Pest Control Services, Portsmouth Naval Shipyard, Kittery, Maine

1. Question: I am writing to seek clarification regarding the coverage of service orders under the recurring ELINs as outlined in our contract. My understanding is that all service orders should be included within the recurring ELINs framework.

Answer: Correct, Service Orders are included in the Recurring Services. Service calls are intended to capture work that is not covered in Recurring services included in Annex 1503020 C, Spec items 3 through 3.3

2. Question: Section 3.2 of the contract specifies that the contractor is responsible for all work up to a Pest Control service order limit of liability of $500 in direct labor and material costs per order. It further states that the government will only cover costs exceeding this liability limit for direct labor and/or materials.

Answer: Cost for the service call with the limit of liability (LOL) of $500.00 is included in the pricing for Recurring Services, when performing work under a service call and the limit of liability is reached, but in order to complete the service call it would go over the LOL, you must stop and notify the contracting officer (KO). The KO will then determine if work will continue or not, should work be required to continue over the limit of liability the government would provide payment via Government Purchase Card (GPC) or a nonrecurring services task order. Examples of work exceeding the pest control service order limits of liability: If a pest control service order requires $600 in direct labor and direct material cost, the Government may issue a task order in accordance with the Non-Recurring Work provisions of the contract for the one direct labor hour and $100 in direct material cost that exceeds the pest control service order limit of liability.

3. Question: However, I noticed that certain services listed under the non-recurring ELIN schedule appear as though they might be more appropriately classified under the recurring ELIN schedule. These services include pest vertebrate control, commensal rodents control in and around buildings and structures, miscellaneous arthropod pest control, and honey bee control. Could you clarify if there are specific circumstances under which we would bill these items individually?

Answer: Pest vertebrate control, commensal rodents control in and around buildings and structures, miscellaneous arthropod pest control, and honeybee control are included in the Recurring Services in Annex 1503020 C, spec items 3.1 through 3.1.6. Non-Recurring services are ordered/issued by the government via GPC or a task order. Non-Recurring services are not funded at the start of the option year; they are funded via a GPC or Task order when any Non-Recurring work is ordered by the government. Upon completion of an ordered Non-Recurring ELIN, you would either bill the GPC or submit an invoice in WAWF if work is ordered via task order.

The RFP is amended in full by the following changes:

1. The following paragraph was removed from Annex 1503020 C Pest Control v2.4, Spec Item 3.2 Pest Control Service Orders. The revised Annex is enclosed in this amendment.

The Contractor may invoice for completed pest control service orders. The Contractor shall not invoice for incomplete pest control service orders and pest control service orders not issued. A modification will be process at the end of each period of performance to deduct for pest control service orders not issued and incomplete pest control service orders. Deduction will be based on the unit prices specified in Attachment J-0200000-08 ELINs.

2. The following ELINs were corrected for the base year and all option years:

ELINs X001AG and X002AF were changed from unscheduled services per Spec Item 3.2 to Service Orders per Spec Item 3.2. The revised is attachement J-0200000-08 ELINs Pest- Rev 2-26-24.

3. Please provide a revised proposal no later than March 1st, 2024.
