The contractor shall have a physical and permanent office located within Europe, and may be required to set up a physical office within Africa and/or Southwest Asia.

3. Scope of Work

*THE FOLLOWING DESCRIPTIONS CORRESPOND TO ENCLOSURE (1) SCHEDULE OF PRICES –

EXHIBIT LINE ITEM NUMBERS (ELINS).

Item 01 – Quarterly Reports and FGS updates not requiring determinations

The Contractor shall provide periodic summaries of the changing environmental standards (e.g., European Union and Host Nation national laws and regulations) and an assessment of their applicability to and impact on DoD installations. All relevant environmental regulations as defined by host nation, not limited to DoD OEBGD (for example, Radon, Electro Magnetic Forces (EMF), etc) will be analyzed. Quarterly Reports will be required for Greece, Italy and Spain (Item 01GQ), Iceland (Item 01IQ), and Bahrain Djibouti, UAE, Kenya, and Jordan (Item 01BQ). In each quarterly report the Contractor shall identify all changes to environmental laws and regulations in force in the host nation (to include applicable EC Directives and Regulations) regarding the environment promulgated over a 3-month period (1 quarter). Each report shall include:

• Full identification of the new laws including issuing authority, legal citation, and name or title. If a law is available on the internet, the URL will be provided.

• A brief analysis of the applicability (see DODI 4715.5 section 6.3.3.1 and E.2.1.4) to and impact of the new laws on DOD installations. Examples of impacts on DOD installations include requirements to obtain or revise permits, cease using or control the use of certain chemicals, inventory or assess the performance of emission control equipment, etc.

• An evaluation of the extent to which the new laws are adequately defined and generally in effect and enforced against private and public sector entities (see DODI 4715.5 section 6.3.2.2). In particular, the report shall address the applicability of the laws to the Host Nation military.

• The impact of significant and recent judicial or regulatory interpretations of existing laws and standards and significant changes (both with regard to geography and subject matter) in the enforcement strategy of regulatory authorities.

• A brief description of proposed changes to the FGS to incorporate the new laws. This description should reference sections of the FGS requiring revision or briefly describe new FGS sections that are required, including but not limited to the newly proposed FGS text incorporating the applicable requirements of these new laws. Upon Navy acceptance of FGS text, contractor will update comparative analysis.

• Pending legislation of apparent applicability to DOD installations, and which therefore, might impact the FGS at a future date. Contractor shall identify the scope and potential impact of the new laws, along with a forecast regarding promulgation (progress of the law in the legislative process, the chances it will become law, and when it is likely to be promulgated).

Contractor shall provide reports via email in MS Word format. Reports are due within 15 calendar days following the end of each quarter.

Item 02 – FGS Chapter Updates requiring determinations from Quarterly Reports.

Updating the FGS will require the Contractor to prepare written updates of FGS chapters for government review, comment, and approval. The updates will reflect changing environmental standards, identified in Item 01, and DoD policy. The contractor will also prepare a comparative analysis that evaluates the changing standards with respect to DoD 4715.5-G and DoD policy in accordance with DoDI 4715.5 paragraph 6.3.3. The Navy will provide contractor with the existing Comparative Analyses of each FGS chapter that the contractor has not developed. The comparative analyses and updated chapters shall be completed simultaneously. Item 01 provides much of the information needed for the comparative analyses. Contractors shall assume that Quarterly Reports (Item 01) are available for use as they develop the comparative analyses.

FGS Chapters are identified as Simple, Moderate, or Complex depending on the technical complexity of the chapter and the amount of host nation law included in the chapter in comparison to the OEBGD (DODI 4715.5-G).

Examples of simple, moderate, and complex chapters are attached.

The Navy will provide the Contractor electronic copies of the existing comparative analyses, chapters, and annotated chapters (identifying differences between the OEBGD and the FGS). The Contractor shall provide products in MS Word when electronic deliverables are specified.

With regard to comment resolution, for each chapter the Contractor shall collect comments and enter them on a table along with their resolution. Tables will be updated as comment resolution proceeds. For each chapter, one table will be used for Navy comments and a new table will be started for EUCOM/AFRICOM Environmental Sub-Group (ECS-G) comments.

For each chapter to be updated, the work shall be accomplished in as follows.

