Military Sealift Command Combined Synopsis and Solicitation Notice Information
1. This is a combined synopsis/solicitation for commercial products and commercial services prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; quotations are being requested and a written solicitation will not be issued.
2. Solicitation number is N3220523Q4105 and is being issued as a Request for Quotes (RFQ).
3. The solicitation document and incorporated provisions and clauses are those in effect through:

6. The Government intends on awarding an Indefinite-Delivery, Indefinite-Quantity (IDIQ) Multiple Award
Contract (MAC) with Firm-Fixed Price (FFP) task orders (TO) to no more than five (5) awardees. Under this type of contract, no work may be performed until directed by a TO.
7. This IDIQ Contract is for a five (5) year ordering period upon award. The anticipated period of performance for the base contract will be 3 November 2023 – 02 November 2028. The period of performance will be identified at the TO level and deliverables shall be identified by each individual TO.
8. The provision at FAR 52.212-1, Instructions to Quoters – Commercial (Deviation 2018-O0018) applies to this acquisition and is incorporated by reference. The provision is amended as follows:

Any inconsistency between FAR Provision 52.212-1 and the Addendum to FAR 52.212-1 shall be solved by giving precedence to the Addendum to FAR 52.212-1.

The Government intends to solicit and award on an unrestricted basis utilizing commercial procedures under FAR 13.5, Simplified Procedures for Certain Commercial Products and Commercial Services.
1.) Responses to the solicitation are due 18 October 2023 no later than 12:00 P.M. Eastern Standard Time
(EST) Norfolk, Virginia. Only electronic submissions shall be accepted. Quotes shall be e-mailed to Jenna Donley at jenna.n.donley.civ@us.navy.mil, Faith Ayana at faith.r.ayana.civ@us.navy.mil and Susan Moomaw at susan.h.moomaw.civ@us.navy.mil. To be considered timely, an e-mail quote must be received in its entirety in the designated e-mail inboxes by the due date and time for quote submission. Quotes received after the due date and time will be deemed late. The contracting officer, may, in their sole discretion, consider late quotes for award if considering the late quote is in the best interest of the Government. Submissions shall not contain any classified material. It is the sole-responsibility of the quoter to ensure that the files submitted are virus free and can be opened and read by the Government. Quotes shall remain valid for at least 60 days after issuance.
2.) Quoter(s) should address all questions or concerns to the Contract Specialists, Jenna Donley at jenna.n.donley.civ@us.navy.mil and Faith Ayana at faith.r.ayana.civ@us.navy.mil and Contracting Officer, Susan Moomaw at susan.h.moomaw.civ@us.navy.mil. All questions shall be received no later than five (5) calendar days after issuance of the solicitation. Quoters are cautioned that any questions received after this deadline may not receive a response.
3.) Submission of Quotation in addition to FAR 52.212-1, Instructions to Quoters - Commercial Products and
Commercial Services, the following information is provided:
A. The submission of the documentation specified below will constitute the quoter’s acceptance of the terms and conditions of the RFQ and concurrence with the contract type. . Quoters are encouraged to submit their best technical quote in their submission. In order to be eligible for award, Quoters are required to meet all solicitation requirements, such as terms and conditions, evaluation factor requirements, and be deemed responsible in accordance with FAR Part 9.Failure to meet a requirement may result in a quoter being ineligible for award. If the quoter finds it necessary to take exception to any of the requirements specified in this solicitation, the quoter shall clearly identify the applicable Volume and exceptions with a complete explanation of why the exception was taken, what benefit accrues to the Government (if any), and its impact, if any, on the performance, schedule, cost, and specific requirements of the solicitation. Each exception shall be specifically related to each paragraph and/or specific part of the solicitation to which the exception is taken. Quoters are cautioned that taking an exception may render the quote ineligible for award. It is recommended that the quoter contact the Contracting Officer immediately prior to solicitation closing, upon identifying an area that may result in an exception.
B. Quote Format outlined in Section C below prescribes the format for the quote and describes the approach for the development and presentation of quote data. These instructions are designed to ensure the submission of information needed to allow for evaluation of quotes. If a quoter believes that the requirements in these instructions contain an error, an ambiguity, omission, or are otherwise deemed unsound, the quoter shall immediately notify the Contract Specialist in writing with the supporting rationale. The quoter is reminded that the Government reserves the right to award this effort based on the initial quotes, as received, without discussion. All referenced documents for this solicitation are available on the website at https://www.sam.gov. Potential quoters are encouraged to subscribe for real-time email notifications when information has been posted to the website for this solicitation.
C. Quote Format: Quotes shall consist of three (3) separate volumes: General (Volume I), Technical (Volume II), and Past Performance (Volume III). Each volume’s content is outlined below. The table below shows detailed page limits for submissions:

a. General (Volume I) –
i. Quoter shall provide an executive summary that introduces the Contractor’s team and quote submission. In addition, a statement of persons authorized to negotiate and sign on the quoter’s behalf with the Government in connection with this solicitation.
ii. Quoter shall provide any exceptions, deviations, and/or any assumptions used in the quote preparation.
iii. Subcontracting Plan. In accordance with FAR Clause 52.219-9 and 52.219-9 Alt II.
Quoters that are large businesses shall ensure that they submit a Small Business Subcontracting Plan with all of the information required.

