JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The Contracting Officer, Public Works Department, Naval Support Facility (NSF) Dahlgren, VA, under the authority granted by NAVFAC Washington, will negotiate a firm fixed-price contract.

2. Description of the Action Being Approved.

In accordance with FAR 6.302-2 “Unusual and Compelling Urgency”, this J&A requests authority to award a sole source contract from RFQ (Request for Quote) N40080-24-Q-9500 to evaluate pump condition before and after disassembly to troubleshoot the issue of losing prime. Contractor is to evaluate the pump shaft, bearings, and seals which were repaired previously, then evaluate impeller, inspect wearplates, seals, and volute for issues. The Contractor shall repair and rebuild pump as necessary based upon evaluation and re-assemble pump back to meet original manufacturer’s performance. Work on the Godwin pump must be performed by Xylem, Inc., in order to integrate correctly with the pump system. Authority to act is FAR 6.302-2(a) Unusual and Compelling Urgency.

3. Description of Supplies/Services.

Utilities at NSF (Naval Support Facility) utilizes an existing Godwin pump system. The estimated value of the proposed contract is $16K, and the funding planned for this acquisition is Fiscal Year 2024 funds. The Period of Performance is anticipated to be 45 calendar days.

4. Statutory Authority Permitting Other Than Full and Open Competition.

It is requested that other than full and open competition be permitted pursuant to 10 U.S.C. 2304(c) (a) as implemented by FAR 6.302-2 Unusual and Compelling Urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

This contract is in support of Utilities at NSF Dahlgren, VA, which currently utilizes a Xylem, Inc., Godwin pump system. Not employing Xylem, Inc., to perform essential maintenance and repairs creates unacceptable risks to mission, systems and personnel. Failure to deliver this capability in FY-2024 will result in unacceptable impacts to NSF Dahlgren, VA, station personnel and for achieving Mission objectives.

If the contracting activity could not limit the competition by issuing this contract, the harm the government would have suffered includes a length of procurement delay that is unacceptable due to the impact upon critical Mission tasks that require use of the Godwin pump system for station personnel. The length of delay could be as much as nine to twelve months or more, taking into account the time for work induction, obtaining funds, soliciting proposals, analyzing and negotiating proposals, and award of project. This time frame is prohibitive and would not support Mission critical requirements of the program. Therefore, the estimated cost to the government is so high that it will not be recouped through competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A market survey was not conducted because of the time constraint based on the Mission requirements.

7. Determination of Fair and Reasonable Cost. The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVFAC has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NAVFAC will assess whether competition for future requirements is feasible.
