- Compliance with technical and administrative requirements described in this document.

2.3 General Contract Description

This document is a Performance Technical Specifications (PTS) for a full Design-Build project. This PTS includes a description of the required finished work.

This is a design-build contract. This means that the contractor is responsible to:

- Assist the Municipality with the Urban Planning changes that shall be required to combine two public plots of land into a single urbanistic unit to build the new nursery. It is estimated that the smaller plot of land will be fully developed, but not provided with any construction, and shall only be used as gardens and entrance to the nursery. The assistance shall be limited to taking measurements and providing technical information to the Municipality. The Municipality owns the process to make the land perfectly usable for the intended use of this document or this contract.

- Make necessary designs as required by this PTS for the different items of work

- Obtain NAVFAC’s acceptance of the designs and the approval of the Municipality of

Mangalia (or other competent Romanian authority).

- Obtain required formal approvals from competent and required Romanian authorities, including the necessary expert review by third party company as required by Romanian regulations, which shall be paid by the contractor.

In case the Romanian regulations do not allow for the contractor to be the client for this independent review, the contractor shall pay for the third party review and assign a different party as the client for this independent company, which could be the Contracting Officer Representative or other agency authorized by the Contracting Officer (i.e. the Municipality of Mangalia).

Note: The contractor needs to be familiar with the regulations of Romania, in order to account for the different required permits, urban planning, reviews and authorizations for new construction works. In a similar project performed in Romania by NAVFAC, the contractor worked together with the Municipality for 10 months, until the plot of land was legally suitable for the new construction of another nursery.

2.4 General Project Description

This document includes everything necessary to provide a perfectly finished, certified and operational kindergarten, as described in this document.

The contract is divided into a Base-Bid and 2 Contract Options. In general terms, the works include the following items of work:

- Base-Bid: Design and construction of a new kindergarten with a built area of 415 to 420 m², to provide an usable area of minimum 345 m² and a terrace of minimum 20 m².

- Contract Option-1: Additional 110 m² built area or 90 m² of usable area. Design and construction of additional areas to provide a new kindergarten with a total built area of 525 to 530 m² to have minimum usable area of 435 m²

2.5 Construction Permit or Authorization – Construction Permit

The contractor shall obtain formal written authorization from the competent Romanian authority to perform the works included in the scope of work of this project.

Note: The works will be executed in a Romanian public building. The contractor shall coordinate with the Municipality the required procedures for a construction company to perform the design and construction works for a new kindergarten within two contiguous public plots of land in the Municipality of Mangalia, while being paid by the US Government. In previous projects the contractor designated the Municipality as the assigner of the project. It is absolutely necessary that the contractor is familiar with the Romanian bureaucratic procedures to obtain approval for the land availability, designs, renovation, construction, alternations and improvements included in this contract.

The contractor is required, as part of this contract, to prepare all documentation, designs, reports, information, drawings, coordination and approvals by experts or monitoring entities, and everything that may be necessary as required by Romanian regulations, in order to obtain the necessary Construction Permits. This includes providing technical information to the Municipality, which may be required for merging the two plots of land within one. The contractor is responsible to pay for any third party inspection or expertise that may be required by Romanian regulations for the scope of work of this project. The contractor shall be familiar with these requirements in order to prepare their bids, regarding the obligatory administrative and technical procedures in Romania.

As previously stated, the contract includes third party review of all items of work which are required as per Romanian regulations. In case the Romanian regulations do not allow for the contractor to be the client for this independent expert company, the contractor shall pay for the third party review and assign a different party as the client for this independent company, which could be the Contracting Officer Representative or other agency authorized by the Contracting Officer (i.e.

Municipality of Mangalia)

No work shall be performed until the contractor shows verifiable evidence that they have obtained all the necessary permits for each element of work included in this contract. This shall be certified by the third party independent monitoring entity.

2.6 Measurements and Quantities

This contract complies with the US Contracting Regulations, and as such, measurements and quantities of materials and work are not provided, and if any are provided, the contractor shall be responsible to verify on site. The contractor needs to visit the job site in order to perform the necessary measurements and to observe the existing field conditions in order to prepare their cost proposal. The contractor should be familiar with the geotechnical conditions in Mangalia and with the seismic technical requirements in order to account for the necessary foundations and building structure which are required in compliance with Romanian regulations. For estimating purposes, the contractor shall estimate that the existing soils are the worst (least favorable) existing in Mangalia for the foundation and structure design.

