Section C - Descriptions and Specifications
STATEMENT OF WORK
STATEMENT OF WORK (SOW) FOR
PREVENTIVE AND REMEDIAL MAINTENANCE ON
DIESEL GENERATORS AT
PORTSMOUTH NAVAL SHIPYARD
KITTERY, ME for FY 2022
1.0 SCOPE OF WORK. At present, Portsmouth Naval Shipyard (PNS) is in possession of multiple diesel generators for which maintenance services are required to ensure operational reliability and availability. The maintenance services shall include two (2) types of services: Preventive Maintenance (PM) scheduled and on call Remedial Maintenance (RM) unscheduled. The PNS equipment maintenance requirements are subject to change by the Government when equipment addition(s) and/or deletion(s) are required due to equipment disposal or replacement. Appendix 1 identifies the equipment requiring maintenance services. As the service life of the equipment in Appendix 1, reaches its end of use; PNSY may remove said piece of equipment from the maintenance contract. As new equipment is put in service PNSY may add, said piece of equipment to maintenance contract. Any equipment additions or subtractions shall be done via the government contract specialist utilizing a contract modification.
2.0 GENERAL. The Contractor shall provide all labor, equipment, tools, materials, replacement parts, and supervision necessary to perform the maintenance services indicated in this SOW for the diesel generators located at Portsmouth Naval Shipyard (PNS) in Kittery, Maine unless otherwise specified by the Government.
In some cases, materials and/or equipment may be more readily accessible by the Government. The Contractor must complete all work In Accordance With (IAW) the terms and conditions specified herein. All references in this SOW to “Contractor personnel” include both Contractor employees and subcontractors. The Government and the Contractor understand that the services to be provided under this contract by the Contractor are non-personal services and that no employer-employee relationship exists between the Government and the Contractor. The Government may provide technical direction which will assist the Contractor in accomplishing the maintenance IAW the SOW; however, the Government will not control the methods used by the Contractor to perform the service requirements set forth in the SOW, except where safety of personnel or equipment is at risk. The Contractor shall, at no time, perform any maintenance action (PM or RM) without a representative of either the Temporary Services Production Shop (Code 990) and/or the Temporary Services Engineering Division (Code 230) of Portsmouth Naval Shipyard present.
2.1 The following Appendices identify the shipyard technical code that is cognizant of the diesel generator(s), the periodicity of preventative maintenance, service documentation required on each asset, and Hazardous Energy Control.

2.2 The Shipyard’s primary point of contact (POC) is TBD
2.3 Additional security requirements (e.g. laptop registration form, etc.) may be imposed by the Government prior to granting access to secured spaces. All computer equipment shall be made available for inspection upon request, and in general should not contain camera equipment or recording capabilities of any kind. Contractors are responsible to disclose any computer equipment being brought onto Government property prior to being granted access.
3.0 PERIOD OF PERFORMANCE. Maintenance services shall be performed during the base year period as shown in the contract. An option to extend this contract up to three additional years is required.
4.0 PREVENTIVE MAINTENANCE (PM) (Scheduled). This maintenance service includes the care and servicing by Contractor personnel for the purpose of maintaining equipment in satisfactory operating condition in accordance with manufacturer’s recommended preventive maintenance tasks. The Contractor shall perform, at a minimum, all services as identified in Appendix 1. Semi-Annual, Annual and Triennial PM’s may or may not be performed at any time and in any order based on project schedules and ship conditions as scheduled by PNS.
4.1 All repairs required as a result of preventive maintenance inspection shall be accomplished under Remedial Maintenance, with the approval of the Government.
4.0 REMEDIAL MAINTENANCE (RM) (Unscheduled). This maintenance service includes all actions to diagnose/troubleshoot equipment malfunctions and restore the equipment to normal operating condition. This equipment includes but is not limited to; diesel engine/generators, integral load banks, fuel system and tanks, electrical/lighting system for the enclosure, heaters enclosure breakers and any other equipment Temporary Services Engineering Division (Code 230) determines to require remedial repair. The Government will advise the Contractor of the suspected problem and request an evaluation either via telephone or by an onsite visit. The Contractor will inspect the equipment and advise the Government of the problem and provide a cost estimate as soon as feasible. In many cases, remedial maintenance services will take place on active systems installed in production work environments governed under stricter government requirements (see paragraph 5.2) and may be considered emergent. The Contractor will begin repairs only after approval by the Temporary Services Electrical General Foreman (or a designated representative) AND the Contract Specialist. If repairs are more extensive, or cost more than originally estimated, the Contractor will obtain the approval of the Government before continuing work.
