FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
The contracting activity is Naval Facilities Engineering Systems Command, Mid-Atlantic
(NAVFAC MIDLANT).
2. Description of the Action Being Approved.
This Justification and Approval (J&A) authorizes the use of the following brand name materials for security equipment that will be required as part of the construction project for the Naval Surface Warfare Center (NSWC) as part of solicitation N4008524R2721, Design/Bid/Build (DBB), Building 29 anti-terrorism force protection (ATFP) at the Philadelphia Naval Business Center (PNBC), Pennsylvania:

-Ameristar Stalwart IS Post & Rail: K8/L2 rating -Barrier 1 SPB-400: Deep Foundation Bollard, M30/P1 rating -Barrier 1 SMB-400: Shallow Foundation Bollard Array, M30/P1 rating
3. Description of Supplies/Services.
The intention of this solicitation is to install a crash-rated perimeter around Building 29 as a result of the PNYA Perimeter Security Study for Security Engineering Planning Assessment (SEPA) criteria and recommendations. The proposed action includes the installation of crash-rated post and rail, shallow foundation crash rated bollard array, deep foundation crash-rated bollards, crash rated drop-arm barriers, and associated modifications to utilities and roadways.
The proposed action is required to protect multiple Naval Surface Warfare Center Philadelphia Division (NSWCPD) buildings and assets. The proposed action does not include any alterations to character defining features of Building 29.
Solicitation N4008524R2721 includes the installation of a crash-rated perimeter and incidental related work to protect the buildings and assets located at Building 29 and incidental related work.
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C. 3204(a)(1) which permits the use of limited suppliers when it is essential to the Government’s requirements, as implemented by FAR 6.302-1. Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
The Navy is required by UFC 4-022-01 and UFC 4-022-02 to utilize secured perimeter barriers from the DoD Anti-Ram Vehicle Barrier List for DoD projects. Based on the limited products on that list, the geographic location/site constraints, and coordination with state historical preservation, only the secured perimeter barriers listed in Section 2 above will satisfy the Navy’s mission.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer will determine that the price for this acquisition is fair and reasonable in accordance with FAR Part 15 prior to task order award. Analysis will be performed by one or more of the following techniques: (1) Comparison of proposed prices received in response to the RFP; (2) Comparison of proposed prices with the Independent Government Cost Estimate (IGCE); (3) Comparison of proposed prices with available historical information; and/or (4) Comparison of market survey results.
8. Actions to Remove Barriers to Future Competition
For the reasons set forth in Paragraph 5, NAVFAC Mid-Atlantic has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC Mid-Atlantic will assess whether competition for future requirements is feasible.