1. Draft Comparative Analysis. Using material from Review of Host Nation Environmental Legislation the Contractor shall develop a comparative analysis (see DODI 4715.5 sections 6.3.3.1, 6.3.3.2, and 6.3.3.3) for each FGS chapter being updated. Each comparative analysis shall include:

• A full identification of new laws relevant to Host Nation consideration of the media areas (not limited to OEBGD) including issuing authority, legal citation, and name or title. If the law is available on the internet, the URL will be provided.

• An analysis of the applicability to and impact of the new laws on DOD installations.

• An evaluation of the extent to which the new laws are adequately defined and generally in effect and enforced against private and public sector entities in the Host Nation. In particular, the report shall address the applicability of the laws to the Host Nation military.

• An analysis of the protection provided by an applicable law versus the Overseas Environmental Baseline Guidance Document. The Contractor shall propose use of the more protective standard for the FGS.

Chapter proposals outside OEBGD shall be determined by Navy prior to development by contractor.

• Proposed changes to the FGS to incorporate the new laws.

The Contractor shall refer to DODI 4715.5 Section 6.3 and consult with the Navy for further information on the requirements of the comparative analysis. The draft Comparative Analysis shall be delivered electronically by email within 45 calendar days from the issue of the task order requesting specific FGS chapter(s) being updated.

2. Draft FGS Chapter. The Contractor shall update each identified FGS chapter consistent with the conclusions of the Comparative Analysis (CA). The Contractor shall follow stylistic conventions established in CA’s and propose updates as required for tracking updates to identify non-OEBGD text (e.g., text related to Italian or EU regulations with italics and mark changes from the original document using Word’s track changes feature). The draft chapter shall be delivered electronically by email within 45 calendar days from the issue of the task order requesting specific FGS chapter(s) being updated.

3. The Contractor shall provide via email written responses to Navy comments on the Comparative Analyses within 15 calendar days from the receipt of Navy comments. After comment resolution, the Contractor shall update the Comparative Analysis consistent with the comment resolution and deliver the revised Comparative Analysis within 7 calendar days from the comment resolution. The revised Comparative Analysis will be submitted to the ECS-G for review.

4. The Contractor shall provide via email written responses to Navy comments on each draft FGS chapter within 15 calendar days from the receipt of Navy comments. After comment resolution, the Contractor shall update each draft FGS chapter consistent with comment resolution and deliver the revised FGS chapters within 7 calendar days from the comment resolution. The revised FGS chapters will be submitted to the ECS-G for review.

5. The Contractor shall provide via email written responses to ECS-G comments on the Comparative Analyses within 7 calendar days from the receipt of ECS-G comments. After comment resolution, the Contractor shall update the Comparative Analyses consistent with the comment resolution and deliver the revised Comparative Analysis within 7 calendar days from the comment resolution. The revised Comparative Analyses will be resubmitted to the ECS-G discussion at the next available meeting or conference call, assuming that this meeting or conference call is held within 7 calendar days from the submittal of the revised Comparative Analysis.

6. The Contractor shall provide written responses to ECS-G comments on each draft chapter within 7 calendar days from the receipt of ECS-G comments. After comment resolution, the Contractor shall update each draft chapter consistent with comment resolution and deliver the revised FGS chapters within 7 calendar days from the comment resolution. Each revised FGS chapter will be resubmitted to the ECS-G for discussion at the next available meeting or conference call, assuming that this meeting or conference call is held within 7 calendar days from the submittal of the revised FGS chapters.

7. The Contractor may be required to attend an ECS-G meeting or conference call to present and discuss comments on the revised Comparative Analyses and FGS chapters, as per above point 6. Eventual travel will be negotiated separately.

8. The Contractor shall prepare the final version of each Comparative Analysis and a draft final of each chapter consistent with comments accepted and resolved at the ECS-G meeting or conference call and follow on communications. These draft final documents will be submitted to NAVFAC EURSWA for approval within 7 calendar days from the meeting or conference call. The Contractor shall provide the documents to the Navy on CDs.

9. The Contractor shall prepare draft final chapters with updated headers and footers, and possibly minor text changes, for submittal to EUCOM/AFRICOM for final approval within 7 calendar days from the receipt of NAVFAC EURSWA approval. The Contractor shall provide the documents to the Navy on CDs. The Contractor shall incorporate other documents (e.g., cover letter) provided by the Navy on the CDs.

