STATEMENT OF WORK

1. Points of Contact

2. General Description

2.1 The Contractor shall provide supervision, labor, material, and equipment required to perform all work for the following project: Repair and upgrade air handling units at McCarty Little Hall (B27). All work shall be done in a manner to provide a complete, usable and finished end product. See section “16. Work Requirements” for an expanded and detailed scope of work.

2.2 All work shall be performed in accordance with, but not limited to, the standards referenced herein, state and federal codes, laws and regulations, and the Unified Facilities Criteria.

3. Location

The work shall be performed at Building 27 McCarty Little Hall (MLH).

4. Time for Completion

The project Contraction Completion Date (CCD) shall be (120) calendar days from receipt of Notice to Proceed (NTP).

5. Examination of the Premises

Site visits not mandatory but encouraged and can be arranged by contacting the Contracting Officer Representative (COR).

6. Inspection and Approval

All material and workmanship shall be subject to the inspection and approval of the COR.

7. Special Scheduling Requirements/Work Procedures

7.1 Service shall be performed during standard business hours Monday thru Friday.

7.2 Existing and adjacent spaces to remain in operation during construction shall be protected from damage, dust, and debris at all times. Damage to any existing spaces, finishes, items, furniture and equipment, as a result of the contractor’s operations, shall be replaced in-kind by the Contractor at no expense to the Government.

7.3 Construction work areas shall have complete and secure separation from adjacent occupied areas.

7.4 The Contractor must perform positive identification and locating of existing utilities prior to any concrete chipping, saw cutting, core drilling, or digging of any kind.

7.5 Work shall be scheduled so as to minimize major HVAC impacts to MLH. MLH has a high cooling demand throughout the calendar year. Schedule will need to be discussed in detail to ensure building operations are not affected due to impacts associated with this work.

7.6 Only one (1) Air Handling Unit (AHU) can be offline at any given time.

7.7 Work within MLH requires full time escort. NWC to provide no more than two escorts at one time. Contractor shall coordinate subcontractors and schedule accordingly.

8. Passes and Badges

8.1 All Contractor employees shall obtain the required employee and vehicle passes.

8.3 Contractor to obtain daily badges from NWC Security Office located in B686 (Conolly Hall). NWC picture badges may be provided to full time contractor employees (i.e.

superintendent, QC Manager, etc.).

9. Safety

9.1 All work shall be conducted in a safe manner and shall comply with all requirements of the U.S. Army Corps of Engineers Safety and Health Requirements Manual EM-385-1-1.

9.2 The Contractor shall submit the Accident Prevention Plan and Activity Hazard Analysis plan for approval by the COR. Submit within (7) days from issuance of this Contract Award, and obtain approval prior to start of any construction activities.

11. Hazardous Materials Disclosure Statements

11.1 Hazardous material must be identified and Material Safety Data must be included for all hazardous material in accordance with EM-385-1-106.B.03e.

11.2 If the contracted work involves the use of hazardous material the contracting officer must receive both a hazardous material inventory report and a daily report including an identification and quantity of the hazardous material used or removed.

12. Submittals The Contractor shall submit (manufacturers’ product data, shop drawings, testing data, manufacturer warranties, work schedule, equipment checklist, and any additional to suit project) documents required for government approval, prior to the start of any construction activities.

13. Competent Person (CP) Submit name, address, and telephone number of the CP selected to perform responsibilities specified in paragraph COMPETENT PERSON (CP) RESPONSIBILITIES. Provide documented construction project-related experience for the specified work. (e.g., confined space entry, scaffolding, fall protection or any other activities as specified by OSHA/this manual) shall be identified and included in the AHA, as well as proof of their competency/qualification.

Submit proper documentation that the CP is trained and certified in accordance with federal, State and local laws.

14. Competent Person (CP) Responsibilities

a. Verify training meets all federal, State, and local requirements.

b. Ensure work is performed in strict accordance with specifications at all times.

c. Control work to prevent hazardous exposure to human beings and to the environment at all times.

d. Certify the conditions of the work as called for elsewhere in this specification.

e. The responsibilities are required but not limited to the work specified in this document. All requirements shall comply with the U.S. Army Corps of Engineers Safety and Health Requirements Manual EM-385-1-1.

f. Recognizes or uses correct English grammar, punctuation, and spelling; communicates information (for example, facts, ideas, or messages) in a succinct and organized manner;

produces written information, which may include technical material that is appropriate for the contract. Proficient to use today’s office technology, and computer software including MS Office with a focus on Microsoft Word, Excel PowerPoint and the ability to make files into PDF format.

15. Contractor Presence An employee of the prime contractor who has full authority to make decisions and obligate the prime contractor shall be physically present at any requested key meetings and site visits.

Examples of these key meetings include but are not limited to pre-construction meetings, progress meetings, and inspections at the job site. Sending a subcontractor to represent prime contractor at related meetings is not authorized.

