About this file
This document is a Department of Navy (DON) Single Source Justification for a sole-source acquisition under the simplified acquisition threshold. The procurement involves removal and replacement of existing condensate piping from B86 to multiple manholes (MH8, MH7, and MH6), with a required delivery date of 9/15/25. The justification cites unusual and compelling urgency due to significant safety hazards, including steam leaks that obstruct vehicular and pedestrian traffic, cause potential burns, and lead to infrastructure degradation.
The document emphasizes critical mission requirements and immediate safety concerns, noting that the underground steam and condensate distribution systems are in poor condition, with multiple steam emissions from manholes. The UEM pipe shop cannot handle the extensive repair work needed. The procurement is deemed urgent to prevent further safety risks, infrastructure damage, and mission impact, with the typical timeline for development, market research, and acquisition not being feasible in this scenario. The technical requirements were certified on 6/18/25, and the contracting officer digitally signed the document on 6/20/25.

DON SAP SINGLE SOURCE
AUG 2018
Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE: Removal and replacement of existing condensate piping from B86 to man hole 8, MH8 to MH7, and MH7 to MH6.
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING:
A. ___ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required. N/A
2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM. N/A
3. _X__ OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer. N/A
C. __X_UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified: 5/29/25 (WIB date)
2. The required delivery date or BOD date is 9/15/25.
3. Explanation of why delivery/commencement of services by the date mentioned above is required: This action for arresting steam leaks in the steam and condensate systems is to satisfy an urgent and immediate need to eliminate existing safety hazards, mission impacts and to limit the ongoing degradation of the utilities. The condensate piping replacement is also necessary to provide the steam heating capabilities to various critical facilities at a critical time. Change over for the heating season will commence as soon as the work is complete.
4. The underground steam and condensate distribution systems are in poor condition in many areas of the installation. The failing conditions have caused a number of compounding issues leading to steam emitting from multiple manholes. The quantity and nature of the work required to arrest and repair the multitude of leaks is outside of the ability for the UEM pipe shop. The steam coming from the structures is causing safety hazards. The steam is obstructing visibility for vehicular and pedestrian traffic. A number of the steam discharges are in pedestrian walkways and there have been multiple instances of burns from billowing steam and boiling water coming from the manholes. In addition to safety concerns, the steamy environments within the underground structures degrade the existing infrastructure further. Allowing the leaks to persist will result in increased cost to repair the infrastructure damaged. The repair efforts will require a concentrated multi-discipline approach to arrest and then repair
Statement of Impact/Urgency: The Government requires the work described in enclosure (1) immediately to meet critical mission requirements. Failure to provide the work immediately will jeopardize successful mission accomplishment in that Existing steam leaks in the system pose an immediate risk to safety of pedestrian and vehicular traffic. The leaks and repairs identified in enclosure (1) are in high traffic areas. There have already been multiple burns to pedestrians walking over leaking utility structures and complaints about visibility. In addition to safety concerns, steam and condensate is corrosive and causes additional degradation when it leaks. While the leaks are active, degradation of systems within the mechanical structures compound. Steam also enters buildings and degrades drywall and other surfaces in addition to increasing the risk of mold development. The typical timeline for project
May 2022 2 development, market research, acquisition, negotiation and subsequent award is not an option in this particular scenario and will continue to increase the already existing and continuously growing concerns to both personnel safety and impact to the mission.
