providing outpatient and/or inpatient health services for eligible beneficiaries.

PERFORMANCE IMPROVEMENT (PI): An ongoing program designed to objectively and systematically monitor and evaluate the quality and appropriateness of patient care, pursue opportunities to improve patient care, and resolve identified problems.

PROTOCOLS: Written procedures providing basic guidelines for the management of specific types of situations related to medical patients, healthcare personnel, and/or medical treatment facilities (MTF's).

QUALITY ASSURANCE (CONTRACT): Those actions taken by the Government to check goods or services to determine that they meet the requirements of the contract.

QUALITY CONTROL: Those actions taken by the contractor to control the provision of services so that they meet the requirements of the Performance Work Statement.

QUALITY IMPROVEMENT (MEDICAL): An ongoing program designed to objectively and systematically monitor and evaluate the quality and appropriateness of patient care, pursue opportunities to improve patient care, and resolve identified problems.

Contractor Manpower Reporting:

The contractor shall report contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the U.S. Navy via a secure data collection site. Contracted services excluded from reporting are based on Product Service Codes (PSCs). The excluded PSCs are:

(1) W, Lease/Rental of Equipment;

(2) X, Lease/Rental of Facilities;

(3) Y, Construction of Structures and Facilities;

(4) D, Automatic Data Processing and Telecommunications, IT and Telecom- Telecommunications Transmission (D304) and Internet (D322) ONLY;

(5) S, Utilities ONLY;

(6) V, Freight and Shipping ONLY.

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year.
