Sewing Machines Preventative Maintenance Services (as of 09/08/2022)
Question 1: Subcontractors allowed this Contract?
Answer 1: This contract will be awarded as a Firm Fixed Price contract in support of the
Performance Work Statement (PWS) as listed in the solicitation. The use of a subcontractor in completion of the work will be up to you but I would note that since this is a small business set aside, the limitations on subcontracting applies. In accordance with FAR 19.505(b)(1)(i), "For a contract or order assigned a North American Industry Classification System (NAICS) code for services (except construction), the concern will not pay more than 50 percent of the amount paid by the Government for contract performance to subcontractors that are not similarly situated entities. Any work that a similarly situated entity further subcontracts will count towards the concern's 50 percent subcontract amount that cannot be exceeded."
According to SBA, the “small business prime contractor must provide at least 50% of the contract cost for personnel. The small business prime contractor can utilize similarly situated subcontractors to meet these performance requirements. A similarly situated subcontractor is a subcontractor that has the same required size and small business program status as the prime contractor."