5.1 The Contractor shall provide the Government with a point of contact and telephone number to receive and respond to remedial maintenance service requests. The Contractor shall ensure that this telephone number is monitored to guarantee at least a telephone response, not to exceed one (1) hour, to RM service requests.
5.2 Remedial maintenance requests may be deemed “emergent” by the Government based on the circumstances of the deficiency. The Contractor shall be prepared to respond to all remedial maintenance requests in an urgent manner unless directed otherwise by the Government.
6.0 MAINTENANCE PERFORMANCE SCHEDULE.
6.1 Preventive maintenance services shall be completed within five (5) business days of scheduled service, unless otherwise approved by the Government.
6.2 The Contractor shall ensure adequate personnel are available to report to Portsmouth Naval Shipyard in response to verbal notification of remedial/emergent maintenance service requests. The required timeframe for ON-SITE RESPONSE shall be within TWO (2) HOURS from the time the Contractor is contacted by PNS to the Contractor arriving onsite of the generator in question. If the Contractor fails to meet the two (2) hour response time a financial penalty equal to double the contractor’s line item for 2022 Remedial Maintenance price per hour will be credited to the PNS in the following billing cycle for each hour over two (2) hours. The Contractor will be clearly notified by Shipyard POC that the request for repair service is an “Emergent Maintenance Service”. The Contractor shall be available 24/7/365 for remedial maintenance requests to Portsmouth Naval Shipyard (Kittery, Maine). The response time may be relaxed at the discretion of the Government based on individual circumstances.
6.3 An emergency call number will be provided to the Shipyard POC. Ten (10) weather resistant stickers with company name and contact information will be provided to the shipyard to post as deemed appropriate.
6.4 Upon arrival on site, Contractor personnel shall report to the Temporary Services Electrical Shop (Building 178) or designated Government representative. The Contractor shall continue remedial maintenance services until such time as the diesel generator is returned to full operational capability or as otherwise instructed by the designated Government representative.
6.5 In many cases, maintenance actions will be performed on power generation equipment that is being relied on as a source of standby power for critical equipment or evolutions. During periods of maintenance, the Contractor shall be responsible to restore operational integrity as soon as possible. Work shall be sequenced to minimize restoration time to restore operational integrity. During Minor Preventative Maintenance restoration time shall be five (5) minutes or less. If, based on the maintenance actions to be performed, this time constraint cannot be met, the Contractor shall notify the Government immediately and request a determination on how to proceed. Maintenance actions requiring diesel generators to be off line for extended periods of time will require specific permission from applicable technical organizations including Code 2340, and Code 230 (PNS).
7.0 REPLACEMENT PARTS/PRODUCTS. The Contractor shall use only new parts, or parts which have been refurbished to “like new” condition which enable the part to function or operate at a level equal to the specification of the original equipment. The Government may have an inventory of some replacement parts for the diesel generator equipment. The Contractor shall, prior to purchasing a replacement part for the diesel generator equipment, contact the Temporary Services Electrical Shop to see if the part is available from the Government-owned parts inventory. If the part is available, the Government will provide the part to the Contractor who shall use that part to perform remedial maintenance. The invoice and work order shall indicate if a “like new” part has been installed and/or used in the repair of the equipment.
7.1 Parts used for preventive maintenance shall not be invoiced separately but shall be included as part of the PM cost.
7.2 Replacement parts required in the performance of RM shall be invoiced to the Government in accordance with the terms and conditions of this contract.
7.3 Replacement parts used in the performance of this contract shall be the same or equal to those recommended by the manufacturer’s technical manuals or specifications.
7.4 The Contractor is responsible for obtaining equipment maintenance service manuals and software that are not available from the Government.
7.5 The contractor shall be required to turn over to the Government all parts and equipment removed from the equipment covered in the contract if requested. Exceptions may be made by the Government for just causes (e.g. to obtain a core charge reimbursement, etc.). Exceptions shall be in writing and signed by the cognizant technical organization as defined in paragraph
2.2 of this SOW.
