About this file
This document is a Justification and Approval (J&A) for the use of other than full and open competition for the procurement of brand name commercial equipment and associated services from Boland Trane Services Inc. for the maintenance and overhaul of existing Trane chillers at Naval Air Station Patuxent River.
The J&A cites the statutory authority under 10 U.S.C. 2304(c)(1) to restrict the procurement to the original equipment manufacturer, Trane, in order to avoid substantial duplication of cost and delay that would result from sourcing the maintenance and control panel upgrades from another vendor. The total estimated value for the 12-month period of performance is approximately $. The procurement is to provide preventative maintenance and life cycle extension for 8 existing Trane chillers across 3 buildings, including overhaul services and replacement of 7 control panels. NAVFAC Washington has determined this approach will avoid substantial duplication of cost and prevent unreasonable delay compared to a full and open competition.

JUSTIFICATION AND APPROVAL (J & A) FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity.
Department of the Navy, Naval Facilities Engineering Systems Command Washington (NAVFAC WASHINGTON), Public Works Department (PWD) Patuxent River, Maryland.
2. Description of the Action Being Approved.
This of brand name commercial equipment from Boland Trane Services Inc.
for approximately 12 months for Facility Related Control Systems (FRCS) programmable building controllers interface with the identified nstallation networked facilities control system at NAS Patuxent River extend life span cycle for the over year old chillers B2187, B2185 and B2188
Specifically included are:
Building 2187-
Factory overhauling 3 Trane 650 Ton Chillers and updating 2 Control Panels to the Trane Tracer Adapt iView Specked Panels
Building 2185-
Factory overhauling 3 Trane 500 Ton Chillers and updating 3 Control Panels to the Trane Tracer Adapt iView Specked Panels
Building 2188-
Factory overhauling 1 Trane 350 ton Chiller and 1 Trane 250 ton Chiller and updating 2 Control Panels to the Trane Tracer Adapt iView Specked Panels
The replacement parts for the chillers and the respective control panels can only be supplied by Trane and only Trane technicians can install parts that meet their specific requirements.
J&A No. N40080-24-J&A-061
3. Description of Supplies/Services.
This requirement is for routine follow-on preventative maintenance work to existing industrial-sized chillers that were previously installed over years ago. The were previously purchased through the 8(a) MACC
Building 2187- The original Contract Building 2185- Contract Building 2188- Contract
Providing this maintenance will avoid substantial duplication of cost that is not expected to be recovered through competition. The avoidance of a duplication of cost and effort will prevent unreasonable delay in providing the follow-on maintenance needed to keep the chillers
As outlined in the chart below, total of chillers will under-go life-cycle maintenance and receive updated control panel hardware.
The follow-on project materials consist of the control panels and controllers that will be configured and programmed using licensed software from Boland Trane and used to overhaul and keep the chillers functional for NAVFAC Washington PWD Pax River Facilities. The Brand name commercial equipment restricts who can install, commission, test, and maintain the proprietary product. However, it does not control who may operate the equipment.
Estimated Dollar Value of Brand Name Equipment
Description includes:
Period of Performance
Cost/Unit Each
Quantity Subtotal
B2187 3 Trane 650 Ton Chiller overhauls and 2 Control Panels
B2185 3 Trane 500 Ton Chillers overhauls and 3 Control Panels
B2188 1 Trane 350 ton Chiller and1 Trane 250 ton Chiller overhauls and 2 Control Panels
TOTAL
The total estimated value of the use of Boland Trane brand name equipment is of the month period of performance. The equipment and the entire project total approximately .
4. Statutory Authority Permitting Other Than Full and Open Competition.
The statutory authority permitting other than full and open competition is Title 10 U.S.C. Section 2304(c)(1) as implemented under FAR 6.302-1(a)(2)(iii), for be available only from the original source in the case of follow-on contracts for the continued provision of highly specialized services
5. Rationale Justifying Use of Cited Statutory Authority.
The current project is to provide an extended life span cycle for the over chillers to receive preventive maintenance. The preventive maintenance is a follow-on project to include the overhaul for the existing 8 Trane Chillers replacing the 7 Trane Control Panels. Applicable United States Government Accountability Office (GAO) Comptroller General Decisions have acknowledged the authority of a federal agency to use other than competitive procedures when there is a reasonable need for preventive maintenance for the existing equipment or software, and when it is likely that award to other sources would result in substantial duplication of cost to the government that is not expected to be recovered through competition. To replace the chillers would also duplicate cost and efforts to build the specifications and designs creating an unreasonable delay to the effort.
The nstallation requires that the hillers remain operable . The hillers are a product of Boland Trane, and in order to meet the needs for, and achieve the benefits of, keeping the chillers operable by performing as follows:
A. Establish and maintain the manufacture preventive maintenance requirements to reduce energy
Maximize utilization of existing chillers to configure and program the control Panels.
Other contractors do not offer programmable control panels that can be configured or programmed with the Boland Trane chiller. Although the chiller provides service to the building, it does not allow for configuration and programming functions to take from any control panels. For example, s control panel cannot be used to program Manufa panels software tools must be used to configure or change the program within the controls.
Using hardware products from the same vendor that produced, the configuration/programming eliminates mutli-vendor disputes regarding conflicts standards, protocols, or performance characteristics should the controller not function as required.
Avoid the significant operational burden and cost of having maintenance and engineering staff training to become proficient with the configuration, programming, commissioning, operations, and maintenance of controllers from different manufacturers product. This training would also be a cost burden as only Boland Trane would be able to provide the training.
Avoiding the cost in time for curv Reduces the inefficient layers of multiple solutions and manpower that would be needed for any new systems, related to additional equipment, maintenance, and support contracts for another hardware and software, as well as the maintenance of the additional parts inventory. Maintaining multiple solutions is inefficient and creates unnecessary work and overhead that increases the total cost of ownership and manpower costs.
In summary, NAVFAC Washington Technical personnel determined that for this nstallation, the contract action authorized this J&A will, avoid substantial duplication of cost that is not expected to be recovered through competition well as preventing unreasonable delay.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable. The cost associated with the complete replacement is not practicable or cost effective.
Actions to Remove Barriers to Future Competition.
For the reasons set forth in Section 5, NAVFAC has no plans at this time to compete future contracts for the types of supplies/services covered by this document. NAVFAC Washington PWD Patuxent River will continue to monitor if a universal control panel or controller configuration becomes available and if another potential source emerges, will assess whether competition for future requirements is feasible. NAVFAC will also look into the potential feasibility of buying the software and hardware rights for future products.
