3. PPI Questions and Answers:

Pre-Proposal Inquiry 0004 - It is specified as 'The Government will evaluate price based on the total price, exclusive of the Value Added Tax (VAT)' in section 00 72 00 - Contract clause (pg.6) of the RFP document. Are we also exempt from Customs and other taxes?

Answer: This project is exempt of value added tax (VAT), sales tax, custom fees and other similar fees as allowed by Tunisian laws and regulations. The contractor shall discuss the extent and requirements to obtain these exemptions with corresponding Tunisian fiscal authorities before starting any works (construction or design) on site.

The contractor shall implement the proper procedures for any procurements subject to any tax exception prior to the procurement, directly with the corresponding fiscal authorities. The US Government representatives will remain available for any support necessary. However, the initiative and responsibility to implement any tax exemption procedure relies exclusively on the contractor.

Pre-Proposal Inquiry 0005 - Could you please clarify that whether one static load test is enough for pile foundation?

Answer: One static load test will suffice.

Pre-Proposal Inquiry 0006 - It is seen in the site visit that the structural quality and stability of the dining building and auditorium is not good. Moreover, it is to be worried about restoring of the building will not be a solution for the mailto:graeme.l.silva.civ@us.navy.mil scope of the project. In addition, since the building age is over 50 years, risk level would be very high even if it were restored. According to scope of work, contractor is not responsible from structural strengthening works. Is contractor responsible from checking structural stability of the buildings? If yes, and structural stability is not found in good condition after contractor’s survey, will structural strengthening works considered as additional works?

Answer: The contractor shall perform a non-obtrusive structural test on the Auditorium as it is recommended in Attachment 9 of the PTS. No structural test is required for the dining facility, per Attachment 9. If the structure is found to be unstable, the project will be re-evaluated depending on funds availability.

Pre-Proposal Inquiry 0007 - Since the date of the site visit is very close, we request a 1 week extension to the bid closing date.

Answer: The proposal due date is extended from Friday, March 10, 2023 at 1400 hrs. to Monday, April 03, 2023 at 1400 hrs.

Pre-Proposal Inquiry 0008 - DFARS 252.204-7004 Level I Anti-Terrorism Awareness Training for Contractors (FEB 2019). As stipulated in the DFARS clause, will there be a French and Arabic version of this training available for Local Nationals who do not speak English and not able to take the online English version of the course? If yes, is there a cost for this training?

Answer: The DFARS clause 252.204-7004, shall be removed from the solicitation. The clause is not applicable to this solicitation or the resulting contract.

Pre-Proposal Inquiry 0009 - Reference RFP Page 5/41, Section 4 INSTRUCTION FOR SUBMITTING PRE- PROPOSAL INQUIRIES - Pre-proposal questions will be accepted ten (10) calendar days before the proposal due date, any inquiries made after that date may not be answered. Due to the delayed site visit for this program, we would like to know if an extension on submission of questions and proposal can be granted?

Answer: See RFI #7 above

Pre-Proposal Inquiry 0010 - The VAT exemption period takes longer than expected in Tunisia. Please confirm that the contractor will not start any Design activities including Topographic Survey or Geo-Technical survey without VAT exemption being approved by the Government.

Answer: Topographic survey and geo-technical survey are not part of this project. The topographic and geo-technical surveys are provided as Attachment 3 in the PTS. Per 1.1 Taxation of the PTS, "The contractor shall receive this [VAT] exemption prior to proceeding to construction." The government expects design to be concurrent with the VAT exemption process.

Pre-Proposal Inquiry 0011 - Please clarify if customs exemption applies for this project?

Answer: This project is exempt from value added tax (VAT), sales tax, custom fees and other similar fees as allowed by Tunisian laws and regulations.