8.0 MAINTENANCE SERVICE MEETING AND DOCUMENTATION. Prior to and after any PM or RM services the Temporary Services Production Shop (Code 990), the Temporary Services Engineering Division (Code 230), of PNS and contractor shall perform a formal In/Out Brief. The Contractor shall complete an accurate maintenance service document for all PM and RM services provided. Each maintenance service document shall contain the information applicable to PM or RM services and shall be submitted at the Out Brief. Also, within five
(5) working days after completion of the maintenance services to PNS for distribution to individuals noted in paragraph 2.2. Either electronic or hard copy delivery is acceptable. Appendix 1 identifies maintenance service documentation required for each diesel generator asset.
9.0 MANDATORY REPORT. The Contractor shall report all Contractor labor hours (including subcontractor labor hours) required for the performance of services provided under this contract for PNS via an invoice presented to the Government. The Contractor is required to provide all required data information requested by the Government. Inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each fiscal year, beginning with 2022. Contractors may direct questions to the Temporary Services Electrical Shop General Foreman or Engineering Code 230.
10.0 CONTRACTOR PERSONNEL. Contractor personnel shall wear required Government furnished badge, and be easily recognized. This may be accomplished by Contractor personnel wearing distinctive clothing bearing the name of the company and/or by wearing appropriate badges which contain the company name and employee’s name.
10.1 Contractor personnel shall comply with directives pertaining to operation of privately owned vehicles on the
PNS.
10.2 The Contractor shall assure that Contractor personnel completely understand the requirements of this Statement of Work. The Contractor shall ensure that all field service technicians have the required relevant experience and training to handle their tasks successfully and professionally and should provide documents (e.g certifications, licensure) to the POC/Cognizant Technical Organization listed in paragraph 2.2 of this SOW, to their satisfaction and approval. Additionally, the field service technicians shall have sound mechanical aptitude and ability; shall have basic understanding of machinery, both mechanical and electrical; shall have the ability to understand and comprehend technical manuals, drawings, diagrams and any other technical data supplied by various manufacturers.
All Contractor service technicians shall have working knowledge of diagnosis and repair for the types of equipment included in this SOW and be capable of diagnosis and repair.
11.0 QUALITY CONTROL PLAN. The Contractor shall establish and maintain a complete Commercial Quality Control Plan to ensure the requirements of the contract are provided as specified.
11.1 The plan shall include an inspection system covering both preventive and remedial/emergent maintenance repairs required by this contract. The plan shall ensure that quality service levels are maintained throughout contract performance.
11.2 The Contractor shall maintain records of all inspections conducted by the Contractor and any necessary corrective action taken. This documentation and all records and schedules, as described in the SOW, that are the responsibility of the Contractor, are the property of the Government and shall be made available to the Government during the term of the contract.
11.3 Immediately following any maintenance action(s), either remedial or preventive, the equipment undergoing maintenance actions shall be operationally tested for satisfactory performance. The Contractor shall remain on site and available during operational testing. Operational test procedures will be determined on a case-by-case basis by the Government. Technical recommendations may be solicited from the Contractor prior to performance.
Operational testing may include, but is not limited to, load bank testing, start-up and shut down procedures, extended run tests, etc.
11.4 Contractor personnel may be required to support the Government in various forums aimed at failure analysis and quality assurance. When equipment requires technical evaluation and investigation following an identified deficient condition, the Contractor shall be required to provide the same response times as indicated in paragraph 5.1 and 6.2. Assistance from Contractor personnel may include, but is not limited to, written statements, meeting attendance, technical evaluation, on site demonstrations, and failure analysis.
12.0 QUALITY ASSURANCE. The Government shall be responsible for performing Government quality assurance functions for all services and supplies furnished under this contract. Contractor performance is subject to review by the Government and Contract Official. Upon contract award, the identity of the Government POC will be promptly furnished to the Contractor.
12.1 The Government shall advise the Contractor in writing when discrepancies occur, and shall request corrective action. The Government shall make annotation of the discrepancy; the date and time the deficiency was noted, and shall request the Contractor (or authorized representative) to initial the entry.
13.0 MAINTENANCE SUPPORT HOURS. The Contractor shall provide preventive maintenance (PM) support services Monday through Friday between the hours of 06:30 and 15:00, excluding federal holidays. The Government observes the following federal holidays:

If the holiday falls on a Saturday, it will be observed on the preceding Friday. If the holiday falls on a Sunday, it will be observed on the following Monday. The Contractor shall not be required to perform PM services on these days.
