About this file
This document is a Justification and Approval (J&A) for other than full and open competition for the award of a service order to Schottel, Inc., the original equipment manufacturer (OEM), for spare parts and completion of an overhaul of two forward and two stern thrusters on the USNS ZEUS (T-ARC 7).
The J&A states that Schottel, Inc. is the only responsible source that can provide the required OEM parts, technical data, and expertise to ensure the thrusters are compatible and reliable, as the USNS ZEUS is the only vessel with this thruster model installed. The parts are needed to support continued operations of the vessel, which is mission-essential to national security. The anticipated cost to the government is determined to be fair and reasonable. The government has no plans to allow non-OEM suppliers for these supplies at this time, but will assess the feasibility of future competition if another potential source emerges.

J&A No. N10424Q0265
JUSTIFICATION AND APPROVAL FOR
OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command Norfolk (MSC).
2. Description of Action Being Approved: Award of a service order on a sole source basis to the original equipment manufacturer (OEM), Schottel, INC. for required spare parts and completion of the overhaul started during USNS ZEUS ROH for two forward and two stern thrusters currently located at Schottel, INC. in Houma, LA. using other than full and open competition.
3. Description of Supplies/Services: Provide OEM parts for USNS ZEUS (T-ARC 7) two forward and two stern thruster lower gear boxes in support of recent overhaul item. Provide one set of overhaul parts and two spare gear sets. The estimated combined dollar value is , which will be funded utilizing fiscal year 2024 Navy working capital funds.
4. Statutory Authority Permitting Full and Open Competition: 10 U.S.C. 3204(a)(1) Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority: Schottel Inc is the original equipment manufacturer. USNS ZEUS (T-ARC 7) is currently the only vessel with this model thruster installed.
The vessel requires purchase of repair parts to support continued operations. The vessel requires these thrusters to keep the ship on station during ROV operations or ensuring accurate cable laying and repairs.
These operations make the vessel mission essential to the national security of the United States. Only Schottel INC has been able to provide exact parts, access to proprietary technical data and has the expertise to identify and provide direct replacement parts, which must be compatible in terms of form, fit, and function with existing equipment or configurations. This ensures equipment reliability. Deficient parts could cause system failure and loss of use of the thrusters. This item was unable to be completed during the last dry-docking because the parts could not be sourced within the ROH period of performance.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The sources sought for the proposed service order was posted on the sam.gov website on May 22, 2024, and closed May 29, 2024, with no responses. MSC perpetually seeks submissions from non-OEM contractors for consideration of qualification of their parts and/or services as an acceptable alternative to the OEM at https://www.msc.usff.navy.mil/Business-Opportunities/Contracts/Qualification-for-Items-Critical-to- Shipboard-Safety-on-MSC-Vessels/. The Government intends to post a sole source combined synopsis and solicitation notice along with this justification at the Government Point of Entry to award a firm-fixed-price purchase order.
7. Determination of Fair and Reasonable Cost: The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this J&A will be fair and reasonable IAW FAR 13.106-3(a).
8. Actions to Remove Barriers to Future Competition: For reasons set forth in paragraph 5, MSC has no plans at this time to allow for non-OEM suppliers in future contracts or purchase orders for the types of supplies covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible.