16. Work Requirements.

The contractor shall provide all necessary materials, labor, services, and equipment to complete the work described below, and as indicated in enclosures and associated specifications. The project shall include, but not limited to, the various upgrades to the air-handling units as described below. See Enclosure_1 for locations of the air handling units and Enclosure_2 for existing equipment information.

16.1 Air Handling Unit #1 (McQuay Model #LSL128DV; Services 1st Floor).

• Replace outdoor air and return air dampers and associated damper actuators (two per damper).

• Replace cooling coil. Include replacing section/panel of air handling unit measuring approximately 43” x 43” for coil removal and installation.

16.2 Air Handling Unit #3 (McQuay Model #LSL172DH; Services 2nd Floor).

• Replace outdoor air and return air dampers and associated damper actuators (two per damper).

16.3 Air Handling Unit #4 (McQuay Model #LSL141DV; Services MLH-110).

• Replace outdoor air and return air dampers and associated damper actuators (two per damper).

16.4 Air Handling Unit #5 (McQuay Model #LSL141DV; Services 3rd Floor).

• Replace return air damper only and associated damper actuators (two per damper).

16.6 Equipment requirements

• Mixed Air & Fresh Air Dampers: Johnson Controls VD-1630 Class 1A volume dampers or approved equal. Frames are to be constructed of formed 16-gauge galvanized sheet steel, with linkage concealed in the side channels to eliminate noise and friction. Compressible spring stainless steel side seals and self-lubricating bearings shall also be provided. Blades are to be constructed of rollformed-galvanized steel in an airfoil shape. Damper blade width shall not exceed 8 inches and shall have seals. Blade action is to be parallel or opposed as shown on the schedules. Performance shall be designed for very tight shutoff and tested in accordance with AMCA Standard 500. Damper shall perform to leakage class 1A at 1 in.

w.c. and class 1 up to 10 in. w.c. with a holding torque of 5 in-lbs/sq.ft. The damper must be rated to operate over a temperature range of -40 to 200°F (-40 to 93°C) standard and -72 to 275°F (-60 to 135°C) extended temperature. Sizing shall be determined by the contractor in accordance with accepted industry practices to ensure proper system performance. Provide Jackshaft on all dampers.

• Damper Actuators: Johnson Controls M9220-GGA-3 Proportional Electric Actuators or approved equal. Contractor to verify size needed to accommodate split dampers.

16.7 Installation requirements

• Dampers: Contractor is responsible for a complete and functional damper system post installation. This includes testing, balancing (minimum and maximum air flows), and confirming proper damper operation via the existing DDC system. Include necessary repairs to AHU framework, ductwork, piping, and/or insulation that is damaged during installation of dampers.

• Cooling Coil: Contractor is responsible for all aspects associated with the coil replacement.

This includes isolating and draining existing coil and removing insulation back to the control valve, removal and reinstallation of incidental electrical components attached to the AHU, replacement of any gaskets at Victaulic fittings, re-insulating all exposed piping back to the control valve (approximately 20LF), and replacing section/panel of AHU measuring approximately 43” x 43” for coil removal and installation. Contractor will be responsible for pressure testing coil, refilling/purging any entrapped air, and balancing to original flow rates.

3. CHANGES TO SOLICITATION

All changes will be issue via Amendment and posted to the Contract Opportunities website at https://beta.sam.gov/. It is the contractor’s responsibility to monitor for any changes or updates.

Submit in writing all Request for Information (RFI) to the Point of Contact by 28 February 2020, 3:00 PM, Eastern Standard Time (EST). Include Solicitation Number and Project Title in subject line of the email.

If applicable, the Government will issue Amendments by 5 March 2020.

4. MINIMUM INSURANCE REQUIREMENTS

a. The contractor shall procure and maintain during the entire period of performance under this contract the following minimum insurance coverage (also refer to FAR Clause 52.228-5):

1. Comprehensive General Liability: $500,000 per occurrence.

2. Automobile Liability: $200,000 per person, $500,000 per occurrence, $20,000 per occurrence for property damage.

3. Workmen’s Compensation: As required by Federal and State workers’ compensation and occupational disease laws.

4. Employer’s Liability Coverage: $100,000 except in states where workers compensation may not be written by private carriers.

5. Others as required by State of Rhode Island.

b. Prior to commencement of work, the contractor shall furnish to the Contracting Officer a certificate or written statement of the above required insurance. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interests of the Government in such insurance shall not be effective for such period as may be prescribed by laws of the state in which the contract, N40085-20-C-3311 is to be performed, and in no event less than thirty (30) calendar days after written notice thereof to the Contracting Officer.

c. The Contractor agrees to insert the substance of this clause, including this paragraph (c), in all subcontracts hereunder.