Also, in the event an Executive Order issued by the President of the United States declares Agencies of the Federal Government closed on a Contractor-scheduled PM, service date, the Government will advise the Contractor on whether PM services should be performed for that day or services should be rescheduled.
13.1 The Contractor shall provide remedial maintenance (RM) support services Sunday through Saturday, including federal holidays, between the hours of 00:00 and 23:59.
14.0 ENVIRONMENTAL COMPLIANCE. The Contractor shall comply with all Federal, State and Local regulations as well as Naval Sea Systems Command (NAVSEA) installation rules and policies regarding the use, storage, transport and disposal of hazardous materials and wastes. The contractor shall be responsible for all liquid spill protection to ground surfaces. The contractor shall be responsible to maintain a spill cleanup kit (in a ready to deploy condition) on site during maintenance operations. All hazardous waste generated should be disposed of through the PNS Hazardous Waste Facility (Building B357). Any liquid or solid matter shall be cleaned and disposed of prior to the end of the shift that it is generated. If for any reason, the site is left in an unsatisfactory condition, the contractor shall be responsible for clean-up at no additional charge to the Government. In the event of a spill to the ground or surface waters, it shall be the Contractor’s responsibility to immediately notify the Federal Fire Department (207-438-2333). In addition to contacting the Federal Fire Department, the Contractor shall notify a representative of the Temporary Services Production Shop (Code 990), the Temporary Services Engineering Division (Code 230), of Portsmouth Naval Shipyard (PNS).
14.1 The Contractor shall provide a Safety Data Sheet (SDS) to the Contracting Officer or Government for any chemicals brought on site to perform the requirements in the contract and shall provide the SDS to the Contracting Officer or Government prior to bringing the chemicals to the worksite.
15.0 SECURITY REQUIREMENTS. The Contractor or authorized representative shall submit to the Government a roster, on company letterhead, identifying all Contractor personnel who will be performing work under this contract and require access to the equipment for which maintenance services are required. The roster shall contain the following information about each individual. An updated roster and individual information shall be provided to the Government when any Contractor personnel changes occur.
(1) Name (last, first, middle initial), aliases
(2) Status (type of employment)
(3) Name of company
(4) Office Phone
(5) Home address
(6) Date of birth
(7) Weight, height, color hair and eyes
(8) Length of anticipated employment
(9) Social Security Number
15.1 The roster shall be furnished to the Government within five (5) business days after the date of contract award.
When any Contractor personnel changes occur, the Contractor shall provide an updated roster and individual information to the Government within five (5) business days. The prompt submission of this information shall keep, to a minimum, any delay and inconvenience to the Contractor and Contractor personnel in performance of the contract. The information shall be used for accomplishment of the Form PTSMH 5521/11486, Local Visitor Request, completed by the Government for NAVSEA Portsmouth Site Security Officer.
15.2 Contractor personnel shall bring two (2) valid forms of personal identification which indicates proof of United States citizenship, such as an original birth certificate or current Passport, and all completed forms to the Site Security Officer for badge photograph and identification when notified by the Government. Contractor personnel shall bring two (2) valid form of personal identification which indicates proof of United States citizenship, such as an original birth certificate or current Passport during each visit to PNS.
15.3 The Contractor and Contractor personnel shall comply with all security requirements imposed by the installation commander at all times while on the installation. Contractor personnel are prohibited from carrying items such as alcohol, illegal drugs, and firearms on Government property. Entry into some Government spaces may constitute consent to search persons and all property within their control. Personal Electronic Devices (PEDs) are restricted inside the Controlled Industrialized Area (CIA). PEDs include camera equipped mobile phones, dashboard/vehicle mounted cameras, photographic equipment, audio recording devices, etc. Contractor personnel involved in civil crimes and/or other incidents of misconduct may be restricted entry to PNS. The Contractor shall be responsible for insuring badge(s) are returned within three (3) calendar days of employee termination or contract completion. Contractors may be provided a more complete list of security requirements upon request.
15.4 The Contractor shall prohibit the use of Government issued keys or Electronic Access Cards by any persons other than Contractor personnel. The Contractor shall prohibit the opening of locked areas by Contractor personnel to permit entrance of persons other than Contractor personnel engaged in the performance of assigned work in those areas.