The contractor shall investigate and obtain geotechnical reports from recently completed construction projects in order to prepare their cost proposal. The US Government is not responsible for any mistake in the contractor’s measurements or assumptions of field conditions, including soil conditions.

2.7 Design Phase - General

The designs shall be prepared in compliance with applicable construction codes, applicable urban planning in this area of Mangalia and construction practices in Romania. The contractor shall hire the services of an architect (or architectural firm) licensed in Romania to design all works, as detailed in this document. At the same time, after obligatory coordination with the Municipality of Mangalia, the contractor shall hire (and pay for) the services of a “Revision Entity - Expertise” authorized by the Government of Romania to supervise and approve each phase of the design and the construction, including final commissioning and acceptance of the facility. This company shall report directly to the US Government representative and the beneficiary if required by the Romanian regulations, but all their services shall be paid by the contractor.

The design shall comply with all applicable regulations in Romania for the scope of work of this contract.

The contractor’s final designs shall be signed, stamped and certified by a licensed architect in Romania, it shall be approved by an authorized “Revision Entity - Expertise” and it shall be approved by the competent Romanian authorities for construction projects in public property before its construction is authorized to start. The level of detail of the design (extent of specifications, number and size of drawings, calculations,…) shall be sufficient to verify the compliance with the requirements of this contract and as required by the regulations of Romania and of the competent Romanian authorities for this particular project.

Mangalia Nursery – Design and Construction Mangalia, Romania

RO-HA-2018-00034824 Page 12 of 111 Version: 002

2.8 Construction Phase - General

The construction shall follow the designs and technical projects prepared by the architect and for which the contractor shall obtain the corresponding construction permits or authorizations.

The architect who prepares the designs shall visit the site for every important and relevant phase of work, to partially accept the completed works. Despite the requirements of the Romanian regulations for the visits of the designer, once the works start, the architect shall visit the site as a minimum once every week.

Two days in advance of each site visit of the architect, the contractor shall inform ODC Romania and the beneficiaries (Mangalia Municipality and the proposed Nursery Director) of the planned arrival time to the job site.

In addition to these minimum weekly visits, the architect shall visit the site when the Contracting Officer Representative (COR) visits Mangalia, estimated at once every two months.

In addition to these visits, the third party experts that may be required will visit the site as required by Romanian regulations, and also when the COR visits the site.

No work shall be accepted until the Final Act of Acceptance is provided.

2.9 Applicable Requirements / Standards

The project is based on the principle of strict compliance with Romanian technical and administrative regulations, with US Contracting Regulations and with Romanian Safety regulations unless EM 385-1-1 has more strict requirements. In case of conflict between Romanian and US safety regulations, the contractor shall apply Romanian regulations.

The design of the new kindergarten (or nursery) shall comply with all applicable Romanian regulations, but in particular, it shall be designed in strict compliance with the NP-2297: Norm on Design and Special Requirements of Nurseries, or “NORMATIV PRIVIND PROIECTAREA

CREŞELOR ŞI CREŞELOR SPECIALE PE BAZA EXIGENŢELOR DE PERFORMANŢĂ

INDICATIV NP 02297” (name of norm in local language)

In case of conflict between the specific technical requirements of this document (PTS) and NP02297, the technical requirements of this document (PTS) shall take precedence, if, and only if, the technical requirements of this document (PTS) do not violate the requirements of the Romanian legislation. For example, if the NP02297 requires ceramic tiles, but the PTS specifies porcelain stoneware, the contractor shall install porcelain stoneware because this is simply a higher quality type of ceramic tiles. For example: if the NP02297 requires individual sinks, but this PTS requires sinks with a countertop, the contractor shall install the countertops, because it should not violate the Romanian legislation. For example, if the NP02297 does not say anything about the toilet partitions, but the PTS requires phenolic toilet partitions, the contractor shall install phenolic toilet partitions, because it should not violate the Romanian legislation. However, if the NP02297 would state the nursery needs to have a room for storing the strollers, but none is mentioned in this PTS, the contractor shall provide a room to be used to store the strollers, but within the total usable/built areas stipulated in the contract requirements.

