100 Section 17, pdf page 33, paragraph 2.3: Please confirm that as stated in this paragraph that the government will be responsible for “(ii) Loss or damage caused by the negligence of the Contractor, its agents, or employees”
That is incorrect. The Contract states' The Government shall be responsible for loss or damage to (1) Leased vehicles EXCEPT FOR normal wear and tear; and loss or damage caused by the negligence of the Contractor, its agents, or employees.' The Contractor is responsible for loss or damage caused by negligence of the Contractor, its agents, or employees.
101 Section 17, pdf page 35, paragraph 2.3.3: Will fines incurred by government personnel simply be passed to the end user for payment? If not does the government expect contractors to pay these fines and invoice the government?
No. Fines incurred by Government personnel as a result of infractions incurred shall be paid by Government personnel who incur said fines. No, the Government does not expect the contractor to pay fines incurred by Government personnel, and the contractor shall not invoice the Government for fines incurred by Government personnel.
102 Section 17, pdf page 35, paragraph 2.3.3: Will contractors be required to file a claim for reimbursement for any fines paid that were incurred by government personnel? If so, what documentation will be required by the government to be provided by the contractor to support these claims?
Fines incurred by Government personnel shall be paid by the Government personnel that incurs those fines. Contractor is not responsible for payment of infractions incurred by Government personnel, therefore there should not be any instances where there would be cause for a contractor to file a claim for reimbursement of payment of fines incurred by Government personnel. No documentation is required from the contractor, as Government personnel shall pay costs incurred as a result of infractions.
103 52.212-2 Evaluation-Commercial Items, pdf page 57, paragraph (a): This paragraph states that a contract will be awarded to the offer that is “most advantageous” to the government. Can the government please clarify which method will be used?
This is a lowest price technically acceptable contract.
104 When a task order requirement arises, does the Government contemplate a single task order award (one awardee) for each performance country, or could contemporaneous requirements in a single country be split amongst multiple task order awardees?
TO will be based on customer needs for the for the Area of responsibility within the contract.
105 Vehicle description has example of acceptable range, brief requirement, equivalent models and engine horsepower capacity. Whilst the common vehicle description is number of cylinders and engine sizes, there is no reference to number of cylinders or engine size defined; therefore the equivalent models indicated are helpful. However, these also include varying ranges of car classes and horsepower not necessarily meeting the horsepower indicated due to change in manufacturer’s production line.
Moreover, horsepower description itself is a variable technical feature which can vary on different makes/models as well as within same type of vehicle across different model years. Kindly confirm that complying with equivalent models indicated alone is acceptable.
Contractor shall meet the specifications outlined in the SOW.
