22.2-8 BASIS FOR AWARD.

• The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable proposal. In accordance with FAR 52.204- 7, to be eligible for award, the offeror must be registered in the System for Award Management (SAM) electronically via https://www.sam.gov/ both at the time of submission of the offer and at the time of award.

• As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

• The Lowest-Price Technically Acceptable (LPTA) process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

• An overall technical rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall technical proposal being rated “UNACCEPTABLE” unless corrected through discussions (if held) . An overall technical rating of “UNACCEPTABLE” makes a proposal ineligible for award.

22.3 CONFIDENTIAL INFORMATION

The Freedom of Information Act (FOIA) and its amendments have resulted in an increasing number of requests from outside the Government for copies of contract qualifications and proposals submitted to federal agencies. If an offeror’s submissions contain information that he/she believes should be withheld from such requestors under FOIA on the grounds that they contain “trade secrets and commercial or financial information” [5 USC§552(b)(4)], the offeror shall mark its submissions in the following manner:

The following notice shall be placed on the title page: “Some parts of this document, as identified on individual pages, are considered by the submitter to be privileged or confidential trade secrets or commercial or financial information not subject to mandatory disclosure under the Freedom of Information Act.

Material considered privileged or confidential on such grounds is contained on page(s) _______.”

Each individual item considered privileged or confidential under FOIA shall be marked with the following notice:

“The data or information is considered confidential or privileged, and is not subject to mandatory disclosure under the Freedom of Information Act.”

Please note that such marking does not in and of itself render the material exempt from FOIA. Rather, the markings will call to the agency’s attention the offeror’s assertion of confidentiality. Upon receipt of a FOIA request, the agency will evaluate and coordinate as needed to ensure it complies with FOIA.

22.4 SOLICITATION RESPONSE REQUIREMENTS

22.4-1 GENERAL

The offeror shall submit documentation illustrating their approach for satisfying the requirements of this solicitation. Proposals must be clear, coherent, and prepared in sufficient detail for effective evaluation of the offeror’s proposal against the evaluation criteria. Also, this documentation shall cover all aspects of this solicitation and include the offeror’s approach for program management activities. Proposals must clearly demonstrate how the offeror intends to accomplish the project and must include convincing rationale and substantiation of all claims. Unnecessary elaborate brochures or other presentations beyond those sufficient to present a complete effective response to the solicitation are not desired.

The offerors shall describe their proposal, through the use of graphs, charts, diagrams or a narrative, in sufficient detail for the Government to understand and evaluate the offer. In its evaluation, the Government will consider the degree of substantiation of the offer in the proposal.

All correspondence in conjunction with this solicitation should be directed to the Government Contracting Officer identified below:

Contracting Officer’s Name: Ashley Williams Phone Number: 843.228.3982 E-mail address: ashley.h.williams8.civ@us.navy.mil

Text and graphics portions of the electronic copies shall be in a format readable by Microsoft (MS) Word.

Data submitted in spreadsheet format shall be readable by MS Excel. Adobe Acrobat pdf format is also acceptable. See Section 22.2, Proposal Delivery, for proposal submission details.

22.5 TECHNICAL FACTOR REQUIREMENTS

Offerors shall submit a detailed proposal in compliance with conditions of this solicitation. The technical proposal shall include a narrative description of the Offeror’s experience and capabilities, as well as their planned approach to performance, that contains sufficient information to enable the Government to make a thorough evaluation and a sound determination as to whether the proposed services are adequate to meet the Government requirements in the PWS. The offeror shall demonstrate experience with providing annual inspections and load testing described in the PWS and shall be insured and licensed in the state of South Carolina to work on lift equipment. The Technical Approach shall be specific, detailed, and sufficiently complete to clearly and fully demonstrate the offeror’s total comprehensive knowledge and understanding of the requirements and technical problems inherent to the work required. Generalized statements within the proposal, such as, “standard procedures will be employed”, or “well known techniques will be used,” will be considered technically inadequate.

Paraphrasing any part of the solicitation will also be considered inadequate.

Offeror’s should note that data submitted prior to the proposal submission will not be considered in the Government’s evaluation. Therefore, such data should not be relied upon nor incorporated in the technical proposal by reference. All offerors are encouraged to submit substantial detail in response to this factor.

All contractor personnel shall meet or exceed the qualification standards, experience levels, and trade backgrounds set forth in the technical proposal.

In the event of an inconsistency between the provisions of this contract and the technical proposal, the inconsistency shall be resolved by giving precedence in the following order: (i) the contract (excluding the technical proposal), and then (ii) the technical proposal.