16.0. SAFETY REQUIREMENTS. Work Site Operational Safety Environment (i.e. Contractors and Non-PNS Government Agencies (NPGAs)) shall be responsible to read and understand the requirements of OSHECM Chapter 250 and can see an electronic copy of OSHECM Chapter 250 (latest revision) by using the following web site:

The Contractor shall provide and require their personnel to wear personal protection equipment (PPE) (e.g., hearing protection, eye protection, hard hat, gloves, steel-toed shoes or boots, aprons, masks, face shields, reflective vests, safety harnesses for fall protection in accordance with OSHA CFR 1926 (construction) and CFR 1915 (PNS) standards. The contractor shall be required to follow all appropriate lockout/tag out requirements as specified by OSHECM Chapter 250 and CFR 1915.89. Contractor shall conform to all applicable safety and occupational health standards published in the Federal Register or any other Occupational Safety and Health Administration (OSHA) Public Laws and ensure employees observe safety, traffic control, and fire prevention requirements in effect at the site.
16.1 Hazardous Energy Control Contractor Compliance Certification Document on page 1 in Appendix 2 shall be signed and returned to the Government prior to working at PNS.
16.2 The Contractor shall notify the Contracting Officer or Government immediately (within one (1) hour) of the occurrence of any accidents and incidents resulting in personal injury, loss of life, property damage to a government facility or equipment.
17.0 GOVERNMENT-FURNISHED FACILITIES AND SUPPORT SERVICES.
17.1 Work area: The Government shall make available during performance of this contract work spaces close to equipment location. The Contractor shall be responsible for the orderliness and cleanliness of all areas utilized in the performance of this contract. These areas shall be neat and clean, free from fire and safety hazards and unsanitary conditions.
17.2 Utilities: When possible, the Government shall make available at no cost to the Contractor water and electricity for Contractor connection at Government provided work areas. Given the scope of this work (e.g. power outages, inclement weather, mechanical failures, etc.), government provided utilities may not be available for use by the Contractor therefore requiring the Contractor to be self-sufficient with respect to air, water, and electrical utilities.
The Contractor shall instruct employees in utilities conservation practices. The Contractor shall be responsible for operating under conditions which preclude the waste of utilities and shall include the following:
A. Lights shall be used only in areas where and when work is actually being performed.
B. Mechanical equipment controls for heating, ventilation, and air conditioning systems shall not be adjusted by the Contractor or by Contractor personnel in Government areas unless authorized.
C. Water faucets or valves shall be turned off after use.
D. Government telephones shall not be used for personal reasons. Telephone access will be made available for the Contractor’s use for approved calls only. All calls require prior authorization by the Government.
Unauthorized calls by the Contractor will be reported to the Contracting Officer for resolution.
18.0 Emergency Medical Services. The Government shall provide emergency medical treatment and emergency patient transportation service for Contractor personnel. The Contractor shall reimburse the Government the cost of medical treatment and patient transportation service at the current impatient or outpatient treatment rate as appropriate. 19.0 GOVERNMENT OBSERVATIONS. Government personnel other than representatives from the Temporary Services Electrical Shop may, with Contractor/Government coordination, observe or inspect Contractor operations.
These personnel may not interfere with Contractor performance.
20.0 DOCUMENTATION AND RECORDS. All documentation, records, and schedules, as described in this SOW, which are the responsibility of the Contractor, are the property of the Government and shall remain so upon termination or completion of the contract. The Contractor shall keep these items current. Documentation, records, and schedules shall be turned over to the Government upon termination or completion of the contract. All documentation, records, and schedules are subject to the Freedom of Information Act and privacy Act.

C-202-H001 ADDITIONAL DEFINITIONS–BASIC (NAVSEA) (OCT 2018)
(a) Department - means the Department of the Navy.
(b) Commander, Naval Sea Systems Command - means the Commander of the Naval Sea Systems Command of the Department of the Navy or his duly appointed successor.
(c) References to The Federal Acquisition Regulation (FAR) - All references to the FAR in this contract shall be deemed to also reference the appropriate sections of the Defense FAR Supplement (DFARS), unless clearly indicated otherwise.