Cancellation Language: The cancellation language must state, "Any cancellation or any change in the limits of liability shall not be effective (1) for such period as the laws of the state in which this contract is to be performed prescribe or (2) until 30 days after the insurer gives written notice to the Contracting Officer, whichever period is longer.” Wording such as "will endeavor to mail notice" or “failure to mail such notice shall impose no obligation or liability" does not comply with the contract requirements and therefore are not acceptable.

7. CONTRACTOR EVALUATION PERFORMANCE REPORTING SYSTEM (CPARS)

The Contractor is required to provide the Government with the name, telephone phone number, and e-mail address of the Contractor’s Representative who will be responsible for the receipt and review of draft performance evaluations prepared by the Government. It is the Contractor’s responsibility to keep this contact information current. Review CPARS requirements at https://cpars.csd.disa.mil.

8. EMPLOYMENT ELIGIBILITY VERIFICATION

If contractor is not enrolled as a Federal Contractor in E-verify at time of award, then the Contractor shall enroll a Federal Contractor in E-verify within thirty (30) calendar days of contract award. Refer to FAR Clause 52.222-54 for further instructions.

52.204-7 SYSTEM FOR AWARD MANAGEMENT (OCT 2018)

(a) Definitions. As used in this provision--

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that--

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''.

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.

(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

(1) Company legal business name.

(2) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(3) Company physical street address, city, state, and Zip Code.

(4) Company mailing address, city, state and Zip Code (if separate from physical).

(5) Company telephone number.

(6) Date the company was started.

(7) Number of employees at your location.

(8) Chief executive officer/key manager.

(9) Line of business (industry).

(10) Company headquarters name and address (reporting relationship within your entity).

(d) Processing time should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://www.sam.gov for information on registration.

52.204-8 ANNUAL REPRESENTATIONS AND CERTIFICATIONS (OCT 2018)

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238220 – Plumbing, Heating, and Air-Conditioning Services.

(2) The small business size standard is $16.5 Million.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.

(b)(1) If the provision at 52.204-7, System for Award Management, is included in this solicitation, paragraph (d) of this provision applies.

(2) If the provision at 52.204-7, System for Award Management, is not included in this solicitation, and the Offeror has an active registration in the System for Award Management (SAM), the Offeror may choose to use paragraph (d) of this provision instead of completing the corresponding individual representations and certifications in the solicitation. The Offeror shall indicate which option applies by checking one of the following boxes:

System for Award Management (SAM) means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—

(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;

(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12;

and

(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.

(b) If the solicitation for this contract contained the provision 52.204-7 with its Alternate I, and the Contractor was unable to register prior to award, the Contractor shall be registered in SAM within 30 days after award or before three days prior to submission of the first invoice, whichever occurs first.

(c) The Contractor shall maintain registration in SAM during contract performance and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement. The Contractor is responsible for the currency, accuracy and completeness of the data within SAM, and for any liability resulting from the Government's reliance on inaccurate or incomplete data. To remain registered in SAM after the initial registration, the Contractor is required to review and update on an annual basis, from the date of initial registration or subsequent updates, its information in SAM to ensure it is current, accurate and complete. Updating information in SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

(d)(1)(i) If a Contractor has legally changed its business name or ``doing business as'' name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to--

(A) Change the name in SAM;

(B) Comply with the requirements of subpart 42.12 of the FAR; and

(C) Agree in writing to the timeline and procedures specified by the responsible Contracting Officer. The Contractor shall provide with the notification sufficient documentation to support the legally changed name.

(ii) If the Contractor fails to comply with the requirements of paragraph (d)(1)(i) of this clause, or fails to perform the agreement at paragraph (d)(1)(i)(C) of this clause, and, in the absence of a properly executed novation or change-of-name agreement, the SAM information that shows the Contractor to be other than the Contractor indicated in the contract will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the electronic funds transfer (EFT) clause of this contract.

(2) The Contractor shall not change the name or address for EFT payments or manual payments, as appropriate, in the SAM record to reflect an assignee for the purpose of assignment of claims (see FAR subpart 32.8, Assignment of Claims). Assignees shall be separately registered in SAM. Information provided to the Contractor's SAM record that indicates payments, including those made by EFT, to an ultimate recipient other than that Contractor will be considered to be incorrect information within the meaning of the ``Suspension of Payment'' paragraph of the EFT clause of this contract.

(3) The Contractor shall ensure that the unique entity identifier is maintained with the entity designated at www.sam.gov for establishment of the unique entity identifier throughout the life of the contract. The Contractor shall communicate any change to the unique entity identifier to the Contracting Officer within 30 days after the change, so an appropriate modification can be issued to update the data on the contract. A change in the unique entity identifier does not necessarily require a novation be accomplished.

(e) Contractors may obtain additional information on registration and annual confirmation requirements at https://www.sam.gov.

52.204-17 OWNERSHIP OR CONTROL OF OFFEROR (JUL 2016)

Commercial and Government Entity (CAGE) code means—

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity;

or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file.
