I have no per se legal objections. IAW DoDI 4165.56, Subject - Relocatable Buildings (RLB), relocatable buildings may be authorized for interim facility requirements and purchased or leased as equipment. When purchased as equipment, it is funded with either operations and maintenance (O&M) or other procurement funds depending on the expense and investment threshold pursuant to DoD 7000.14-R Financial Management Regu-lation (FMR), Vol 2A, Ch 1. RLBs may be authorized and acquired as property and funded with either O&M or MILCON funds depending on the total acquisition cost IAW the cost thresholds for construction pursuant to 10 U.S.C. sections 2801 and 2805. When determining the threshold, the cost of the RLB will be based on the total cost of the completely assembled building, including all site work. In making the determination to either purchase or lease as equipment and/or property (classified as real property), other considerations must be considered as to facility maintenance, alterations, and operational costs should be budgeted in the same manner as other installation real property assets. Also when considering OPNAV INST 11010.33C (Policies on the procurement and Use of Government - Owned Personal Property Relocatable Buildings), I note that RLBs are considered temporary structures for periods not to exceed three - years. In instances where an activity has initiated a military construction project or minor construction via authorized procedures, the three - year limitation may be extended using the waiver process, which apparently CNIC granted on 3 Mar 16 and as recently as 28 Feb 19. In its recent waiver, CNIC approved the continued leasing arrangement for two (1) year renewals for a period not to exceed two years from contract ratification. CNIC also provided that should funding from NAVAIR to purchase the existing RLB become available, it shall be permitted with proper documentation and communication to CNIC. The contemplated J&A seeks to purchase the RLB, which has been leased since 2008 in anticipation of MILCON Project 130 coming on line. IAW the J&A, the RLB is estimated to cost $2.6M or more. To execute this RLB purchase, proper funding is required and further coordination with CNIC is expected. Ensure that appropriate funding is available for this requirement to avoid any potential Anti-Deficiency Act violation.

1. Contracting Activity.

The contracting activity is the Naval Facilities Engineering Command Washington (NAVFAC WASH) located at Naval Air Station Patuxent River, Maryland (NAS PAX).

2. Description of the Action Being Approved.

This request is to obtain authority under FAR 6.302-1 Only One Responsible Source and No Other

Supplies or Services Will Satisfy Agency Requirements� to purchase the Lease Relocatable Building

(RLB) 149, Building 3700 at Naval Air Station Patuxent River, Maryland from the incmnbent contractor, Blazer's Custom Construction, LTD.

3. Description of Supplies/Services.

LR-149 has 21,000 square feet of administrative office space in the Leased Relocatable, structure, which currently serves as the primary operating facility for the Maritime Patrol and Reconnaissance Aircraft Program Office (290). The PMA 290 is a 1,400- member team delivering improved products and costwise readiness to Navy maritime patrol and reconnaissance forces and national intelligence agencies worldwide, to ensure dominant combat power is available at the right place, at the right time.

Responsible for budgeting, development, acquisition, test, delivery, sustainment, current and future readiness, and total ownership cost for the P-8A Poseidon, P-3 Orion and derivative, EP-3E Aries II, P-3 Special Project, and S-3B Viking aircraft; a Foreign Military Sales program with 16 foreign countries;

and power and propulsion systems for P-3, EP-3, S-3B, C-130, C-2 and E-2C aircraft, PMA-290 achieved significant success in FY12 developing and implementing initiatives to improve acquisition program performance, reduce acquisition cycle time and Total Ownership Cost, develop assigned personnel, and deliver warfighting capabilities and product to the Fleet on schedule and below cost, improving the Fleet's sustainability and readiness, and increasing the Navy's overall buying power. The relocatable facility is complete with lighting, HY AC, utilities, electrical, telecom, fire alarm, and data network installed.

LR-149 was originally leased tmder contractN40080-08-D-3022 as LR 134 and was awarded on 29 August 2008 to Blazer's Custom Construction, LTD. The intent of the original procurement for the RLB was to have a temporary building solution in place due to the contemplated MILCON P290 Project P-8 Hangar. The P-8 Hangar will consist of a three-bay Type III hangar, aircraft parking apron, maintenance shops, flight crew areas, squadron space and administrative and laboratory spaces to support Research, Development, Acquisition, Test and Evaluation (RDAT&E) for the P-8 program. The MILCON remains un-prograrnmed at this time, however, it is still considered to be an option at some point in time if Congress decides to fund it, in which case the purchase of this RLB will have to be included in the DD1391. Incorporated in contract N40080-08-D-3002 was the delivery and setup of the RLB and the installation of undergroW1d utilities, foundation, and paving to support the facility. LR-149 was then procured under leased under contract N40080-14-D-3010 and awarded 04 March 2014 to Blazer's