Mangalia Nursery – Design and Construction Mangalia, Romania

RO-HA-2018-00034824 Page 13 of 111 Version: 002

The work shall meet all requirements of this Request For Proposal (RFP) package. Drawings to be as required in these PTS and with the necessary details and previous approvals (experts or monitoring entities) to submit the designs to the US Government, Local Romanian Administration, final users, contractor’s staff and sub-contractors. Material selection, specifications and installation to be as described in these Performance Technical Specifications (PTS). The Performance Technical Specifications (PTS) are a guideline for the design package:

If an item in the project design is included in the PTS, the requirements of the PTS, applicable local Romanian codes and regulations, and international codes shall govern.

If an item in the project design is NOT included in the PTS, the requirements of applicable local Romanian codes and regulations, and international codes shall govern.

Provide the final work as a complete and usable facility including all required items not described in this RFP. Technical details, items of work, permits or fees that are not explicitly described in this RFP, but which are necessary to provide a fully operational and finished kindergarten/nursery facility shall be considered part of this contract.

Any work not explicitly included in the scope of work of this project, but which is absolutely necessary to have a perfectly operational facility, as required by Romanian regulations, shall be considered and treated as part of the requirements of this contract.

Construction Phase - General

Once the contractor completes the design and they show evidence of formal authorization by the competent local authorities and Monitoring Entity, and the contractor shows that they have completed other administrative contract requirements (Accident Prevention Plan, Quality Control Plan, Schedule,…), the Contracting Officer will inform the contractor that they may start the construction phase of this design-build contract. This notification is called Notice to Proceed or

NTP.

Under this phase, the contractor shall provide all necessary work in order to provide complete and usable kindergarten/nursery facilities, including, but not limited to: Foundations, Structure, Exterior Enclosure, Roof System, Interior Construction, flooring, doors, windows, Plumbing Systems, Central Heating system, Air Conditioning, Electrical Installation, Lighting Protection, Fire Protection, Communications, Site Improvements, pavement connections, development of the plot of land, connection and coordination with electrical, water, and gas systems, sewage system, finishes and other works as required in order to have a fully operational facility. Other elements that may not be explicitly included in this document, but which are absolutely necessary to provide 1 complete and usable kindergarten/nursery facility as required by Romanian regulations shall be considered to be an integral part of the project, and therefore, shall be considered to be part of this contract.

The contractor shall familiarize with the requirements of the Romanian regulations for kindergarten/nursery construction.

Tables, desks, chairs, computer, phones, washing machines, refrigerator, beds, televisions, and other movable equipment are not part of this contract, unless otherwise indicated in these technical specifications. Only those elements that are fixed, permanently attached to the building or considered as an integral part of the facility, and specifically described in these contract specifications or in the applicable Romanian regulations, are included in this contract, unless otherwise indicated in this document.

Requirement for Romanian Code and Regulation

The contractor shall request, process and pay for any permits that may be required in accordance with Romanian Law for this type of construction. The contractor shall follow the current pertinent Urban Development regulations of Mangalia. The contractor shall hire and pay for the services of a “Revision Entity” (or expertise) authorized by the Government of Romanian as required by Romanian Regulations for this type of construction. If it is not allowed for the contractor to hire this third party inspection company, the contractor shall pay but assign the beneficiary or NAVFAC as the client. The contractor shall provide a copy of the pertinent construction permit to be issued by the competent local authorities and approval by the Monitoring Entity of the design, before they are authorized to start work.

For each completed phase of work, as required by Romanian regulations, the contractor shall provide the certificate of the third party monitoring entity in order to process payment for that particular phase of work.

3 GENERAL SCOPE OF WORK OF BASE BID

The Base-Bid of the project includes the items of work specified in this paragraph 3 and its subparagraphs, which include the necessary work in order to have an operational nursery/kindergarten facility in the given public plot of land. This includes:

- Design and construction of a new kindergarten with a built area of 415 to 420 m², to provide an usable area of minimum 345 m² and a terrace of minimum 20 m².

- Cleaning and grading of 3250 m² of land. No fence required in the Base-bid, but clear delimitation of plot of land is necessary (i.e. with simple metal posts at corners of plot of land). It is not required for the complete development of the plot of land, but only the access by people and vehicles to the new facility.

