DEPARTMENT OF THE NAVY

NAVAL FACILITIES ENGINEERING COMMAND, MID-ATLANTIC

9324 VIRGINIA AVENUE

NORFOLK, VIRGINIA 23511-3095

JUSTIFICATION AND APPROVAL

J&A No. ML-19-64

06 Sept2019

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

l. Contracting Activity: The contracting activity is Naval Facilities Engineering Command, Mid-Atlantic, Resident Officer in Charge of Construction (ROI CC) Camp Lejeune, North Carolina

2. Description of the Action Being Approved: A ward of a 6-month extension to Contract N40085-l 5-C-0800, Lead Cleaning of Breach and Shooting Houses at Marine Corps Base (MCB) Camp Lejeune, North Carolina. The extension is necessary to have sufficient time to solicit and award the follow-on contract with sufficient time to allow for a 30-day phase-in period.

3. Description of Supplies/Services: The Contractor shall provide labor, management, supervision, tools, material, and equipment required to perform lead cleaning services at MCB Camp Lejeune, North Carolina. The bridge action will be effective from 01 October 2019 to and including 31 March 2020 with an estimated amount of$ for recurring services.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C. 2304(c)(2);

FAR 6.302-2, Unusual and compelling urgency. Contracting without providing for full and open competition under this acquisition may be accomplished pursuant to the authority of 10 U.S.C.

The agency's need for these services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive synopsis requirements pursuant to FAR 5.22(a)(2).

5. Rationale Justifying Use of Cited Statutory Authority: The use of the authority cited in Section 4 is deemed appropriate due to the unusual and compelling need for lead cleaning services at the MCB Camp Lejeune breach and shooting houses. The requirements package was received later than required, which did not leave sufficient time to complete pre-award activities, proposal evaluation, and award the contract before the current contract expires. Continuing Lead Cleaning of Breach and Shooting Houses is essential; without continual services to the breach and shooting houses, there is an increased risk that these training sites would become out of compliance due to the high levels of lead. This in and of itself will render the facilities unusable due to unacceptable levels of lead causing unsafe working conditions. Failure to perform the
