AMENDMENT 0002

Solicitation N40085-20-R-4004 Landfill Maintenance and Repair Services

This amendment should be acknowledged when your proposal is submitted. Failure to acknowledge may constitute grounds for rejection of your proposal.

1. Question: Attachment J-1502000-09 details Hardware and operating systems for each device (3). It shows a minimum requirement and a recommended system. What do we actually have running currently and does it meet the requirements?

Answer: Software system currently running is: CompuWeigh by Paradigm Software (remove attachment J- 1502000-09 and replace with Amendment 0002 Revised Attachment J-1502000-09). The system meets the Governments required needs, it is understood that upgraded systems have occurred since the present system was installed; the upgrades will be accepted based on Attachment J-1502000-09 revision.

2. Question: Should we plan to upgrade the system to the recommended system as detailed in Attachment J-

1502000-09

Answer: Upgrade the system based upon the Amendment 0002 Revised Attachment J-1502000-09.

3. Question: Attachment J-1502000-09 details (3) devices at the site visit we were told only (2) existed which is correct?

Answer: Correction based upon Amendment 0002 Revised Attachment J-1502000-09, three (3) devices.

4. Question: What is the preferred software application for this scales function?

Answer: The Government will not dictate which software the contractor obtains, however; the software application must meet all of the recommended specifications of Amendment 0002 Revised Attachment J-1502000-09, and function as the existing system does. (The application must interface with the scales. The failure of the software or hardware to interface with scales will be a cost risk to the contractor and no added expense to the Government.)

5. Question: Spec item 3.7-3.7.2 does not give a response time for system issues, what is the allowed response time for addressing issues?

Answer: Based upon the manufacture troubleshooting protocol by phone, if the issue is not resolved by phone, technical assistance is required to response on site within 24 hours after the phone attempt to troubleshoot the system issues. Refer to the Amendment 0002, Revised Annex 1502000 – Facility Investment (FI).

6. Question: Can an onsite visit be arranged to see the current equipment and software to ensure the proper application of software and hardware?

Answer: The Government will not conduct another onsite visit; however, any of the interested contractors may revisit the site. Please identify yourself to the Landfill personal with your gate pass and inform them that you are and interested contractor regarding the future contract.

7. Question: Will a warranty be required and for what length of time?

Answer: Yes, a warranty requiring five (5) years or the life cycle of the contract, refer to the Amendment 0002 Revised Annex 1502000 C (FI).

8. Question: At the site visit, the question was asked if re-lettering, stenciling, labeling was required we were told no, the solicitation says we are responsible see ATTACHMENT J-1502000-04 & 04-1. Which is correct?

Answer: All stenciling and labeling will be processed by the Government, refer to the Amendment 0002 Revised Attachments J-15020000-04 and J-1502000-04-1.

9. Question: ATTACHMENT J-1502000-03 shows very good historical data for the number of repairs, is there any break down as to the level of repair i.e., minor, average, major?

Answer: The following historical data is provided:

40 cubic yard open tops 11 major repairs 30 cubic yard open tops 26 major repairs 20 cubic yard open tops 5 major repairs 8 cubic yard drop bottom 25 major repairs 8 cubic yard trash front loader 200 major repairs 8 cubic yard cardboard front loader 150 major repairs. (Refer to Amendment 0002 Revised attachment J-1502000- 03).

10. Question: When containers are designated for repair and queued does that mean any that is repaired must be painted?

Answer: When containers are positioned in the work area container are considered designated for repairs and must be sanded, primed, and painted according to the specs provided in Attachment J-1502000-02 through 04-01. The PAR will provide the Contractor with details and degree of repairs for specific work on task orders.

11. Question: ATTACHMENT J-1502000-02 at the bottom it says to paint container utilizing government paint spec’s do we have a copy of this specification?

12. Question: Attachment J-0200000-07 ELIN A001AM Startup and Hardware Support is this ELIN to be used to cost new hardware and software for upgrading the system? There is no material cost in this ELIN.

