Technical Approach and Capability: This area concerns the Offeror’s technical approach towards meeting the Performance Work Statement (PWS). At a minimum, the Offeror shall include in their proposal:

o The sources and processes used to find information about legislative and regulatory proposals, including whether such sources involve purchases of information from other providers.

o Any additional information gathering processes employed (i.e. automated or human searching of state websites, network of lobbyists, etc.)

o How the Offeror provides regulatory and/or legislative services such as screening or review of bills and regulations to match the client’s profile.

o How the Offeror obtains or prepares written summaries of bills or regulations, and whether said summaries are customized to highlight the client’s interests.

o A description of the Offeror’s internal processes for customizing its services to its clients, and whether this internal process includes a quality control or customer feedback process for improvement.

o A description, illustrated with screen-shots where appropriate, of the features of the Offeror’s website that provide for searching for and reviewing legislative and regulatory information and for meeting the criteria of Paragraph 2.3.2.3 DoD Fillable Fields and Customizable User ID Profile.

If additional web application development will be undertaken after contract award to meet the criteria of Paragraph 2.3.2.3, that should be clearly indicated and discussed.

o A description of any additional or unique capabilities or technical functionality offered by the contractor that exceed the PWS requirements.

Information Access, Retrieval, and Management Tools: The Offeror shall describe in detail the standard features and customizable features of websites, e-mail capabilities, and any other tools for information retrieval and management to satisfy the requirements described in the PWS in particular Section 2.3.2 (Data Elements), 3.1.1.1 (Data Access Mechanisms), and 4.1 (Performance Metrics). The Table in the Information Management Requirements Summary, which is an attachment to the solicitation, may be used to guide the Offeror’s response.

Key Personnel: The Offeror shall identify and submit resumes for up to three (3) proposed key personnel.

Key Personnel are those responsible for or in charge of quality control for the services listed in this PWS.

Depending on the company organization, this may include a Quality Control Manager, and/or company principals (owners or senior managers). Persons providing quality control to the identification and reporting of legislative and regulatory information shall have experience and/or education that provides a broad basic understanding of environmental laws and regulations, and of the legislative and regulatory processes, legislative cycle, and timeframes.

Legislative and Regulatory Example Work Products: Under this area, the Offeror shall provide the following:

o Two Example Work Product (EWP) that are consistent with the data and reports as will be required by the PWS. The EWP shall be provided in both an Excel and Word format and will include both a legislative and a regulatory summary. One EWP will focus on legislation, and the other will focus on regulation.

The legislative EWP will include all state legislation introduced during or carrying over into 2019 that addresses hydraulic fracturing in the title or body of the legislation and shall be submitted consistent with Section 2.3.2.2 of the PWS.

The regulatory EWP will include all state regulatory actions, including Executive Orders, introduced or active within 2018 and to date in 2019, which address per-fluoroalkyl substances (PFAS, PFOA) in any environmental context, including drinking water standards, wastewater discharge limits, soil cleanup standards, or groundwater protection standards. The regulatory EWP shall be submitted consistent with Section 2.3.2.1 of the

PWS.

Factor 2: Past Performance

Offerors shall provide past performance evaluation forms on at least two (2), but no more than four (4) relevant projects performed within the past five years. Submitted projects may include those entered into by the Federal Government, agencies of state and local Governments, and commercial customers.

IF A COMPLETED Contractor Performance Assessment Reporting System (CPARS) EVALUATION IS

AVAILABLE, IT SHALL BE SUBMITTED WITH THE PROPOSAL. IF THERE IS NOT A

COMPLETED CPARS EVALUATION, the Past Performance Questionnaire (PPQ) included in the solicitation is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor 2, Past Performance. AN OFFEROR SHALL NOT SUBMIT A

PPQ WHEN A COMPLETED CPARS IS AVAILABLE.

IF A CPARS EVALUATION IS NOT AVAILABLE, the Offeror shall provide a completed PPQ for corresponding projects. Offerors shall complete the PPQ Cover Sheet and ensure correct phone numbers and email addresses are provided for the client point of contact. PPQs completed by clients and returned to the Offeror should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client before proposal closing date, the Offeror should complete and submit with the proposal the cover sheet (first page of the PPQ), which will provide client/reference contract information. Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contacts: Nicole Mendes, via email at Nicole.mendes@navy.mil and Geralyn Castro, via email at geralyn.castro@navy.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Also include performance recognition documents received within the last five years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

A copy of the blank Past Performance Questionnaire to be used for requesting client references will be included as an attachment to the solicitation, NAVFAC USACE PP Questionnaire Form PPQ-0.

(5) Volume II – Price Proposal: Offerors shall submit in separate file attachments Volume I: Technical

Proposal and Volume II: Price Proposal. The PRICE proposal shall include the following:

Factor 3: Price

The Contracting Officer has determined that certified cost or pricing data is not required to be submitted for this solicitation because the “adequate price competition” and “commercial item acquisition” exceptions apply (FAR 15.403-1(b)).

The cost proposal shall be submitted in a separate volume from the technical proposal. No technical information shall be submitted as part of the cost proposal.

i. The Offeror shall submit a firm-fixed-price on contract line items 0001 through 0006. Offerors will complete a Price Proposal Sheet (included as an attachment to the solicitation), listing the total proposed price for the base period and each option period and the total price of the proposal. Total Price is inclusive of all direct and indirect costs.

We recognize that activity levels of state legislatures vary significantly over the course of the year, with some months being nearly inactive, but it is our intent to purchase continuous and uninterrupted legislative and regulatory monitoring services rather than purchase only selected months out of a year.
