1.10.1 Surface Transportation

Use of Government facilities are on a priority basis as determined by the Government. Repair damaged Government property such as docks, buoys, lightering watercraft and equipment due to the Contractor's negligence at the Contractor's own expense.

a. Military Sealift Command (MSC): The current shipping cycle to Diego Garcia is approximately 90 days but is subject to change without notice.

If the Contractor elects to use MSC services, the Contractor is responsible for costs incurred or delays encountered because of late or nondelivery of materials or equipment. MSC services are subject to the following conditions:

(1) Provided on a space available basis or if no commercial service is available.

(2) The Government has the right to reject cargo offered and to limit the quantities of materials accepted.

SECTION 01 14 00 Page 14

(3) The Government incurs no responsibility, expressed or implied, for return transportation, continued frequency, timeliness or reliability of the MSC service.

(4) As historical information, the Government shipping rates per measurement ton (MT) from US to Singapore and Singapore to DG:

YEAR SINGAPORE TO DG US TO SG

2016 $422.51 - with or without Hazmat $416.24 2017 $406.73 - with or without Hazmat $416.24 2018 $396.00 - without Hazmat

$410.25 - with Hazmat $147.39

2019 $396.00 - without Hazmat $410.25 - with Hazmat

$147.39

2020 $396.00 - without Hazmat $410.25 - with Hazmat

$147.39

2023 $396.00 - without Hazmat $410.25 - with Hazmat

$147.39

A measurement ton is defined to be 40 cubic feet. The measurement ton associated with a container is calculated by dividing the total exterior volume of the container by 40. A standard 20 foot container occupies approximately 38 MT. A 40 foot container can also be utilized with gross weight of approximately 7,650 pounds. The Government will charge per measurement ton Government Shipping Rate for containers with cargo shipped to Diego Garcia from Singapore, but will not be charged for the return of empty containers shipped back to Singapore. The prevailing Government Shipping Rate is subject to change and no change in the contract price will be made due to a future change in the Government Shipping Rate.

For US to DG, USTRANSCOM (MSC) normally operates regular resources for transporting personnel, materials, and equipment to and from Diego Garcia. 10 U.S.C. § 2642 (a)(3) authorizes approval of the use of DoD Transportation Working Capital Fund (TWCF) rates to DoD contractors transporting goods or supplies. Contractors are provided a TAC code to utilize for shipments to/from DG. The ACO office, FEAD, PWD Diego Garcia will coordinate with Naval Facilities Engineering Systems Command, Washington Navy Yard, D.C. to obtain the UIC/DoDAAC.

For general ocean transportation question, please call 1-800-526-1465.

(5) The BOS Contractor's stevedoring/lighterage rates must be directly coordinated with the BOS Contractor.

(6) Damages or loss due to handling, loading, securing, transporting, failure of, or delay in delivery shall be borne by the Contractor. Obtain adequate insurance against damage, loss or

SECTION 01 14 00 Page 15 failure of, or delay in delivery, as appropriate, and include the Government as a named insurer.

(7) Contractor shall establish a Transportation Account Code (TAC) to be obtained from the Military Surface Deployment and Distribution Command (SDDC). This TAC code will be used for surface shipping to include demurrage/movement fees in Singapore. The Point of Contact is:

Ms. Barbara Lohman Accountant SDDC/G8 Commercial: 1-618-220-5335

DSN: 770-5335.

It is the Contractor's responsibility to provide ample amount of time in securing a TAC Code.

(8) The Contractor will require a Unit Identification Code (UIC) for the ordering of materials, supplies and equipment for use in the performance of the contract. The ACO office, FEAD Diego Garcia, will coordinate with Naval Facilities Engineering Command, Washington Navy Yard, D.C. to obtain the UIC/DoDAAC.

b. Commercial vessel:

(1) Lighterage operations are restricted to daylight hours unless approved otherwise at DG.

(2) The Contractor is liable for accidental injury or death of Contractor's personnel and damages to material and equipment during stevedoring operations performed by the Contractor.

(3) Pay demurrage charges for barges and vessels not under Navy sponsorship, or vessels where delay results from the failure of the Contractor to perform specified stevedoring services. When demurrage is assessed to cargo belonging to several agencies, arrange with the agencies concerned in sharing such expenses. No priority will be afforded the Contractor's cargo over others, and cargo will be handled as the ship's cargo master elects to unload, except that food or medical supplies will be given first priority.

(4) Unload cargo from ships anchored offshore into BOS Contractor controlled watercraft and repair damages to Government lightering watercraft due to Contractor negligence. The movement of the cargo from the dock to the jobsite is the Contractor's responsibility.

(5) The Contractor will not be charged for the use of the watercraft dockside crane and two forklifts for lighterage operations but will be charged for the labor involved at the prevailing labor rates. The Contractor must utilize the BOS Contractor's operators.
