About this file
This document is a Justification for the Use of Other Than Full and Open Competition under the Simplified Acquisition Threshold for the provision of three portable showers for a period of 30 service days to support the health and comfort of the ship's duty section personnel onboard the USS RUSHMORE.
The justification cites urgency as the basis for sole-sourcing this requirement to K.I. KOGYO LTD, the incumbent contractor currently providing temporary portable showers and toilets at the pier. This approach will leverage the contractor's existing equipment setup to enable rapid delivery and seamless integration, resulting in cost savings, time efficiencies, operational continuity, and quality assurance. The requirement has an estimated delivery date of July 1st and a total performance period of 30 days. The related federal contract opportunity has been awarded to an unknown vendor for an unknown amount on June 14, 2024.

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Request the provision of three portable showers for a period of 30 service days. The primary purpose of these portable showers is to support the health and comfort of the ship’s duty section personnel. The ship lacks organic capabilities for disposing of wastewater collected from showers, the availability of portable showers is essential to maintain hygienic conditions onboard. The timely provision of portable showers is crucial to ensure the well-being and morale crew living onboard.
THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):
A. ___ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
3. ___ OTHER REASONS. Other reason not identified above. Provide details on mission impact if requirement is not solicited from only one source.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. X UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified: 01APR2024
2. Required delivery date/period of performance: 30 days
3. Explanation of why delivery/commencement of services by the date mentioned above is required: If portable showers are not received by July 1st, it will have a significant impact on the health and comfort of the sailors onboard. Access to proper hygiene facilities such as showers is crucial for maintaining the well-being and morale of individuals in confined living conditions. Duty section personnel are required to stay within the confinement area of the ship to support any onboard emergencies. Given that there are no alternative shower facilities available for the sailors on duty, the lack of portable showers would leave them with no options for maintaining basic hygiene standards. This situation could create a serious health and morale issue among the crew, potentially affecting their ability to perform their duties effectively.
4. If appropriate, include any additional pertinent information.
K.I KOGYO LTD (K.I. KOGYO) is the recommended contractor for this urgent requirement as the Navy can leverage in their expertise in providing compatible portable showers that seamlessly integrate with the current infrastructure. This approach will eliminate costly modifications but also ensure continuity of service without disrupting ongoing Project operations.
Due to the unusual and compelling urgency of this requirement, sole sourcing the contract to K.I. KOGOYO, will optimize financial resources and ensure operational efficiency:
Cost Savings: K.I. KOGYO is currently providing temporary portable showers and portable toilets at the pier. Engaging a contractor with existing equipment setup eliminates the need for additional investment in acquiring or renting equipment from a separate provider. This translates into direct cost savings for the government and ensures optimal utilization of financial resources.
Time Efficiency: By leveraging the contractor's pre-existing equipment setup, the government can expedite the start of the project without delays associated with sourcing, purchasing, or mobilizing equipment from an external vendor. This streamlined approach accelerates project timelines and enhances overall efficiency.
Operational Seamlessness: A contractor with established equipment setup is well-versed in the operation, maintenance and disposable waste of the equipment, leading to smoother project execution and reduced risk of operational disruptions. This familiarity with the equipment contributes to enhanced project performance and mitigates potential challenges.
Quality Assurance: Utilizing a contractor's own equipment setup ensures a higher level of quality control throughout the project lifecycle. The contractor's familiarity with the equipment and its capabilities enables them to deliver work of superior quality, meeting or exceeding the government's expectations.