- Providing paved pedestrian access from main street (Street Rozelor)

- Providing car access and area for parking vehicles as required by Romanian regulations

NAVFAC currently completed the design and construction of a new nursery/kindergarten in the Romanian city of Caracal. Bidders can visit this site prior coordination with the Program Manager from the US Office of Defense Cooperation in Romania Ms. Negoita. (corina.negoita.ln@mail.mil)

3.1 General Basis of Design

This is a 100% Design Build contract. This means that the US Government is not providing technical projects or detailed measurements, but only sketches to better understand the requirements of this contract. All requirements of this document shall be considered by the architect hired by the contractor in order to prepare their conceptual design and later the full technical project, with the requirements described in this document and those required by the applicable regulations which may not be explicitly described herein.

The contractor shall hire the services of a licensed architect in Romania to design one complete and fully operational nursery/kindergarten in coordination with the US Government representative, with the beneficiaries (Municipality of Mangalia and the proposed Kindergarten Director) and other pertinent competent Romanian authorities. These contract Performance Technical Specifications (PTS) include the minimum general requirements. It shall be the licensed architect the professional to provide the best layout and distribution, meeting the minimum requirements outlined in this document with the restrictions and limits of the Urban Planning of this areas of Mangalia.

The design includes all elements of this document: base-bid and the two contract options.

Depending on how many contract options are awarded, the contractor shall prepare the pertinent designs. However, the US Government shall unilaterally decide the award (or not award) of Contract Option-1 at the time of award of the Base-Bid, so that only one design and technical project shall be necessary for the main kindergarten/nursery building.

3.2 Demolitions and elements interfering with the new construction

The contractor is responsible to survey the area prior to submission of their bid. They shall be responsible to demolish anything within the footprint of the new facility which may interfere with the new construction.

They shall locate and reroute any potential utility line (cables, piping,…) that may interfere with the construction of the new facility.

The contractor is responsible to survey the area, but simple visual inspection shows that as a minimum the contractor will be required to remove the fence separating the plot of land currently used by the kindergarten from the plot of land currently used by the school. This removed fence can be reutilized to separate the new resulting plot of land of 3,250 m² from the rest of the kindergarten and school areas. Although the perimeter fence is included as a contract option, the complete demolition of all fences separating the final resulting plot of land is included as part of the Base-Bid.

The pavement at the section of the plot of land currently used by the kindergarten can be used as general parking areas in the Base-Bid. If Contract Option-2 is awarded, these shall all be demolished as part of the complete development of the plot of land.

Typical section for new mortarless brick pavement

The amount of sidewalk surface, can be easily estimated based on the proposed layout. However, the amount and location of the colored interlocked concrete bricks will depend on the location and orientation of the new building, which shall be determined by the architect hired by the contractor, with an amount not less than 300 m².

The new facility shall be properly connected with the adjacent street. This will require minimum work outside the plot of land, to connect the new paved areas with the asphalt of the adjacent street and providing a metal hinged gate where there is currently a masonry and metal fence (see pictures)

For estimating purposes, the contractor can estimate 300 m² of solid colored bricks, held on both sides by pre-cast concrete curbs on their concrete foundation.

The new required sidewalks which surround the new building annex shall be provided with exposed concrete finishes, without the need to provide solid brick pavement.

For the paved areas with solid concrete bricks the contractor shall use interlocking bricks, in combination of 2 colors, over a 10 cm thickness reinforced concrete slab. This is to avoid any possibility of sinking for poor compaction if the area is eventually used by heavy vehicles.

These paved areas shall be designed by the architect hired by the contractor, and they shall be surrounded with precast concrete curbs embedded in solid concrete foundations.

Design the paved areas with adequate drainage, to avoid any accumulation of surface water.

3.4 Partial Development of Plot of Land (3,250 m²)

The contract in its Base-Bid includes the partial development of the plot of land of 3,250 m². This includes the very minor development necessary for the plot of land to be cleaned, leveled and clearly identifiable without any internal fences and with limits also clearly identifiable. The plot of land needs to be clearly identifiable as an independent plot of land from the areas occupied by the kindergareten#02 and by the School. The plot of land would be left with the existing paved area in the Kindergarten#02 portion of the plot of land for parking purposes. This would include elements such as:

- Removing all garbage and gravel and all garbage within the 3,250 m² identified for this project.

- Remove all vegetation not necessary for the future kindergarten/nursery.

- Leveling and grading the areas as necessary to provide adequate surface drainage of all areas of the plot of land.

All areas not to be used for construction (new building, sidewalks or paved areas) are estimated to be used as gardens (see definition and scope of work of Contract Option-2 in order to define the difference between the work included in the Base-Bid and the works included in the Contract Option-2). The Base-Bid only includes minimum develoments.
