1. RFP

P.16

N/A O.3.(a).(1).iv.a This paragraph states that the 'Offeror Letter' should include, at a minimum, the System for Award Management (SAM) Unique Entity ID and the Commercial and Government Entity (CAGE) Code.

Is the first 'Commercial and Government Entity ID' a duplicate, or does it differ from the CAGE Code?

Unique Entity ID, and Commercial and Government Entity ID are different.

Commercial and Government Entity ID means CAGE.

Unique Entity ID is related to System for Award Management

(SAM).

Therefore, it is not duplicate.

2. RFP

P.18

N/A O.(b).(1) This paragraph states that, for the purposes of this evaluation, a relevant construction project is further defined as meeting all three criteria: a construction project with a total contract value (size) of at

Use the FY24 Budget Exchange Rate of

139.1635 JPY /

$1.00. Refer to Amendment 0003 for revision to Factor 1, least $1,000,000 U.S. Dollars or the Japanese equivalent. Is this 'Japanese equivalent' based on the FY24 Budget Rate (BER) of

139.1635 JPY / $1.00, as specified

on page 4 of the RFP?

As the Budget Exchange Rate (BER) changes each year, for projects performed in the past, can the contractor use the BER at the time of the completion, or should the contractor use the FY24 BER, or any other applicable rate?

Corporate Experience.

3. RFP

P.48

N/A 52.216-19 (b).(1) FAR 52.216-19 ORDER

LIMITATIONS (OCT 1995),

described in this RFP, states that '(b) Maximum order. The contractor is not obligated to honor

- (1) Any order for a single item in excess of $3,000 or the Japanese Yen equivalent.' However, this statement does not match the stated order range of between $3,000 and $25,000,000 described on Page 7 of the RFP. What is the correct value for the maximum order limitation? Additionally, if the maximum order limitation changes, does the requirement for contract value for Corporate Experience also change?

The maximum order limitation is $25,000,000 or Japanese Yen equivalent. The contractor is not obligated to honor any order for a single item in excess of $25,000,000 or the Japanese Yen equivalent. Refer to Amendment 0003 for revision to FAR clause 52.216-19 paragraph (b)(1).

The contract value in the definition of a relevant construction project in Factor 1 Corporate Experience remains unchanged;

however, refer to Amendment 0003 for clarification.

4. Solicitation and Supporting Documents

Solicitation documents states requirement is a “MACC for small magnitude size DBB projects”, and Attachment 2 includes specifications for “Iwakuni Mini- MACC”, yet Section 00 10 00 (B)(4) states Task Orders will have a range of up to $25,000,000 of yen equivalent (about 3,400,000,000 JPY). Confirm this requirement is a “Mini-MACC” solicitation and listed Task Order range is correct?

Section 00 10 00 B.

DESCRIPTION OF

ACQUISITION

paragraph 4 states that "The anticipated task orders will be firm-fixed-price (FFP) ranging from $3,000 to $25, 000,000 or Japanese Yen equivalent". The Attachment 2 for seed project is in the range of that task order specified.

5. FAR 52.216-19 Solicitation “Order Limitations” states “The contractor is not obligated to honor – Any order for a single item in excess of $3,000 or Japan Yen equivalent”. Is this statement correct?

No. Refer to Inquiry No.3 and Amendment 0003.

6. P74 of

Solicitation Solicitation Page 74 of 77, Section B, states if a MACC Contractor does not intend to submit a proposal in response to Task Order RFP, the MACC Contractor shall notify the Contracting Office in writing, within two (2) days of receiving the Task Order RFP.

Contractors require receipt of RFPs, review of RFPs, attendance at Site Visit, submission of PPIs and government responses to PPIs, followed by discussions with supporting resources and suppliers before a contractor can determine their intent to provide a proposal or not. Confirm notification to the government of intent to not provide a proposal can be submitted at anytime during the solicitation period prior to bid?

As Solicitation Page 74 of 77, Section B states, the MACC Contractor shall notify the Contracting Office in writing, within two

(2) days of receiving the Task Order RFP if MACC Contractor does not intend to submit a proposal in response to Task Order RFP.

Contractor notification to not provide a proposal can be submitted anytime during the solicitation period prior to bid.

7. Main Spec 01 11 00 Specification states “All "metal items" to be removed shall be vested in the Government Property and delivered to Bldg.7725 (Facilities Recycle Center) in accordance with the following regulations”. Confirm is this is “All Metal” for all Task Orders, or when identified by Task Order to be applicable?