v. Technical Non-Disclosure Agreement. The quoter shall ensure that the required fields within the Attachment III Technical Non-Disclosure Agreement are completed.
vi. Quoters shall address Organizational Conflict of Interest (OCI) as an attachment to their quote in accordance with FAR Part 9.5. If an Offeror determines that a potential or real OCI issue exists and still wishes to proceed through the request for quote process, the Offeror shall notify the contracting officer prior to submission of the quote to determine the need for an OCI Remediation Plan specific to the requirement.
b. Technical (Volume II) - The technical volume contains two (2) subfactors and will be the basis for assessing the quoter’s ability to understand the scope of service, support, and parts for Self-Contained Breathing Apparatus (SCBA) systems described in the solicitation. FAR Provision 52.212-2 of the solicitation outlines the evaluation criteria for evaluating the technical submission. The technical volume shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims in the quoter’s submission. Legibility, clarity, and coherence are very important. The quote should not simply rephrase or restate the Government’s requirements, but rather shall provide convincing rationale to address how the quoter intends to meet the requirements. Statements that the quoter understands, can, or will comply with the requirements;
statements paraphrasing the requirements or parts thereof; and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will be considered unacceptable. Quoters shall assume that the Government has no prior knowledge of its facilities and experience, and will base its evaluation on the information presented in the quoter’s submission. Elaborate brochures or documentation, binding, detailed artwork, or other embellishments are unnecessary and are not desired.
i. Subfactor 1 –Certification: The Quoter shall provide proof of required ABS Certification as detailed in Section 5.1 of the Performance Work Statement (PWS).
The Quoter shall provide proof of current Requalification Identification Number (RIN) issued by the Department of Transportation Pipeline and Hazardous Materials Safety Administration (DOT PHMSA) as detailed in Section 5.3 of the PWS.
ii. Subfactor 2 – Technical Approach: The Quoter shall provide a precise narrative that explains their understanding of the requirements and ability to provide all required parts and services, both routine and emergency, as it relates to ABS standards and maritime service requirements as detailed in the PWS. The approach shall explain the strategy for obtaining and maintaining certified technicians as required in the PWS, in particular, those with ABS and maritime experience.
c. Past Performance (Volume III) - The past performance evaluation will be accomplished by reviewing aspects of a quoter’s recent and relevant past performance. Quoters may provide information for up to three (3) previous Government contracts whose effort is/was recent and relevant to the effort required by this solicitation.
i. “Recent” is defined as a contract in-progress and at least 50% complete or completed within the last three (3) years. If the quoter has not had three (3) Government contracts within the last three (3) years, information on recent and relevant subcontracts and/or commercial contracts may be submitted.
ii. “Relevant” is defined as a contract or multiple simultaneous contracts cumulatively combined that is of similar scope, magnitude, and complexity to the requirements as set forth in this solicitation. Scope, Magnitude and Complexity are defined below:
• Scope: Experience in the areas defined in the PWS.
• Magnitude: The measure of similarity of the volume of orders, dollar value, and/or duration of work actually performed under the quoter’s submitted contracts to this acquisition.
• Complexity: The measure of the similarity of technical difficulty, managerial intricacy, and/or required coordination of efforts and disciplines performed by the quoter in its submitted contracts to this acquisition. For complexity, not only will the tasks performed by the quoter be considered, but also the quoter’s ability to coordinate tasks (e.g., concurrent performance requirements).
iii. A Past Performance Data Sheet (Attachment IV) shall be submitted for each contract to be considered as past performance. Quoters shall provide a detailed explanation demonstrating the similarity of the contracts to the requirements of this solicitation; a detailed description of the work performed for the contract; and the role performed, including whether the quoter acted as a prime contractor or a subcontractor. Quoters are responsible for the accuracy of all data provided. Past performance information regarding predecessor companies, key personnel who have relevant experience and subcontractors that will perform major or critical aspects of the requirement may be provided as past performance submissions.
iv. Utilization of Small Business Concerns: All Quoters shall address historical compliance with the requirements of FAR 52.219-8 (Utilization of Small Business Concerns) in the Performance Data Sheet.
9. The provision at FAR 52.212-2 Evaluation – Commercial Products and Commercial Services applies to this acquisition. The provision is amended as follows:
52.212-2 (ADDENDUM) EVALUATION- COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES
Any inconsistency between FAR Provision 52.212-2 and the Addendum to FAR 52.212-2 shall be solved by giving precedence to the Addendum to FAR 52.212-2.
EVALUATION CRITERIA:
1.) Basis for Award. The Government will award a maximum of five (5) contracts to the technically acceptable Quoter(s), with acceptable past performance and an acceptable Small Business Subcontracting Plan or Commercial Plan (if applicable, see 52.212-1 Addendum, Volume 1, item iii).
The Government reserves the right to award to fewer than five (5) Quoters. In accordance with FAR 13.106-1(a)(2)(iv)(A), price may be excluded as an evaluation factor. Accordingly, the Government intends to make award to all qualifying quoters. Price will be one (1) of the factors in the selection decision for each task or delivery order under the multiple-award contract, in accordance with FAR 16.505(b)(1)(ii)(E).
2.) The Government will determine award by evaluating the following criteria:
Factor 1 – Technical Subfactor 1 – Certification Subfactor 2 – Technical Approach Factor 2 – Past Performance
3.) The Government will review the information required by the RFQ to determine whether the Quoter has met the minimum submission requirements.
4.) The Government intends to award without discussions. Pursuant to FAR 52.215-1(3)(A), however, the Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.
5.) For large businesses, the Government will evaluate the Small Business Subcontracting Plan in accordance with FAR 52.219-9. Failure to submit and negotiate a subcontracting plan acceptable to the Contacting
Officer will make the Quoter ineligible for award of a contract. All personnel and subcontracting personnel needs to be qualified at all times when it comes the requirements set forth in the PWS.
6.) An overall rating will be assigned to each of the factors as a result of the source selection evaluation. All factors will be rated on an acceptable or unacceptable basis. If any factor or subfactor is deemed unacceptable, the entire quote will be deemed unacceptable. Award will not be made to any Quoter whose quote is deemed technically unacceptable.
A. FACTOR I: TECHNICAL
Quotes will be evaluated to determine if the Quoter meets all of the minimum requirements detailed in the solicitation. Technical tradeoffs will not be made and no additional credit will be given for exceeding the minimum requirements of the solicitation. The technical factor consists of two (2) subfactors as listed below.
SUBFACTOR 1 – Certification
To be rated technically acceptable, the Quoter shall provide proof of required ABS Certification as detailed in Section 5 of the PWS, and the Quoter shall provide proof of current RIN issued by the DOT PHMSA as detailed in Section 5.3 of the PWS.
SUBFACTOR 2 – Technical Approach
To be rated technically acceptable, the Quoter shall provide a precise narrative that explains their understanding of the requirements and ability to provide all required parts and services, both routine and emergency, as it relates to ABS standards and maritime service requirements as detailed in the PWS. The Quoter also detailed its strategy for obtaining and maintaining licensed technicians as required in Section 5 of the PWS.

