Text version
All personnel responsible for developing, reviewing and approving a single source determination shall ensure that sound business judgment is applied in researching, documenting and approving such actions.
The rationale for a single source determination is not constrained by this form. If filled out electronically, the form will expand to the written narrative. If not available electronically, the drafter shall attach continuation sheets to ensure rationale is fully supported.
SIMPLIFIED ACQUISITION PROCEDURES (SAP)
SINGLE SOURCE DETERMINATION FOR ACQUISITIONS NOT EXCEEDING THE SIMPLIFIED ACQUISITION
THRESHOLD AS DEFINED IN FAR 2.101
SOLICITATIONS MAY BE LIMITED TO ONE SOURCE ONLY IF THE CONTRACTING OFFICER (within its warrant authority) DETERMINES THAT ONLY ONE SOURCE IS AVAILABLE IAW FAR 13.106-1(b). THIS DETERMINATION SHALL BE SUPPORTED WITH FULL JUSTIFICATION FOR SINGLE SOURCE FROM THE CUSTOMER. THE CUSTOMER SHALL PROVIDE THE FOLLOWING INFORMATION:
QUOTE/SOLICITATION NUMBER: N39430-19-T-2113 (ACQR# 5558378)
ESTIMATED AMOUNT (Not exceeding $250,000): $246,704.96
DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED AND THE INTENDED USE: The contractor shall provide all labor and services necessary to provide engineering support services. The contractor shall review Government publications, General Services Administration (GSA) approved products, Federal Specifications, Military Specification, standards, documents, and comments pertaining to the storage and protection of National Security Information (NSI), Intelligence Community documents, etc. The contractor will also provide technical review/writing services in support of the DoD Lock Program. The contractor shall provide physical security equipment (PSE) technical support information and assistance to DoD components by providing engineering support services as requested by the Government.
UNIQUE CHARACTERISTICS THAT LIMIT AVAILABILITY TO ONLY ONE SOURCE, WITH THE REASON NO OTHER SUPPLIES OR SERVICES CAN BE USED: The contractor must have the following minimum qualifications: (a) 25 years or similar experience as Technical Security Officer and Program Manager for the Intelligence Community specializing in the installation, maintenance, testing and evaluation of security equipment required for the storage of national security information in high risk environments; (b) managed or participated in dozens of programs, studies, tests, forensic analysis and investigations on the capabilities and limitations of security equipment; (c) provided technical expertise in the writing of Federal Specifications for the testing of security systems; (d) provided expertise in the testing of security equipment submitted for US Government; (e) has the ability to obtain and maintain a Top Secret Clearance for personnel who work with classified information; (f) Contractor must be a US Citizen.
REASON THAT SUGGESTED SOURCE IS THE ONLY SOURCE WHICH CAN PROVIDE THE SUPPLIES OR SERVICES: William Coupe recently retired from the Federal Government after serving 40 years in the Intelligence Community as a Technical Security Officer and Program Manager. He specialized in the installation, testing, and evaluation of security equipment required for the storage of national security information in high risk environments. He managed and participated in dozens of programs, studies, tests, forensic analyses, and investigations on the capabilities and limitations of security equipment. Based on this experience and having access to classified information pertaining to the technologies and capabilities of our adversaries, Mr. Coupe has amassed a unique skillset and personal catalog of knowledge and expertise that is not available elsewhere in the marketplace. In addition, he maintains a Top Secret Clearance and has successfully performed the same scope of work for the Navy under NAVFAC EXWC contract N39430-16-P-1842 since May 2016. Furthermore, consultation with the Intelligence Community also confirmed that Mr. Coupe is the only contractor available in the marketplace that possesses all of the minimum qualifications listed above to successfully perform the scope of work.
EXPLAIN WHY AN ADEQUATE PURCHASE DESCRIPTION OR OTHER INFORMATION SUITABLE TO SOLICIT BY FULL AND OPEN COMPETITION HAS NOT BEEN DEVELOPED OR IS NOT AVAILABLE: It is not possible to develop a performance work statement that would be suitable to solicit by full and open competition, because the work requires minimum technical qualifications and the ability to obtain and maintain a Top Secret security clearance. These restrictive characteristics inherently limit competition. In addition, relaxing these minimum qualifications to make the purchase description more conducive to competition would pose a security risk to the DOD Lock Program and to the Navy.
PROVIDE A STATEMENT OF ACTIONS, IF ANY, THE GOVERNMENT MAY TAKE TO REMOVE OR OVERCOME ANY BARRIERS TO COMPETITION BEFORE FUTURE ACQUISITIONS ARE REQUIRED: Due to the security risk resulting from any action to remove or relax the minimum qualifications for this requirement, any future acquisitions for this same scope of work will continue to limit competition. The requirement has not been split merely to fall within SAP authority and is not short-term work.
I certify that the statements above are complete and correct to the best of my knowledge.