10. The Contractor shall prepare the final chapters with updated headers and footer within 7 calendar days from the receipt of EUCOM/AFRICOM approval. The Contractor shall provide final versions of the document in both Word and Acrobat pdf formats. Two versions shall be provided in Word: one shall include the italics text identifying all non-OEBGD language and shall include references to the legislation from which the text arises and will be called the “annotated version”; the other version will not identify the source of the text. The Contractor shall work with the existing “annotated” version to provide a comprehensive annotated version at task completion. The Contractor shall provide all versions of the documents to the Navy on CDs. The Contractor shall provide 5 CDs with the Acrobat version to each of the following: USAREUR, USAFE, and

DLA.

Item 03 – Monitoring and Analysis of Environmental Legislation/International Agreements and Initiatives

Background. U.S. Forces operating in Europe are subject to a variety of environmental requirements many of which stem directly from EU legislation that either is directly applicable in the EU member states or requires member states to enact legislation. These requirements can place restrictions on the ability of U.S. Forces to operate and maintain essential equipment.

Objective. The purpose of this work is to provide EUCOM/AFRICOM with information about developments in EU environmental policy and legislation (here termed ‘legislation’), including draft, adopted and published legislation as it progresses toward member state implementation. Information about existing legislation, which may not have been implemented in member states, will enable DoD Components operating in Europe to assess the impacts of the legislation and prepare for its implementation. Armed with information about proposed legislation and its potential impacts on the ability of U.S. Forces to operate and maintain equipment, EUCOM/AFRICOM can work with our EU-member/NATO allies and others to the ameliorate the impacts of proposed legislation on the ability of armed forces to operate and maintain essential equipment.

Item 031 – Summary Reports. Contractor shall summarize developments in relevant EU environmental legislation both items in progress and awaiting member state implementation. The Contractor shall provide summary reports quarterly. The target audience is the EUCOM/AFRICOM Environmental Principals Working Group (EPWG) and the EUCOM/AFRICOM Compliance Sub-Group (ECSG). The objective is to provide information on a broad range of potential EUCOM/AFRICOM environmental concerns, and to provide information to identify particular EUCOM/AFRICOM focus items. Each summary shall be approximately one paragraph in length, with each summary report expected to be in the order of 5-10 pages in length. The Government may comment on the reports and Government recommendations will be incorporated into successive reports.

Item 032 – Focus Items. Contractor shall provide quarterly reports on EUCOM/AFRICOM focus items to the EUCOM/AFRICOM Environmental Compliance Sub-Group (ECSG). The objective is to provide Components with information on legislation identified as a concern by the Government. The Contractor shall track as many as fifteen items. The Contractor shall present the status of each identified focus item in a one- to two-page summary describing the current content of the legislation/international agreement, dissenting and concurring opinions, upcoming opportunities to provide input to the legislative/international agreement development process, etc. The EPWG will identify which focus items to address. Examples of focus items include Natura 2000, EU environmental liability, sonar, noise, and ozone depleting substances. The Government may comment on the reports and Government recommendations will be incorporated into successive reports.

Item 033 – In-Depth Analysis. Contractor shall provide limited in-depth analysis of recent existing and proposed legislation. The scope and depth of each analysis will be determined using the following process. Proposed analyses will be discussed by EUCOM/AFRICOM and the Contractor at meeting or conference call which the Contractor attends. These discussions will assist EUCOM/AFRICOM in identifying items of policy and legislation for further analyses, assist in the scoping of each analysis, and provide the Contractor with further clarification regarding potential relevance to and impacts on DoD operations. The in-depth analysis will be limited to those aspects of the legislation most relevant to EUCOM/AFRICOM. Contractor shall respond to requests from EUCOM/AFRICOM for clarification on specific issues contained within the analyses, but such requests shall not require substantial rewrites or further in-depth analysis except as may be required to correct errors made by the Contractor. The Government may comment on the reports and Government recommendations will be incorporated into successive reports. Any required travel (for instance, to attend EUCOM/AFRICOM meetings) will be negotiated separately.

Item 034 - Briefings. The Contractor shall brief the EPWG and/or ECWG on work conducted and will provide an opportunity for questions and answers on items of interest. The duration of a briefing will be no more than 3 hours.

Travel will be negotiated separately.

Item 035 - Conference Presentation. The Contractor shall present a 1-hour presentation on EU legislation impacting military operations at the EUCOM/AFRICOM environmental conferences or workshops. Travel will be negotiated separately.