MCAS Iwakuni has Marine Corps Air Station Order of "Qualified Recycling Program (QRP)."

This program must be applied to all scrap metals generated from the construction site. All Task Order must follow this program and each Task Order describes the detailed requirements as necessary.

8. Main Spec 01 14 00 Specification states regular working hours are 8-1/2 hour period between 8:00 am and 4:30 pm, Monday thru Friday. Regular working hours as stated are not practical nor consistent with known past MACC contract actual work hours performed. It is believed that Regular Work Hours should be defined as 0700-1800, Monday through Saturday, which is consistent with normal practice, No, specification remains unchanged.

and will also reduce contract documentation processes for both government and contractor by reducing requests and approvals for work outside regular work hours. Confirm regular work hours can be amended to more practical hours?

9. Main Spec 01 35 26 Specification states “The SSHO must have completed the NAVFAC Far East 24-hour EM 385-1-1 Awareness Course for Contractors within 6 months of award of contract”; however, government has not scheduled classes frequently or consistently enough to accommodate this requirement. Will government be providing and or increasing the training cycles for this requirement?

Contractors should contact NAVFAC Far East for course schedules. However, FEAD Iwakuni Contract Manager (CM) will request for

NAVFAC FE

designated office to provide a training as frequently as possible.

10. Main Spec 01 45 00.00 20 Specification states “the QC Manager must have completed the course entitled “Construction Quality Management (CQM) for Contractors,’ training which is “periodically provided by the government”; however, government has not scheduled classes frequently or consistently enough to accommodate this requirement. Will government be providing and or increasing the training cycles for this requirement?

Contractors should contact FEAD Iwakuni for course schedules.

This CQM course training will be conducted by FEAD Iwakuni locally, per FEAD CM. It will be scheduled flexibly depended on the number of contractor’s participation.

11. Specs & Dwgs

Government Specifications and Drawings have been signed and approved by multiple government Designer of Record Engineers for Quality Control, including a Professional Engineer (PE), as well as Government Engineers for Quality Assurance. Confirm there are no conflicts between government provided design drawings and government provided design specifications?

All Task Orders are subject to the terms and conditions of the base MACC contract. In the event of conflict between a Task Order and this contract, the Task Order will take precedence, except as otherwise noted in the contract documents.

Per DFARS Clause 252.236-7001, the Contractor shall (1) Check all drawings furnished immediately upon receipt; (2) Compare all drawings and verify the figures before laying out the work; (3) Promptly notify the Contracting Officer of any discrepancies; (4) Be responsible for any errors that might have been avoided by complying with this paragraph; and (5) Reproduce and print contract drawings and specifications as needed.

Furthermore, omissions from the drawings or specifications or the misdescription of details of work that are manifestly necessary to carry out the intent of the drawings and specifications, or that are customarily performed, shall not relieve the Contractor from performing such omitted or misdescribed details of the work.

The Contractor shall perform such details as if fully and correctly set forth and described in the drawings and specifications.

12. Specs & Dwgs

Confirmed government Designer of Record is liable for design errors and omissions in accordance with FAR Part 36?

Offerors are responsible for submitting files in the format specified consistent with requirements stated elsewhere in this solicitation. Offerors should mark all electronic files with the solicitation number and should keep the file name as short as possible (i.e., under 40 characters) so that the files are accessible on Government share drives. Files with longer names may become corrupt or inaccessible. Files that cannot be opened, or are otherwise missing the required content are the responsibility of Offerors.

It is an Offeror’s responsibility, when transmitting its proposal electronically, to ensure the proposal’s timely delivery by transmitting the proposal sufficiently in advance of the time set for receipt of proposals to allow for timely receipt by the Government no later than the date and time stated in the solicitation. Offerors shall allow adequate time to upload files, which may be slower for non-DoD users, and to avoid other technical difficulties that may be encountered. An Offeror risks the late receipt and rejection of a proposal where it delays transmitting its proposal until the last few minutes before the time set for receipt of proposals. It is the responsibility of the Offeror to confirm receipt of proposals. Proposals that are received after the stated date and time in the solicitation shall be treated as late submissions and will not be considered except under facts and circumstances allowed by the Federal Acquisition Regulation (FAR).

