DEPARTMENT OF THE NAVY
NAVAL FACILITIES ENGINEERING COMMAND, MID-ATLANTIC
9324 VIRGINIA AVENUE
NORFOLK, VIRGINIA 23511-3095
J&A No. ML-18-15 23 April 2018
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity. Naval Facilities Engineering Command Mid-Atlantic, Facilities Engineering Acquisition Division (FEAD) Marine Corps Air Station (MCAS) Cherry Point, North Carolina.
2. Description of Action Being Approved. The FEAD MCAS Cherry Point proposes to increase the indefinite quantity portion of N40085-14-D-1310 for Maintenance Service Contract at MCAS Cherry Point, North Carolina and outlying areas. The proposed action will increase the total contract value from redacted by redacted to redacted for the current contract period. The increased capacity will be used for fully funded customer requested actions to be executed before the end of this fiscal year.
3. Description of Supplies/Services. The work consists of various maintenance service requirements for MCAS Cherry Point relevant to the Maintenance Service Contract, which is in place to supplement the small in-house workforce of shop personnel at MCAS Cherry Point.
The requirements placed on the IDIQ portion of this contract are essential to mission and operational status on MCAS Cherry Point. The ability to quickly address issues such as HVAC and plumbing allows mission critical operations to continue without delay. Several of the tenant commands have provided urgent projects to be accomplished under the IDIQ portion of this contract; however, the current capacity is insufficient to accommodate these urgent requirements.
4. Statutory Authority Permitting Other Than Full and Open Competition. 10 U.S.C.
2304(c)(2); FAR 6.302-2, Unusual and Compelling Urgency. The Agency’s needs for these services is of such an unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals and waive synopsis requirements pursuant to FAR 5.202(a)(2).
5. Rationale Justifying Use of Cited Statutory Authority. Use of the authority cited above is deemed appropriate due to the agency’s need for the required service which is of such unusual and compelling urgency that delay in award of task orders for repairs of critical systems to various systems, such as HVAC and plumbing, could result in significant financial damage to real property, affect the quality of life for military and civilians, and could have an adverse impact to the Marine Corps’ mission.
6. Description of Efforts Made to Solicit Offers from as many Offerors as Practicable.
Due to the urgency, it is not practical or in the best interest of the Government to solicit additional sources for the additional services as the current contractor is the only source
J&A No. ML-18-15 practicable under the exigent attendant circumstances. The contractor is already mobilized at the facility and providing the required services, is intimately familiar with the work to be performed, and is currently performing satisfactorily. Time is of the essence before significant financial damage to real property affects the quality of life for military and civilian personnel, and could adversely impact the Marine Corps’ mission.
7. Determination of Fair and Reasonable Costs. The current contract was solicited using full and open competition. Contract price was determined fair and reasonable based on competition and comparison to the independent government estimate. Task Orders issued under this proposed action will use the current pre-priced line items previously determined fair and reasonable.
8. Actions to Remove Barriers to Future Competition. The follow-on maintenance service contract vehicle is in the development stage. Those new contract requirements will include increased IDIQ capacity to accommodate the needs of MCAS as well all tenant commands.