B. FACTOR II: PAST PERFORMANCE
The past performance evaluation will assess the Quoter's probability of meeting the solicitation requirements. To develop an overall rating, the Government's evaluation will take into account relevant information submitted by each Quoter as part of its quote and the Government's assessment and evaluation of other sources of information. Other sources of information for past performance may include, but are not limited to, Contractor Performance Appraisal Reporting System (CPARS), the Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Report System (ESRS), other databases, questionnaires and interviews.
The Government will consider the recency and relevancy of past performance information compared to the requirements detailed in the PWS, the source of the information, the context of the data and general trends in the Quoter's performance and any associated risk.
The Government will consider the extent of the Quoter's ability to perform a previous contract successfully in the areas of;
(a) Quality of product or services;
(b) Timeliness or scheduling of supplies/deliveries;
(c) Business relations/customer satisfaction; and
(d) Personnel and staffing (including subcontractors).
The Government will consider the company itself, predecessor companies, personnel who have relevant experience and subcontractors who will perform major or critical aspects of the requirement.
For all Quoters, the Government will consider historical compliance with the requirements of FAR Part 52.219-8 (Utilization of Small Business Concerns).
Past performance will be rated on an "acceptable" or "unacceptable" basis using the ratings outlined below:
Adjectival Rating Description
Acceptable Based on the quoter's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown. (See note below)
Unacceptable Based on the quoter's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
NOTE: In the case of a Quoter without a record of recent/relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Quoter may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the Quoter shall be determined to have unknown (or "neutral") past performance.
In the context of acceptability/unacceptability, a neutral rating shall be considered "acceptable".
10. A written notice of award or acceptance of a quote, mailed or otherwise furnished to the successful Quoter within the time for acceptance specified in the quote, shall result in a binding contract without further action by either party. Before the quote’s specified expiration time, the Government may accept a quote (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
11. All Quoters’ must include a completed copy of FAR 52.212-3, Quoter Representations and Certifications – Commercial Products and Commercial Services with its offer. FAR 52.212-3 Alt I applies also.12.
12. A small business joint venture Quoter must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.212-3, Quoter Representations and Certifications-Commercial Products and Commercial Services, and paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with 52.204-8(d) and 52.212-3(b) for the following categories:
(A) Small business;
(B) Service-disabled veteran-owned small business;
(C) Women-owned small business (WOSB) under the WOSB Program;
(D) Economically disadvantaged women-owned small business under the WOSB Program; or
(E) Historically underutilized business zone small business.
13. Clause 52.212-4 Contract Terms and Conditions – Commercial Products and Commercial Services, applies to this acquisition.
14. Clause 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders—
Commercial Products and Commercial Services (Jun 2023), applies to this acquisition along with the following FAR and DFARS provisions and clauses cited in Attachment II – Provisions and Clauses.
