QUESTIONS AND ANSWERS
The following are answers to questions received from potential offerors. The answers provide clarification only and DO NOT constitute an amendment to the solicitation.
1. There is a provision in this solicitation to requirement the winner to work on site at a government designated location. This vendor asks a three-part question. Would it be possible to utilize the government's cleared area for operations removing the requirement that the vendor has a cleared facility certification. We were forced to vacate an office in 2021 due to COVID and other issues and as a result have been unable to secure a clear facility clearance. There creates a slight chicken and egg scenario where until there is an immediate need for it you cannot be sponsored. We have exhausted many efforts with the SBA and other sources. With the remote nature of work today since exiting our former space we haven't found the need to have staff in office; similar to many government agencies today.
ANSWER - 1: Your first question is not clear. No, it is not possible to utilize the Government’s cleared area for operations.
No, it is not possible to remove the requirement that the vendor has to have a cleared facility certification.
2. The next part of the question, would it be possible to operate designated at the location of our teaming partner (one of the largest facilities management companies in the United States, who have been long-term partners with us and hold an FCL) which is allocation that has a cleared facility status?
ANSWER - 2: Please see Attachment 1 of the solicitation regarding FCL.
Please see FAR 19.5 regarding 8(A) Set Aside contracts. Also, see FAR Subpart 9.6 regarding “teaming arrangements.”
Teaming Partners may be able to sponsor a teaming partner for an FCL. FCL sponsoring, by another cleared Contractor can be a very lengthy process, and effect work requirements/contract timeline. MSC as the Government Contracting Authority (GCA)will not be sponsoring offerors for an FCL.
3. Or less optimally, can we bid subject to sponsorship by the department of defense for this requirement. There would be absolutely no problem meeting this requirement but at the moment we don't have it and it seems particularly and perhaps onerous in light of the government speed and willingness to handle a facility clearance at this time that this requirement exists with the options that we just presented. We have an existing 8(a) contract on a US Army base and have done extensive work for the FAA and FDA in the past. (End of three-part question).
ANSWER - 3: FCL is required at the time of submission of proposal.
4. Will the government sponsor a contractor to obtain a Secret FCL? If not, would a Joint Venture suffice this requirement if an individual member to the joint venture holds a Top Secret
FCL?
ANSWER - 4: MSC as the Government Contracting Authority (GCA)will not be sponsoring offerors for an FCL.
Please see the Government response in A2.
