Attachment (3) PPI Response-Amend 0002

NO Reference Question Government Response

Instructions to Bidders, Page 19, Section 5 Preparation of Bids, Sub-paragraph (7) Bidder’s Qualifications

Instructions to Bidders lists multiple supporting documents that bidders are encouraged to submit, but, also states not mandatory, and states may be required to determine a bidder’s responsibility. This requirement conflicts with the fact the solicitation is an “IFB”, Open Bid, which suggests “lowest bidder” would receive the award absent any circumstances determined by the government that would eliminate a bidder from receiving the award. How will the submission of these documents be used to determine award over another bidder that does not submit these documents, and when compared to cost?

Please see FAR 14 “Sealed Bidding” and FAR 9 “Contractor Qualifications”.

Refer to and review the entire provision FAR 52.212-2 Evaluation – Commercial Items in the IFB.

FAR 52.212-2 in the IFB provides that, “The Government will evaluate offers for award purposes in accordance with FAR 52.214-10 Contract Award – Sealed Bidding. There are no price related factors…”

FAR 9 requires the contracting officer to make a responsibility determination prior to issuing any contract. The documentation requested, but not required, will be used for responsibility determination only.

Refer to FAR 9.104 for the standards used in determining responsibility.

Instructions to Bidders, Page 19, Section 5 Preparation of Bids, Sub-paragraph (7) Bidder’s Qualifications

Bidder’s Qualifications list multiple supporting documents that bidders are encouraged to submit, but, also states not mandatory, and states may be required to determine a bidder’s responsibility. Will a bidder submitting these documents, although not mandatory, be considered for award above a bidder that has a lower price and does not submit requested documents?

See response to Question 1.

However, Page 23, Far 52.212.2 Evaluation, sub-paragraph (a), states government will evaluate offers for award based on FAR 52.214-10, which is determined by “most advantageous to the government considering only price and price related factors”. Same sub-paragraph also states this solicitation has no price related factors, thus, government will consider price only based on the total of all CLINS 0001 – 0016. Please confirm the purpose of documents contractors are encouraged to submit, but, not mandatory to submit, in accordance with Page 19, Section 5 Preparation of Bids, Sub-paragraph (7) Bidder’s Qualifications, and their purposes with regard to award determination?

See response to Question 1.
