N104-AS-TURBOGEN
CLASS JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC), Norfolk, VA.
2. Description of the Action Being Approved: Award of contracts on a Brand Name /
Limited Source basis for Main Propulsion Steam Turbines, Main Reduction Gears, Ship Service Turbine Generators (SSTG) and Electrical Power Generation Equipment for Technical Service and Repair Parts in support of the AS-39 Class MSC vessels. The authority to act under this class justification will expire 15 July 2017.
3. Description of Supplies/Services: MSC requires parts and services to accomplish overhauls and repairs to the Main Propulsion Steam Turbines, Main Reduction Gears, Ship Service Turbine Generators (SSTG) and Electrical Power Generation Equipment installed aboard the AS-39 Class MSC Vessels. The actions executed under this class J&A have an estimated value of approximately $1,500,000 using M&R funding.
4. Statutory Authority Permitting Other than Full and Open Competition: The statutory authority permitting other than full and open competition for FAR subpart 13.5 requirements is 41 U.S.C. 1901. The statutory authority permitting other than full and open competition for FAR part 15 requirements is 10 USC. 2304(c)(l) as implemented by FAR Part 6.302-1, respectively
5. Rational Supporting Use of Authority Cited Above: There are currently two active
AS-39 Class Vessels in the MSC Fleet, each vessel has one HP and LP Main Propulsion Steam Turbine, one Main Reduction Gear, four Ship Service Turbine Generators and associated Electrical Power Generation Equipment. The Original Equipment Manufacturer (OEM) is SEIMENS DEMAG De Laval Turbomachinery for the Main Propulsion Turbines, Reduction Gears and Ship Service Turbine Generators. Proper refurbishment and maintenance of the Steam Turbines, Reduction Gears, Generators and Electrical Power Generation Equipment are critical to the safe operation of the AS-39 Class Vessels. The OEM Service Engineer shall have specialized knowledge and extensive experience of the Main Propulsion Turbines, Reduction Gears, Ships Service Turbine Generators and Electrical Power Generation Equipment onboard the AS-39 Class Vessels. The OEM parts and technical data/drawings from the OEM and qualified service technicians are required by USCG and ABS regulations. This maintains all OEM warranties, ensures reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
Safety Management Systems Number 10.6-002-ALL lists all Main Propulsion Turbines, Reduction Gears, Ship Service Turbine Generators and Electrical Power Generation Equipment as critical equipment. Failure of the Main Propulsion Turbines and Reduction Gears will result in a C-4 CASREP. Failure of one Ship service Turbine Generator will result in the loss of Electrical Power Generation capacity. The loss of two or more Ship

Service Turbine Generators puts a ship in a C-3 CASREP, thus reducing its ability to perform its primary mission of providing electrical power to submarines being tended alongside. The reduction of speed can also pose a hazard to the crew, due to limited ship maneuverability. Proper refurbishment and maintenance of main Propulsion Turbines, Reduction Gears, Ship Service Turbine Generators and Electrical Power Generation Equipment are critical to the safe operations of the AS-39 Class Vessels.
MSC did not purchase the proprietary technical data rights to this equipment when it was installed on the AS-39 Class Vessels. MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts.
The Main Propulsion Steam Turbines, Reduction Gear, Ships Service Turbine Generators (SSTG) and Electrical Power Generation Equipment installed aboard the AS-39 Class Vessels requires special tools, specialized repair parts, and technical expertise unique to these engines; only approved OEM parts are authorized to be installed on this highly sophisticated equipment. The OEM Representative has access to provide parts and technical data/drawings from the OEM, as required to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements.
6. Description of Effort Made to Solicit Offers from as Many Potential Sources as
Practicable: The Government intends to synopsize when required and to post request for quotations (RFQ) and request for proposals (RFP) at the Government Point of Entry, the Federal Business Opportunities (FBO) Website, for each separate procurement, with the intent of awarding a firm fixed price contract.
7. Determination of Fair and Reasonable Costs: The Contracting Officer will determine that the price for the supplies/services is fair and reasonable pursuant to FAR Part 13.106-3 or 15-404-1, as appropriate.
8. Actions to Remove Barriers to Future Competition: For the reasons set forth in paragraph 5, SEIMENS DEMAG De Laval Turbomachinery parts and services are required. Should MSC determine that SEIMENS DEMAG De Laval Turbomachinery parts and services are no longer required; this J&A will become null and void.
