JUSTIFICATION AND APPROVAL FOR USE OF OTHER THAN FULL
AND OPEN COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC).
2. Description of the Action Being Approved: This is a justification for work to be provided under Work Items (WIs), 107, 201, 202, 211, 451, 452, 453, 454, 455, 459, 505, 506, 509, 516, 524, 562, 563, 630, 651, 653 and 656 of the Statement of Work (SOW) for the Mid-Term Availability (MTA) of the USNS LEROY GRUMMAN (T-AO 195) under Request For Proposal (RFP) N3220519R4015. This Justification is covering only the portion of the acquisition, which an Original Equipment Manufacturer (OEM) Authorized Facility/Manufacturer/Representative is required and the approval level requirements will then only apply to that portion.
3. Description of Supplies/Services: MSC requires OEM authorized technical field service representatives and OEM parts to accomplish the requirements of WIs 107, 201, 202, 211, 451, 452, 453, 454, 455, 459, 505, 506, 509, 516, 524, 562, 563, 630, 651, 653, and 656. These WIs require the provision of highly skilled, specialized, unique services and associated OEM replacement parts. The estimated dollar value of the twenty-two (21) WIs is which will be funded utilizing FY 20 Navy Working Capital Funds (NWCF).
4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304
(c)(1), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, as implemented by FAR 6.302-1(a).
5. Rationale Justifying Use of Cited Authority: The use of required OEM authorized field technical service representatives and OEM parts is necessary for mission essential purposes. The required OEM authorized field technical service representatives and OEM parts maintain mission critical ship equipment and systems, the failure of which could have serious consequences for deployed military forces and the crew on the vessel during deployments. Further, the required OEM authorized field technical service representatives and OEM parts are necessary to achieve the highest possible reliability, readiness and effectiveness required by MSC for the T-AO class of vessels. Use of required OEM authorized field technical service representatives and OEM parts also maintains all OEM warranties and ensures equipment reliability, crew safety and applicable American Bureau of Shipping (ABS) and United States Coast Guard (USCG) certifications.
a. WI 107, Evaporator Deck Steel Replacement
The OEM for the vessel’s Evaporator is Alfa-Laval Industries. Alfa-Laval Industries and its OEM authorized vendors provide service to their equipment. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company. The Evaporator provides potable water for ship’s company to drink, and feeds water for boilers to convert to steam. Potable water is necessary for hotel service and feeds water for steam necessary for main engine operation.
SMS number 10.6-002-01-AO lists the Evaporator as critical equipment. Failure of the Evaporator will severely impede the ship’s ability to live on board ship and to lite off main engines. Failure of the main engine would affect the operation of the main propulsion system, which will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the main engine is critical to the safe operations of the USNS LEROY GRUMMAN (T-AO 195).
b. WI 201, Port and Starboard Main Engine Repairs
The OEM for the main engine is Fairbanks Morse Engine (FME). FME is the OEM and the only supplier of repair parts and service for their equipment. Proper refurbishment and maintenance of the main engine is critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195). This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
Safety Management Systems (SMS) number 10.6-002-01-AO lists the main propulsion engines as critical equipment. Failure of the main engine would affect the operation of the main propulsion system, which will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the main engine is critical to the safe operations of the USNS LEROY GRUMMAN (T-AO 195).
c. WI 202, Port Power Take Off (PTO) Coupling Seal Replacement
The OEM for the PTO Coupling is Geislinger Corporation. Geislinger and OEM Authorized Technical Representative provides OEM parts and services that are required for all couplings onboard T-AO class ships. Proper refurbishment and maintenance of the PTO Clutch is critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195). Failure to maintain the PTO coupling/clutch could result in the loss of back-up propulsion.
SMS number 10.6-002-01-AO lists the main propulsion engines as critical equipment. The Clutch Assembly system is an integral part of both the Ship’s Generator System and Propulsion Motor Shafting arrangement. Any failure of this system will severely impede the ship’s ability to generate electricity or provide auxiliary propulsion or complete mission requirements. Proper refurbishment and maintenance of this system is critical to the safe operations of the USNS
LEROY GRUMMAN (T-AO 195).
d. WI 211, Reduction Gear Inspection
The OEM for the reduction gear is CST-Cincinnati. CST-Cincinnati is the only authorized supplier of its repair parts, and the only vendor authorized to service its equipment. Reduction gears are equipment in the propulsion plant of the vessel. Proper inspection of the reduction gears is critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195). Only the OEM can provide the parts and has access to the proprietary technical data/drawings required needed. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Main Propulsion Engines as critical equipment. Failure of the Main Propulsion System will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the Main Propulsion Engines is critical to the safe operations of the USNS LEROY GRUMMAN (T-AO 195).
e. WI 451, WI 452, Annual Radar-Electronic Chard Display and Information System(ECDIS) Maintenance
The OEM for the vessel’s Radar and ECDIS are FURUNO and TRANSAS, respectively.