(d) National Stock Numbers - Whenever the term Federal Item Identification Number and its acronym FIIN or the term Federal Stock Number and its acronym FSN appear in the contract, order or their cited specifications and standards, the terms and acronyms shall be interpreted as National Item Identification Number (NIIN) and National Stock Number (NSN) respectively which shall be defined as follows:
(1) National Item Identification Number (NIIN). The number assigned to each approved Item Identification under the Federal Cataloging Program. It consists of nine numeric characters, the first two of which are the National Codification Bureau (NCB) Code. The remaining positions consist of a seven digit non-significant number.
(2) National Stock Number (NSN). The National Stock Number (NSN) for an item of supply consists of the applicable four-position Federal Supply Class (FSC) plus the applicable nine-position NIIN assigned to the item of supply.

C-211-H017 UPDATING SPECIFICATIONS AND STANDARDS (NAVSEA) (DEC 2018)
The contractor may request that this contract be updated to include the current version of the applicable specification or standard if the update does not affect the form, fit or function of any deliverable item or increase the cost/price of the item to the Government. The contractor should submit update requests to the Procuring Contracting Officer with copies to the Administrative Contracting Officer and cognizant program office representative for approval. The contractor shall perform the contract in accordance with the existing specifications and standards until notified of approval/disapproval of its request to update by the Procuring Contracting Officer. Any approved alternate specifications or standards will be incorporated into the contract.
C-211-H018 APPROVAL BY THE GOVERNMENT (NAVSEA) (JAN 2019)
Approval by the Government as required under this contract and applicable specifications shall not relieve the Contractor of its obligation to comply with the specifications and with all other requirements of the contract, nor shall it impose upon the Government any liability it would not have had in the absence of such approval.
C-211-H020 PROTECTION OF THE VESSEL (NAVSEA) (MAR 2019)
(a) The Contractor shall exercise reasonable care, as agreed upon with the Supervisor, to protect the vessel from fire, and shall maintain a system of inspection over the activities of its welders, burners, riveters, painters, pipe fitters, and similar workers, and of its subcontractors, particularly where such activities are undertaken in the vicinity of the vessel's magazines, fuel oil tanks, or store rooms containing inflammable materials. All ammunition, fuel oil, motor fuels, and cleaning fluids shall have been off-loaded and the tanks cleaned, except as may be mutually agreed upon between the Contractor and the Supervisor prior to work on the vessel by the Contractor. Fire hose lines shall be maintained by the Contractor ready for immediate use on the vessel at all times while the vessel is berthed alongside the Contractor's pier or in dry dock. All tanks under alteration or repair shall be cleaned, washed, and steamed out or otherwise made safe to the extent necessary, and the Contractor shall furnish the vessel's Gas Free Officer and the Supervisor with a "Gas Chemists' Certificate" before any hot work is done. The Contractor shall maintain a fire watch aboard the vessel in areas where the Contractor is working. All other fire watches aboard the vessel shall be the responsibility of the Government.
(b) Except as otherwise provided in contractually invoked technical specifications or NAVSEA furnished directives, while the vessel is at the Contractor's plant and when the temperature becomes as low as thirty-five degrees Fahrenheit, the Contractor shall assist the Government when requested in keeping all pipe-lines, fixtures, traps, tanks, and other receptacles on the vessel drained to avoid damage from freezing, or if this is not practicable, the vessel shall be kept heated to prevent such damage. The vessel's stern tube and propeller hubs shall be protected by the Contractor from frost damage by applied heat through the use of a salamander or other proper means.
(c) The work shall, whenever practicable, be performed in such manner as not to interfere with the work performed by military personnel attached to the vessel, and provisions shall be made so that personnel assigned shall have access to the vessel at all times, it being understood that such personnel will not unduly interfere with the work of the Contractor's workmen.
(d) The Contractor shall at all times keep the site of the work on the vessel free from accumulation of waste material or rubbish caused by its employees, or the work performed by the Contractor in accordance with this contract, and at the completion of such work shall remove all rubbish from and about the site of the work, and shall leave the work in its immediate vicinity "broom clean", unless more exactly specified by the Supervisor.

C-222-H001 ACCESS TO THE VESSELS BY NON-U.S. CITIZENS (NAVSEA) (APR 2019)
(a) No person not known to be a U.S. citizen shall be eligible for access to naval vessels, work sites and adjacent areas when said vessels are under construction, conversion, overhaul, or repair, except upon a finding by COMNAVSEA or his designated representative that such access should be permitted in the best interest of the United States. The Contractor shall establish procedures to comply with this requirement and NAVSEAINST 5510.2D.
