About this file

This is a Justification and Approval (J&A) document for use of other than full and open competition in federal procurement.

Naval Facilities Engineering Systems Command, Europe, Africa Central Command (NAVFAC EURAFCENT) in Naples, Italy seeks to award a sole-source modification to Contract N33191-25-C-6015 to KVG, LLC for design and construction of a Helipad Parking Apron at Mari Naval Base, Cyprus. The Government's estimated cost for this project is $2.45 million, requiring 200 days of performance. The statutory authority cited is 10 U.S.C. 3204(a)(1), permitting award when only one responsible source can satisfy agency requirements. The justification emphasizes that the new helipad parking apron must integrate directly with the taxiway and take-off/landing pad currently under construction by KVG LLC, and the site's physical constraints—including limited flat space, active military operations, and insufficient staging areas—make concurrent contractor operations unsafe. The incumbent contractor already occupies the only available laydown area and has completed topographical, geotechnical, and design work approved by Cyprus authorities; awarding to another contractor would require duplicating these efforts and mobilization costs, estimated at significant amounts. Competing the requirement would introduce unacceptable 11-month delays compared to one month for sole-source award, which risks operational readiness and mission schedules accelerated due to Operation Epic Fury. A synopsis posted on SAM on March 11, 2026 generated one interested contractor whose previous bid was 4.92 times higher than the incumbent. The Contracting Officer has determined the anticipated cost to be fair and reasonable, and future Cyprus projects will be solicited on a full and open basis.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Facilities Engineering Systems Command, Europe, Africa Central Command (NAVFAC EURAFCENT), Naples, Italy

2. Description of the Action Being Approved.

Award of a modification on a sole source basis to Contract N33191-25-C-6015, “Design- Build Helipad Mari Naval Base Cyprus” for a Helipad Parking Apron.

3. Description of Supplies/Services.

The proposed contract action will include the design and construction of a Helipad Parking Apron connecting to the current Helicopter Take-Off/Landing Pad and the Helicopter Taxiway. The Government estimate for this project is $2.45M and requires 200 days of performance.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 3204(a)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

In accordance with FAR 6.302-1(a)(1):

The proposed award is a modification to an existing design-build contract for the construction of a Helipad Parking Apron at Mari Naval Base, Cyprus. The services required for the Helipad Parking Apron are available from only one responsible source, the incumbent contractor, KVG, LLC, and no other type of supply or service will satisfy agency requirements. Awarding this contract modification to any other source would introduce unacceptable safety risk and operation disruptions for the following reasons:

Integration and Site Management: The new helipad parking apron is not a standalone project; it must tie directly into the taxiway and helipad Take-Off/Landing Pad currently under construction by KVG LLC at Mari Naval Base. The physical constraints of the site make it unsafe for a second contractor to operate concurrently.

Mari Naval Base is an active operational facility with significant space limitations.

Introducing a second contractor will create significant site coordination and control challenges as well as substantially increase safety risks to both the contractors and military forces using the base. Furthermore, Mari Naval Base is space constrained and lacks sufficient lay down and staging areas for two contractors to operate simultaneously.

design-build contract at an estimated cost of . KVG has also substantially completed the design for the required cross-section of the helipad and apron with all associated storm-water measures within the existing project. These designs have been approved and permitted by the Cyprus Ministry of Defense and the Environmental Protection Agency of Cyprus for the existing work and the new work is substantially similar. A new contractor will be required to duplicate many of these costs, developing new designs and performing their own surveys, resulting in redundant design efforts, and additional government reviews and permitting processes. These costs are estimated to be up to .

A new contractor will also be required to mobilize personnel and equipment to the site simultaneous to the incumbent. KVG LLC is already mobilized with established base access, permits, and VAT exemption, which took approximately six (6) months. This process would likely be longer for a new contractor as a result of Operation Epic Fury.

A new contractor will face the same lengthy processes as well incur additional, duplicated mobilization costs estimated at .

Further, these costs will not be recouped through competition. Competitive award of the current project resulted in five timely proposals, of which four were deemed responsive. Of the four responsive contractors, only two were priced in the competitive range. Examination of these two offers in accordance with the prescriptions of the Source Selection Plan resulted in the incumbent, KVG LLC, earning the only acceptable rating for award.

Unacceptable Delays: Competing this requirement is estimated to take approximately six (6) months, plus the aforementioned six (6) months for base access and permits, as compared to the approximate month necessary to award as a sole-source modification to the existing contractor. This additional 11 month delay is prohibitive and will not support program requirements, as it risks impacting the operational readiness and critical mission schedules at Mari Naval Base, which have been accelerated due to Operation Epic Fury.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A synopsis of the proposed contract action was posted on the System for Award Management (SAM) website on 11 March 2026. While one contractor responded expressing interest, the original bid submitted by this contractor in response to the initial solicitation was 4.92 times higher than the incumbent and therefore their technical proposal for the original work was not evaluated, and it is not anticipated that this firms price for the new work would be more favorable to the Government than KVG’s if competed. No other sources have expressed interest in the proposed action. No additional market research was conducted because it is not practicable, for the reasons discussed in paragraph five, for any company other than KVG LLC. to provide the required services.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

NAVFAC has no plans at this time to compete future contracts for the types of services covered by this document. Future projects in Cyprus will be solicited on a full and open basis.
