SIMPLIFIED ACQUISITION PROCEDURES (SAP)

SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION

THRESHOLD AS DEFINED IN FAR 2.101

SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:

QUOTE/SOLICITATION NUMBER:

N40084-18-T-0064 ESTIMATED AMOUNT (Not exceeding $150,000):

(Engineering Services = & PCAS = )

DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE:

In accordance with FAR 13.106-1(b), this single source determination is for architectural and engineering (AE) services to review and update the original Design Build (DB) Request for Proposal (RFP) package for Work Order # 1291914 REPLACE FIRE ALARM SYSTEM AT NEW SANNO HOTEL, TOKYO, JAPAN, and for Post Construction Award Services (PCAS).

UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES

CAN BE USED:

Tokuyama Architects & Engineers, Inc. developed the DB RFP package to replace the fire alarm system at the New Sanno Hotel in Tokyo, Japan under contract N40084-12-D-0019, Task Order 0005. The final DB RFP package was submitted to the Government on 25 May 2016. Since then there have been some minor codes, criteria, and condition changes; however, majority of the codes and standards that the original DB RFP utilized still apply. Furthermore, in accordance with UFC 1-200-01 section 1-5, projects that have a delay of more than 18 months between design completion and solicitation of offers for construction must be reevaluated. Tokuyama Architects & Engineers, Inc. has extensive knowledge of this project, having participated in kick off and review meetings with the New Sanno Hotel facility manager, Tokyo Fire Department and NAVFAC while developing the DB RFP package. They have also conducted a thorough site investigation and developed a site investigation report documenting their findings. The minor changes that would need to be incorporated into their original DB RFP package includes assisting the New Sanno Hotel on identifying ADA designated rooms; incorporating revised fire protection codes, NAVFAC’s electronic construction and facility support contract management system (eCMS), and cybersecurity specifications; and revise the construction cost estimate. This effort for the AE to incorporate these changes is estimated to be . In addition to engineering services, PCAS, which includes reviewing design submittals (basis of design, drawings, specifications and cost estimate), reviewing construction submittals, providing office consultation, and witnessing both the preliminary and final acceptance testing of the fire alarm mass notification system, will be required and is estimated at .

REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES:

Full and open competition would not be in the best interest of the Government as it would result in a duplication of efforts and costs that is not expected to be recovered through competition. That AE contractor would need to conduct their own site investigation and report, hazardous material testing, and RFP package development that includes conceptual drawings, phase plan, and cost estimate. This will result in a higher cost to the Government and delay in the project schedule. In addition, awarding PCAS to a different AE contractor may result in conflicting design opinions between itself and Tokuyama Architects & Engineers, Inc., which may result in additional cost to the Government and further delays.

The effort for a new AE to complete these tasks is estimated to be .

EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN

COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE:

Other AE firms should be able to complete the requirement, but this would incur unnecessary duplicate cost, as described above. Awarding a standalone contract to the AE firm that developed the original DB RFP package would save the Government an estimated and avoid delaying the project by an estimated seven months.

PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO

COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED:

Unless future requirements are directly related to the work performed under this contract, new work will be competitively solicited using the Selection of Architects and Engineers procedures for AE services.

SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION

I certify that the statements above are complete and correct to the best of my knowledge.