(b) If the Contractor desires to employ non-U.S. citizens in the performance of work under this contract or agreement that requires access as specified in paragraph (a) of this requirement, approval must be obtained prior to access for each contract or agreement where such access is required. To request such approval for non-U.S. citizens of friendly countries, the Contractor shall submit to the cognizant Contract Administration Office (CAO), an Access Control Plan (ACP) which shall contain as a minimum, the following information:
(1) Badge or Pass oriented identification, access, and movement control system for non-U.S. citizen employees with the badge or pass to be worn or displayed on outer garments at all times while on the Contractor's facilities and when performing work aboard ship.
(i) Badges must be of such design and appearance that permits easy recognition to facilitate quick and positive identification.
(ii) Access authorization and limitations for the bearer must be clearly established and in accordance with applicable security regulations and instructions.
(iii) A control system, which provides rigid accountability procedures for handling lost, damaged, forgotten or no longer required badges, must be established.
(iv) A badge or pass check must be performed at all points of entry to the Contractor's facilities or by a site supervisor for work performed on vessels outside the Contractor's plant.
(2) Contractor's plan for ascertaining citizenship and for screening employees for security risk.
(3) Data reflecting the number, nationality, and positions held by non-U.S. citizen employees, including procedures to update data as non-U.S. citizen employee data changes, and pass to cognizant CAO.
(4) Contractor's plan for ensuring subcontractor compliance with the provisions of the Contractor's ACP.
(5) These conditions and controls are intended to serve as guidelines representing the minimum requirements of an acceptable ACP. They are not meant to restrict the Contractor in any way from imposing additional controls necessary to tailor these requirements to a specific facility.
(c) To request approval for non-U.S. citizens of hostile and/or communist-controlled countries (listed in Department of Defense Industrial Security Manual, DOD 5220.22-M or available from cognizant CAO), Contractor shall include in the ACP the following employee data: name, place of birth, citizenship (if different from place of birth), date of entry to U.S., extenuating circumstances (if any) concerning immigration to U.S., number of years employed by Contractor, position, and stated intent concerning U.S. citizenship. COMNAVSEA or his designated representative will make individual determinations for desirability of access for the above group. Approval of ACP's for access of non-U.S. citizens of friendly countries will not be delayed for approval of non-U.S. citizens of hostile communist-controlled countries. Until approval is received, Contractor must deny access to vessels for employees who are non- U.S. citizens of hostile and/or communist-controlled countries.
(d) The Contractor shall fully comply with approved ACPs. Noncompliance by the Contractor or subcontractor serves to cancel any authorization previously granted, in which case the Contractor shall be precluded from the continued use of non-U.S. citizens on this contract or agreement until such time as the compliance with an approved ACP is demonstrated and upon a determination by the CAO that the Government's interests are protected. Further, the Government reserves the right to cancel previously granted authority when such cancellation is determined to be in the Government's best interest. Use of non-U.S. citizens, without an approved ACP or when a previous authorization has been canceled, will be considered a violation of security regulations. Upon confirmation by the CAO of such violation, this contract, agreement or any job order issued under this agreement may be terminated or default in accordance with the clause entitled "Default (Fixed-Price Supply and Service)" (FAR 52.249-8), "Default (Fixed-Price Research and Development)" (FAR 52.249-9) or "Termination (Cost Reimbursement)" (FAR 52.249- 6), as applicable.
(e) Prime Contractors have full responsibility for the proper administration of the approved ACP for all work performed under this contract or agreement, regardless of the location of the vessel, and must ensure compliance by all subcontractors, technical representatives and other persons granted access to U.S. Navy vessels, adjacent areas, and work sites.
(f) In the event the Contractor does not intend to employ non-U.S. citizens in the performance of the work under this contract, but has non-U.S. citizen employees, such employees must be precluded from access to the vessel and its work site and those shops where work on the vessel's equipment is being performed. The ACP must spell out how non-U.S. citizens are excluded from access to contract work areas.
(g) The same restriction as in paragraph (f) above applies to other non-U.S. citizens who have access to the Contractor's facilities (e.g., for accomplishing facility improvements, from foreign crewed vessels within its facility, etc.) except that, with respect to access to the vessel and worksite, the restrictions shall not apply to uniformed U.S.
Navy personnel who are non-U.S. citizens and who are either assigned to the ship or require access to the ship to perform their duties.