Answer: ELIN A001AM is an all-inclusive one-time cost for the entire system. IDIQ (non-recurring services will be utilized for the Scales System Maintenance ELIN’s)

13. Question: Under the Basis of Award (page 94 of 100) of the solicitation, the Government indicates that teaming arrangements will not be acceptable for consideration for award. However, the Amendment 1 somewhat contradicts this basis in that it states that subcontractor experience may be submitted and considered for overall Corporate experience and past performance in the evaluation process. Please clarify if the Prime contractor may identify a team subcontractor in its proposal for certain scope areas (including Corporate Experience), and this will be acceptable for evaluation and potential award.

Answer: Amendment 0001 was issued to allow a Subcontractor to bid for the work as well as a prime. If the Prime Contractor is bidding for the work, the Prime is allowed to submit the ratings under their umbrella as the work was performed under the responsibility of the prime, but not under both company names (simply state that the subcontractor performed the work). If the Subcontractor is bidding for the work, they must submit ratings/past performance under their companies name and not the Primes name (simply state that the work was performed for a Prime contractor).

14. Question: Please include the PPQ and Attachment C, Corporate Experience form, as they were not provided with the Solicitation.

Answer: Section J Annex 0200000 Table of Content Revised under Amendment 0002 Attachment J-0200000-08 (Attachment C and Performance Questionnaire (Form PPQ-0) provided.

15. Question: You have stricken the line indicating that past performance as the prime is required under i) Factor 2.

However, the requirement remains under ii) Factor 2 as a list of criteria for the basis of evaluation (use of 'and' indicates all three criteria must be met). Based on the current language, at least 2 of the projects must be facility support services as described in RFP and contractor must be performing as prime on the two facility support services criteria at a value $400K-$1.5M. You must be performing as the prime on at least three. Furthermore, under i) the requirements stipulate all past performance must be $400K-$1.5M. Is that correct?

Answer: The offeror shall provide information of at least three (3), but not more than five (5), relevant projects that best demonstrate experience with projects that are similar to the size and scope of this solicitation. (Correct)

Relevant experience managing similar projects with at least two (2) facility support service contracts with a contract price range of $400,000 to $1.5 M annually, completed within the past five (5) years from the date of receipt of proposals. (Correct) Revised wording on page 97 of 100 under Factor 2, Corporate Experience, to correspond with the changes in Amendment 0001, (i) Solicitation Submittal Requirements.

(ii) Basis of Evaluation: change from Experience performing as a prime contractor AND change TO as follows:

Experience performing as a prime contractor or a subcontractor, and

16. Question: There is a statement on Page 2 of the RFP stating "teaming arrangments will not be considered".

Does this mean we cannot use subcontractors in performance of the contract?

Answer: Contractors may employ subcontractors to do specific work in accordance with FAR Clause 52.219-14, Limitation on Subcontracting. Companies are required to limit the amount of work performed by subcontractors.

Details are provided in the clause.

17. Statement "Relevant experience managing similar projects with at least two (2) facility support service contracts with a contract price range of $400,000 to $1.5 million annually, completed within the past five (5) years from the date of receipt of proposals. Facility support services include services such as landfill management, leachate system cleaning, grounds maintenance and pest control, specialized technique for waste containers repairs/refurbishment, and maintenance of weight scales"

Question based on this: Is the requirement that at least (2) facility support service contracts need to have NAICS 561210 or is it based on similar services description?

Answer: As stated in the response to question #15 (Relevant experience managing similar projects with at least two

(2) facility support service contracts with a contract price range of $400,000 to $1.5 M annually).

18. Question: The Due Date is currently Tuesday, February 18 at 2PM ET. Since this requires a hard copy submission and the day before is a federal holiday (President's Day) would the government consider extending the Due Date to Friday, February 21? This will provide easier accommodations as related to printing and mailing of proposals.

Answer: This solicitation was issued under an Urgent and Compelling Circumstances and cannot be extended.

February 18, 202 at 2:00 PM EST will remain as the due date.

19. Question: Was there a sign-in sheet for the site visit on 1/23? If so, will the government please post a copy?

Answer: There was a sign-in sheet for the site visit. The Government is NOT required to publish or post the sign in sheet for a site visit.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT

YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE

RATING DEFINITION NOTE

(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit.

The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.

An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.

(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit.

The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.

A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.

(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.

A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.

(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.

A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.

(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.

An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.

(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.
