About this file

This document is an amendment to a solicitation for the time charter of a logistics support vessel by the Military Sealift Command. The amendment provides answers to questions from potential offerors, edits the attachment list, and extends the offer due date to October 16, 2023 at 1400. The solicitation is for the time charter of one US flagged Jones Act compliant vessel to transport various types of cargo between Port Canaveral, Florida and the Atlantic Undersea Test and Evaluation Center on Andros Island in the Bahamas, with an estimated 40% of time spent in port and 60% at sea. Cargo will include occasional classified, hazardous, and inert materials. The set-aside is for small businesses. Fuel is available at Patrick Space Force Base but not Andros Island. The vessel is restricted to a maximum length of 220 feet and beam of 55 feet due to dock and channel limitations at Andros Island.

REQUEST FOR CLARIFICATION / QUESTIONS

SOLICITATION: N3220523R4218

Questions / Answers:

1. An offeror requests a face to face meeting with the contracting and procurement officers on the week of 25 September 2023 or the week of 02 October 2023.

In accordance with FAR 15.201(f), face-to-face meetings with potential offerors will not be entertained. All offerors are encouraged to make all information enquiry via electronic email communication. If necessary, a discussion session may be arranged with all offerors after evaluation of all submitted proposals.

2. If an offeror contracts another vessel operator to support the contract, what specific details will MSC require?

Offerors shall provide the technical and proposal information required in the Instruction to Offerors section of the solicitation.

3. Risk of Loss (j) - Is MSC open to a collaborative discussion to assure all insurance coverages provided by an offeror meet your needs?

No, offeror shall meet the insurance requirements required by the solicitation and provide the proposal information required in the Instruction to Offerors section of the solicitation. MSC will review all proposal documents based on the evaluation factors provided in the solicitation.

4. Will an offeror be privy to questions by other vendors?

Yes. All potential offeror’s questions and corresponding answers will be posted on SAM for the benefit of all potential offerors. The Government will work to limit the release of business sensitive information.

5. This is a 100% small business set aside. RFP page X-12 states that all offerors shall address the historical compliance with the requirements of FAR 52.219-8, Utilization of Small Business Concerns. Does this apply? Reference: page X-12, section Past Performance.

Yes. This provision applies to all offerors irrespective of business size.

6. RFP page X-12 offers definitions of recent and relevant past performance, however, does not provide any requirements for presentation of past performance. Please clarify whether Offerors are required to provide any recent/relevant experience under this proposal part, or if the Government's search of CPARS noted on page XI-2 is the only method of evaluation. Reference: page X-12 and XI-2, section Past Performance.

No, offerors are not required to provide recent relevant experiences. Part XI of the RFP provides information on the sources the Government will utilize in determining recent/relevant experience.

7. RFP page X-7 notes that each offer shall be clearly labeled, and complete with the following parts: Critical Submission Data; Business Proposal; Technical Proposal; Price Proposal; and Past Performance. Please clarify whether this shall be submitted as a single PDF file with each part bookmarked, or in 5 individual PDFs. Reference: page X-7.

Offerors have the discretion to provide all required information in whole or part in PDF format that expresses the information accurately and completely.

8. Referencing Block 10 - Confirming that Size Standard of 1,050 refers to the total number of employees for us to qualify for the Small Business Set Aside?

Yes, that is the correct size standard.

9. Of the gross volume of cargo to be transported, what percentage of the cargo carried is considered sensitive / classified or hazardous and what percentage is considered inert?

Historically, it is occasional based (about one in every 6 trips- with no guarantee) on projects and need, both for IMO class 1 cargo and classified cargo. The percentage considered inert varies.

10. Will the freight volumes be consistent weekly and monthly and is there seasonality where there are higher volumes that we should project for?

No, freight volumes will not be consistent weekly or monthly. Freight volumes and historical fluctuations were considered in setting the minimum technical characteristics. - At all times, vessels should be prepared to accommodate seasonality volumes.

11. Provided all classified/sensitive/hazardous cargo is transported from Port Canaveral directly to AUTEC, will MSC accept all other sustainment (not classified, not sensitive) cargo to be transported from an alternate port in Florida?

No.

12. Provided all sensitive/classified cargo is transported on US Flagged, Jones Act Vessels, will MSC accept a US corporation with foreign flagged vessels to transport any and all non-classified cargo? The US Corporation, foreign flagged vessel(s) are in full compliance with all applicable international conventions and all applicable laws, regulations, and other requirements of the nation of registry and of the nation(s) and local jurisdiction to whose port(s) and/or place(s) it is contemplated that the vessel with will order hereunder. Noted, all vessels operating under Centauri Transport’s control do so under US Coast Guard authority and approvals.

No, vessel requirement is for a US Flagged, Jones Act Vessel.

13. In the event MSC accepts the use of US Corporation’s foreign flagged vessels, all crew members as articulated on page III-2 on the non-US-flagged vessels will meet and comply with all US Customs, US Coast Guard and International Regulatory requirements and will be conversant in English and in possession of valid and current certificates, licenses and documents.