FURUNO and TRANSAS have numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a certificate of approved training for the FURUNO Radars and TRANSAS units that are installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The Radar and ECDIS are intricate components within the Bridge Navigation equipment. Failure of the Radar and ECDIS will severely impede the ship’s ability to safely navigate and identify other vessels operating in/around the vessel. Proper refurbishment and maintenance of the Radar and ECDIS are critical to the safe navigation and operations of the USNS LEROY GRUMMAN (T-
AO 195).
f. WI 453, NAVIGAT X Gyro Maintenance
The OEM for the vessel’s new NAVIGAT Gyro Compass repeater system is Northrop Grumman Systems Corp - Sperry Marine Division (NGSC-SMD). NGSC-SMD has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a certificate of approved training for the FURUNO FS-5000 GMDSS Console unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors.
This maintains all OEM warranties, ensures equipment reliability, and crew safety therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Gyro Compass as critical equipment. Failure of the Gyro Compass will severely impede the ship’s ability to navigate and maneuver the vessel. The reduction of the ability to navigate and maneuver the vessel will also pose a hazard to the crew and the vessel. Proper replacement and maintenance of the Gyro Compass and Steering Stand are critical to the safe operations of the USNS LEROY GRUMMAN (T-AO 195).
g. WI 454, Annual Ship Voyage Data Recorder (SVDR) Recertification
The OEM for the vessel’s SVDR is Japan Radio Company, Ltd (JRC). JRC has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a certificate of approved training for the JRC-JCY-1700S unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the SVDR is part of the vessel’s Safety Radio Certificate, as required by ABS. The SVDR is a USCG and ABS required system that is integrated into the Radar and ECDIS systems to records ship movements. Service of the SVDR must be accomplished by USCG/ABS approved and
OEM trained vendors. Proper refurbishment and maintenance of the SVDR is critical to the safe navigation and operations of the USNS LEROY GRUMMAN (T-AO 195).
h. WI 455, Annual Radio Communication Equipment (includes GMDSS, Furuno)
The OEM for the vessel’s radio communication equipment, including GMDSS is FURUNO.
FURUNO has numerous authorized vendors to provide service to their equipment. Vendor is required to provide documentation with a certificate of approved training for the FURUNO FS- 5000 GMDSS Console unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment, and the GMDSS is required by ABS and USCG. Service of the GMDSS must be accomplished by USCG/ABS-approved and OEM-trained vendors. Proper refurbishment and maintenance of the GMDSS is critical to the safe navigation and operations of the USNS LEROY Grumman (T-AO 195).
i. WI 459, Doppler Speed Log Preventative Maintenance
The OEM for the vessel’s Doppler Speed Log is Furuno. Furuno has multiple authorized vendors who can provide parts and/or technical representative services. Vendors are required to provide documentation with a certificate of approved training from Furuno for the DS-80 unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-01-AO lists the Navigational Equipment as critical equipment. The Doppler Speed log is an intricate component, identifying the ship’s speed when navigating.
Failure of the Doppler Speed log will severely impede the ship’s ability to safely navigate and degrade mission capabilities. Proper refurbishment and maintenance of the Doppler Speed Log is critical to the safe navigation and operations of the USNS LEROY GRUMMAN (T-AO 195).

WI 505/506, Boiler 1, 2 Overhaul
The OEM for the vessel’s Auxiliary Boilers is Clayton Industries. Clayton Industries is the only authorized vendor to provide service to their equipment. Clayton Industries is also the only authorized supplier of its parts; and also holds all associated proprietary technical data/drawings needed. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company. Boilers provide hotel steam to the living quarters and heating for main engine sumps.
SMS number 10.6-002-01-AO lists the Auxiliary Boiler as critical equipment. Failure of the boiler will severely impede the ship’s ability to lite off main engines. Failure of the main engine would affect the operation of the main propulsion system, which will severely impede the ship’s ability to get underway and complete mission requirements. Proper refurbishment and maintenance of the main engine is critical to the safe operations of the USNS LEROY
GRUMMAN (T-AO 195).
k. WI 509 Incinerator Annual
The OEM for the vessel’s Incinerator is ATLAS Incinerators A/S. ATLAS Incinerators A/S has numerous authorized vendors to provide services to their equipment. Vendor is required to provide documentation with a certificate of approved training for the ATLAS ASWI-402-AS unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.
l. WI 516, Aqueous Film-Forming Foam (AFFF) Skid Replacement T-ALT 0937
The OEM for the vessel’s AFFF is ANSUL. Only OEM-authorized suppliers of ANSUL approved repair parts and authorized ANSUL technical representatives can provide services for its equipment. Proper installation and testing of new system under approval T-ALT 0937 is critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195) as required by USCG and ABS regulations. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the AFFF foam system as critical equipment. Proper operation of system is a safety requirement for the vessel to get underway for vessel operations. The inability to use major safety and lifesaving equipment poses a hazard to the crew and the safe operations of the USNS LEROY GRUMMAN (T-AO 195).
m. WI 524 Engine Room and Cargo Oil Content Monitors (OCM) Certification
The OEM for the vessel’s Engine Room OCM is Deckma and Cargo OCM is VAF System, respectively. There are numerous authorized vendors to provide services to their equipment.
