JUSTIFICATION FOR URGENCY ($2,500 to $250,000)

Ref: FAR 13.106 and NAVSUP 4200.85D Chapter 5 Paragraph 2.b.(2)(b)

The service or material listed on (Document number) is urgent and advertising requirements are precluded for reasons indicated below. If the service/material is not received by the Required Delivery Date (ROD), specific damages to the Navy will result.

2. Brief descriptive narrative of service or material required:

Fabrication of custom disposal containers to be used for a project at the . Usage will be in the Delivery date for the containers must include sufficient time for inspection of the containers as well as time to address any deficiencies that may be found during inspection. Containers must then be shipped from

4. Describe the resulting damages if the above required delivery date is not met. Explain why the service/material is needed and what will happen if it's not received by the RDD. (As necessary, describe the impact on overhaul/availability schedules, impact to base support, personnel safety issues, potential environmental damages, etc.) The impact should be expressed as the daily cost (labor, material, etc.) to the government for each day of delay beyond the RDD.

The RDD is selected delays in delivery will directly translate into day-for-day delays in critical-path project work at the , because we will be unable to remove the necessary items without a container into which they can be placed. This is sequential work with no parallel path. The project has stated that each day of delay results in a one million dollar cost to the government.

5. Lack of prior planning does not support urgency. Please provide a time-line beginning on the date the need was first identified and ending on the date the requisition was submitted to the Contracting Office. Why is the claimed "urgency" not the result of a lack of advanced planning?

What is the minimum quantity that must be obtained by the RDD? Why can't some of the total required quantity be procured under urgency while procuring the remaining items/services through the normal procurement process?

All containers will be used within an approximate one-week time span. The entire quantity is urgent, and no portion of the order may be contracted separately through the normal contracting process.