See response to 12 above.

14. Risk of Loss (j) 2 – Containers – is there specific liability MSC is asking us to assume by designating as “deemed shipped under deck”?

The contractor should follow the requirements and limitations as outlined in the PART II(j) Risk of Loss as it pertains to COGSA.

15. Does MSC take into consideration the value of vessels which are capable of operating in much higher seas than a tug and barge and at no less than twice the speed of a normal tug and barge operator?

No. Please see Part XI for the criteria for evaluation of proposals and award selection criteria.

16. For the sustaining non-classified cargo, will MSC entertain intermittent deliveries of partial loads throughout the course of the week in addition to dedicated scheduled vessels or as an alternative to?

Requirement is for the time charter of one vessel: vessel schedule and cargo loads will be as directed by the Charterer.

17. Page III-3 under Cargo Receipt, MSC implies that it will take full responsibility for cargo processing and related documentation to include manifest and/or bills of lading. Will MSC accept an alternative cargo processing/receiving warehousing, and documentation production for all non-classified/non-sensitive/hazardous cargo? We operate a fully compliant (US Coast Guard, US Customs, EPA, etc) shipping terminal, which is also US Customs bonded in Miami, FL and would like to make that facility available as an alternative for all non- classified / non- sensitive / hazardous cargo.

18. Page III-4, Item 5, 6, 7 and Page IV-9 Item (f) Dry Dock– Will MSC consider utilizing a private company’s cargo terminal for cargo services?

19. Page IV-26 (ad) Does MSC anticipate the ability to provide advance notice of any boarding which may require overnight, onboard accommodations?

Vessel shall have the ability to take-on required supercargo, as outlined in solicitation.

No. However, the Government has the discretion to authorize the vessel to remain pier side at AUTEC and, or Patrick Space Force Base beyond loading / unloading periods.

22. Please provide historic cargo data to evaluate estimated duration and person hours required for loading / unloading operations.

Op tempo in RFP is estimated to be 40% in port and 60% at sea.

23. What stevedore or port service options are provided by charterers?

The Government is responsible for loading and unloading of cargo.

24. Please provide the expected operational tempo of this charter between load and discharge port.

The question is not clearly stated to respond adequately: If it is asking for the time in port to load and discharge, the average time is between one to three days in AUTEC and Patrick SFB.

25. Please provide the historic port call information, e.g. frequency and location in the past 24 months?

There is no historic port call information available.

26. PWS E-1.E states “all docking and undocking assistance costs are for the owners account”. Please provide the estimated costs the awarded contractor should expect to pay or provide the POC’s contact information for these services.

MSC will not provide estimated costs of any docking or undocking assistance required for, and arranged by a potential offeror.

27. PWS E1.D states “due to dock length and channel composition for Andros Island, the AUTEC facility vessel cannot exceed 220 feet in length or 55 feet in beam.” is the 220 feet the max length of the tug and the barge individually, or the max combined length of tug/barge if one were to offer a tug/barge combination.

The max length of the dock and channel composition shall not exceed 220 feet in lenth or 55 feet in beam for any one individual tug or barge, nor shall any combination of a tug/barge exceed 220 feet in length or 55 feet in beam.

Terminal regulations are not available for distribution by MSC at this time.

31. Is fuel available at AUTEC OR PATRICK SPACE FORCE?

Fuel is available at Patrick SFB.

32. Please confirm the use of USMMA Cadets as crew members and/or passengers will not be a part of this contract as indicated by the lack of a box check at the beginning of the section. Reference: page IV-17, section (5).

Confirmed, USMMA Cadets will not be crew members or passengers for this contract.

33. Please confirm that a Magnetic Compass and a Satellite Compass are acceptable compass configurations in lieu of a Gyro Compass. Reference: page V-9, PDF 95 / section (t) NAVIGATIONAL EQUIPMENT.

Yes. If navigational equipment meets USCG requirements and COI.

34. Please confirm that only the Vessel is required to be in the VISA program and not the Offeror. Reference:

page XI-1, PDF 160, section PART XI. FAR 52.212-2 EVALUATION.

Negative. Please review the provisions of 79 Federal Register 64462-64470, Sec. III.A.3. of VISA.

35. Please confirm that gaining/maintaining crew and vessel clearance for port (FCL) is comprised of submitting for approval and receiving approval based upon SECNAV Form 5512/1. Reference: section E- 1.q. Classified Materials/Security.

This question is not clearly stated to respond adequately: A Facility Clearance (FLC) relates to ability to hold and manage security clearances, which is not related to the Base Access Pass registration form cited in the question. Contractors shall ensure both crew and shore-based facilities meet the requirement necessary for the specified personnel to hold appropriate clearance.

36. We were unable to locate Attachment IX(C) in the proposal documents. Will MSC please support with location/provision of this Attachment?

No. It is reserved and not applicable to this RFP.
