Limited Source Justification Summary
This is a Limited Source Justification (SAP) document, Revision 09/30/2020, for a simplified acquisition under the federal acquisition threshold. The procurement involves performing visual and operational Pre-Arrival Tests (PATs) on CO2 Scrubbers installed shipboard, in accordance with Technical Manuals NAVSEA S9515-A2-MMO-010 and Pre-Arrival Test Procedures, 51560-601 latest Revision/Change.
The justification is based on two primary rationales: (1) Only One Responsible Source due to restrictive rights, and (2) Unusual and Compelling Urgency. Under the restrictive rights determination, Cepeda Associates owns all drawings, designs, and proprietary information associated with the CO2 Scrubbers and CO H2Burners systems. As the Original Equipment Manufacturer (OEM), Cepeda is the sole authorized vendor with the requisite knowledge and capability to perform this work. The requirement was identified on 09/14/2026 with a required delivery/performance window of 10/26/2026 to 03/06/2027. The urgency is justified because the vessel will be pier-side for a limited window prior to its scheduled overhaul, and completing the PATs is necessary to develop the Scope of Work for integration into the project schedule. The planning team requires known scope prior to vessel availability to prepare the requirement package for C400 action, as historically the repair contract represents a large procurement. The technical certification was signed by Andrea Williams on 09/17/2026, and contracting officer approval was issued by Nathan Westman on 10/06/2026.

OR:
Identify the distributor(s)/authorized technical representative(s) for the item or service. Provide evidence of the exclusive licensing agreement as an attachment to this document. NOTE: If there is more than one distributor/authorized technical representative for an OEM part, then Part B, BRAND NAME SOLE SOURCE, is applicable, and Part A, ONLY ONE RESPONSIBLE
SOURCE, should be left blank).

B. BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer. Discuss why you are precluding consideration of a product manufactured by another company. Describe how the particular brand name, product, or feature is essential to the Government’s requirements and why a “brand name or equal” purchase description cannot be used (see FAR 11.104). Describe how market research indicates other companies’ similar products or products lacking the particular feature do not meet, or cannot be modified to meet, the agency’s needs.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance:
3. Explanation of why delivery/commencement of services by the date mentioned above is required: Explain the impact to the mission if the date above is not met, any special circumstances or conditions that exist which validate the requirement as “urgent,” estimated production lead time for the item, etc.

The boat is scheduled to be pier-side and available for a small window prior to the scheduled overhaul. It is necessary to complete the PATs in order to develop the Scope of Work to be integrated into the Project Schedule. Historically, the repair contract has been a large procurement; by knowing the scope prior to the availability, the planning team is able to complete and send the requirement package to C400 for action.