22.6 PAST PERFORMANCE

(a) The Supplier Performance Risk System (SPRS) application (https://www.sprs.csd.disa.mil) will be used in the evaluation of suppliers' past performance in accordance with DFARS 213.106-2(b)(i).

(b) SPRS collects quality and delivery data on previously awarded contracts and orders from existing Department of Defense reporting systems to classify each supplier's performance history by Federal supply class (FSC) and product or service code (PSC). The SPRS application provides the contracting officer quantifiable past performance information regarding a supplier's quality and delivery performance for the FSC and PSC of the supplies being purchased.

(c) The quality and delivery classifications identified for a supplier in SPRS will be used by the contracting officer to evaluate a supplier's past performance in conjunction with the supplier's references (if requested) and other provisions of this solicitation under the past performance evaluation factor.

22.7 PRICE FACTOR REQUIREMENTS

The offeror shall complete blocks 30a, 30b, and 30c of the SF 1449 (1st page of this solicitation). The offeror must submit acknowledgement of any amendments issued prior to the closing date of the solicitation. In addition, Offerors shall complete provisions and submit Offerors Representations and Certifications with their proposal as identified in FAR Clause 52.212-3 in the SF 1449 solicitation.

“Pricing Schedule” shall be completed by the offeror in accordance with the following:

a) All prices contained in the pricing schedule reflect total compensation for the services detailed therein and are fully inclusive of all costs including labor (workers, management, aids, assistants, and operators), overhead, general and administrative (G&A) expenses, and profit.

b) Annual inspection and load testing are considered commercial in nature. The service to be provided, in whole or in part, is a readily available service provided in the general competitive marketplace. Offeror shall submit its price proposal in the following format:

i. Offeror shall propose a firm fixed price for each CLIN to include the base period and all option periods.

For purposes of evaluating offers for award, the Government will utilize the pricing submitted for the base year and all option periods.

ii. See PRICING OF CLINS, Section 15 for details on pricing.

23. EVALUATION OF PROPOSALS: Proposers shall submit a lump sum price and individual price (Notice to Offerors, Section 17 for Bid Schedule), for CLINS 0001 through 0005. For purposes of evaluating offers for award, the Government will utilize the pricing submitted for the base year and all option periods. Refer to FAR 52.212-2, EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021).

23.1 EVALUATION FACTORS. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price, past performance, and other factors considered. The following factors shall be used to evaluate proposals:

a) Price

b) Past Performance: The apparent successful, prospective contractor must have satisfactory or neutral past performance. Past Performance shall be evaluated in accordance with FAR 13.106-2. The Supplier Performance Risk System (SPRS) application (https://www.sprs.csd.disa.mil) will be used in the evaluation of suppliers’ past performance in accordance with DFARS 213.106-2(b)(i).

c) Technical:

Solicitation Submittal Requirements:

• Narrative desciving your approach to performance. Contractor’s proposed supplies or services shall, at a minimum, meet the salient characteristics, specifications, deliverables, or performance requirements outlined in the solicitation.

• Capability of Key Personnel: Submit key personnel qualifications, experience, and training, including resumes of the Project Manager, Superintendent, and other key personnel.

• For relevant experience submit a minimum of three (3) to a maximum of five (5) relevant projects that are similar in size, scope and complexity.

Basis of Evaluation. Offeror’s will be evaluated to confirm they have proposed an experienced and qualified team with defined roles and responsibilities, as well as capacity and resources to perform demonstrating knowledge of the content of the work and technical solution.

Proposals will initially be screened for price and placed in order of price (lowest price to highest price).

The Navy will then evaluate the non-price factors of the three (3) lowest priced proposals. The Navy will make award to the lowest priced technically acceptable proposal from among the three (3) lowest priced proposals.

However, if no proposals are found to be technically acceptable within the first group of proposals, the Navy, at its sole discretion, reserves the right to increase the number of proposals it will review, until the Government identifies a technically acceptable proposal. Accordingly, under this methodology, the technical factors of some proposals may not be evaluated by the Navy. If discussions are deemed necessary by the Contracting Officer, all proposals will be evaluated (both non-price and price) for the purpose of establishing a competitive range NOTE: Offerors MUST be evaluated as technically ACCEPTABLE under factors 2 (Past Performance) and 3 (Technical) in order to be considered technically acceptable overall.

23.2 OPTIONS. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

23.3 NOTICE OF AWARD. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

24. CONTRACT CORRESPONDENCE AND INQUIRIES

All correspondence/inquiries shall Reference the appropriate Contract Number, and shall be submitted to the email points of contact address:

FEAD Parris Island Contract Specialist Ashley Williams, 843-228-3982, ashley.h.williams8.civ@us.navy.mil