Offerors shall ensure that proposals (with all required supporting documentation) are received electronically no later than the date and time stated in Block 13A of the Standard Form (SF) 1442 “Solicitation, Offer, and Award (Construction, Alteration, or Repair)”, unless revised by a formal amendment. Proposals not received by the date and time specified shall be treated in accordance with FAR 52.215-1 “Instruction to Offerors – Competitive Acquisitions” and may be rejected. Ultimately, it is the Offeror’s responsibility to ensure timely proposal submission. An Offeror risks the late receipt and rejection of a proposal where it delays submitting its proposal until the last few minutes before the time set for receipt of proposals.

Proposal Submission Hand-Delivered or Mailed

Hand-delivered or mailed proposals shall arrive, and be accepted, at Naval Base Yokosuka, Building 1828, prior to the time set for proposal closing date stated in this Request for Proposal (RFP). O. EVALUATION FACTORS FOR AWARD

3. Basis of Evaluation and Submittal Requirements for Each Factor.

(b) Non-cost/price Factors:

Factor 1, Corporate Experience:

(1) Solicitation Submittal Requirements:

The Offeror shall submit the following information to demonstrate construction experience using Exhibit A – Construction Experience Project Data Sheet:

Submit a maximum of five (5) recent and relevant construction projects for the Offeror that best demonstrates your experience on relevant projects that are similar in size, scope, and complexity to the Request for Proposal

(RFP).

For purposes of this evaluation, a recent construction project is defined as a construction project completed within the past seven (7) years of the date of issuance of this RFP.

For purposes of this evaluation, a relevant construction project is further defined as meeting all of the three areas:

o A construction project with a total contract value (size) of at least $1,000,000 U.S. Dollars or 139,163,500

JPY using FY24 Budget Exchange Rate of 139.1635 JPY/ $1.00; and o A construction project involving new construction of infrastructure or renovation, alteration, or repair of existing infrastructure (scope); and o A construction project with at least one of the following characteristics (complexity):

 Construction or renovation, alteration, or repair of multi-unit residential living facility, such as Bachelor Quarters, dormitory, condominium or apartment building;

 Installation, improvement and/or replacement of critical power realignment, shore to ship power systems, electrical distribution loop systems, emergency generators, and other electrical distribution systems;

 Structural work on airfields, roadways, and supporting facilities;

 Structural waterfront work on piers, wharves, caissons, dry docks and other shoreline structures;

 Installation and/or repair of fire suppression systems;

 Installation and/or repair of Packaged Terminal Air Conditioner (PTAC) systems, Heating

Ventilation and Air Conditioning (HVAC) systems or Dehumidification systems;

 Installation and/or repair of plumbing or mechanical or electrical systems;

 Roof construction, replacement, recoating and/or repair; or Removal and disposal of asbestos containing material.

A project is defined as a construction project performed under a single task order or contract. For indefinite delivery type contracts, the contract as a whole shall not be submitted as a project; rather Offeror(s) shall submit the work performed under a task order as a project.

The Offeror(s) shall submit all project information using Exhibit A – Construction Project Data Sheet for each construction project. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e., unique features, area, construction methods).

If the Offeror(s) is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects may be submitted for the Joint Venture members. If a project was performed by a JV, and not all partners from that JV are on the JV proposed for this contract, the Offeror(s) shall clearly demonstrate what portion of the work was performed by the JV member offering on this contract and shall not include work performed by the JV as a whole. The JV member proposed for this contract shall specifically address field work performed by that JV member including field staffing and direct field work oversight. The JV member proposed for this contract shall also address home office management performed by that JV member including the number/percentage of employees provided for the overall contract by the JV members as well as the overall percentage of work performed by the JV member. The Offeror(s) shall also submit a SIGNED copy of the Joint Venture agreement indicating the proposed participation of each Joint Venture member. Offeror(s) are still limited to a total of five (5) projects combined.

If an Offeror(s) is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of the contract. The proposal shall state specific commitments of technical resources (e.g. personnel, equipment) that the affiliate/subsidiary/parent/LLC/LTD member companies commit to the performance of this contract. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/parent/LLC/LTD member companies in terms of the work it will either self-perform or manage on behalf of the Offeror in performance of the contract. The Offeror MAY NOT utilize experience of a subcontractor to demonstrate construction experience under this evaluation factor unless specialized subcontractor experience is stated as acceptable. Failure to submit this information may result in lower rating.

(2) Basis of Evaluation:

The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing recent and relevant construction projects as defined in the solicitation submittal requirements. The assessment of the Offeror’s recent and relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP. The Government will only review five (5) projects for construction. Any projects submitted in excess of the five (5) for Construction Experience will not be considered.