Vendor is required to provide documentation with a certificate of approved training for the OCM unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings are only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.
n. WI 562, Annual SCBA (Self-Contained Breathing Apparatus) Equipment Servicing
The OEM for the vessel’s SCBA equipment is Interspiro. There are several companies who are OEM representatives and authorized vendor/suppliers for approved repair parts and service for their equipment. Proper refurbishment and maintenance of the SCBA Equipment is critical to the safe operation and firefighting capabilities of the USNS LEROY GRUMMAN (T-AO 195).
Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
MSC does not have the manufacturing and technical information required to evaluate and determine whether non-OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. The work items listed in this section require special tools, specialized repair parts, and technical expertise unique to this equipment; only approved
OEM parts are authorized to be installed on this highly sophisticated equipment. Further, OEMs are required to perform service work for MSC vessel critical systems and equipment. The OEM Representative has access to provide parts and technical data / drawings from the OEM, as required to properly repair and maintain the equipment. All OEM repair parts are in compliance with USCG and ABS IMO regulatory requirements.
o. WI 563 SCBA Air Compressor & Fill Station
The OEM for the vessel’s SCBA Compressor is MAKO Model 9400E3 Compressor and Fill Station Model 3100has numerous authorized vendors to provide services to their equipment.
Vendor is required to provide documentation with a certificate of approved training for the MAKO Model 9400E3 unit that is installed. Factory authorized suppliers provide parts and proprietary technical data/drawings only available from the original manufacturer’s authorized vendors. This maintains all OEM warranties, ensures equipment reliability, and crew safety, therefore precluding consideration of a product manufactured by another company.
p. WI 630, Install Duct Split-Air Conditioning System T-ALT 0916
The T-ALT 0916 was developed and drawings approved by American Bureau of Shipping (ABS). MSC Drawing 320-8497257, T-AO 187 Class Split A/C System Installation Electrical System Modifications list in the Bill Of Material parts required for WI. MSC based of Form, Fit and Function has installed the same material on other T-AO 187, 188, 194, 196, 198, 203 and
204. Installation of New AC units will improve the quality of life for the Mariners for the Persian Gulf deployment. Currently the Grumman will be deploying to Persian Gulf after MTA.
Proper installation and testing of new system under approval T-ALT 0916 is critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195) as required by USCG and ABS regulations.
q. WI 651, Annual Lifeboat and Davit Inspection
The OEM for the vessel’s Lifeboat Winches and Davit is Palfinger. Palfinger is the only vendor authorized to supply its approved repair parts and services for its equipment. Proper refurbishment and maintenance of Lifeboat Winches and Davits are critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195) as required by USCG and ABS regulations.
This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
SMS number 10.6-002-ALL lists the Lifeboats as critical equipment. Proper operation of the Lifeboat Winches is a safety requirement for the vessel to get underway for vessel operations.
The inability to use major safety and lifesaving equipment poses a hazard to the crew. Proper refurbishment and maintenance of the Lifeboat Winches is critical to the safe operations of the

s. WI 653, Annual Port Rigid Hull Inflatable Boat (RHIB) Davit and Winch Inspection (Allied)
The OEM for the vessel’s Port RHIB Boat Davit is Allied Technical Services (Allied). Only authorized Allied part distributors and authorized service technical representatives are authorized to provide Allied approved repair parts and services for its equipment. Proper refurbishment and maintenance of the Port Rescue Boat Davits is critical to the safe operation of the USNS LEROY GRUMMAN (T-AO 195). Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS regulations. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.

u. WI 656, Annual Liferafts Certification
The OEM for the vessel’s Liferafts are Elliot / Vikings. Several companies are OEM representatives and authorized vendors/suppliers for approved repair parts and servicing of their equipment. Proper refurbishment and maintenance of the Liferafts is critical to the safe operation capabilities of the USNS LEROY GRUMMAN (T-AO 195). Factory authorized suppliers provide parts and technical data/drawings from the original manufacturer as required by USCG, SOLAS and ABS regulations. This maintains all OEM warranties and ensures equipment reliability and crew safety, therefore precluding consideration of a product manufactured by another company.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable:
The Government intends to post a synopsis and a Request for Proposal (RFP) at the Government Point of Entry, FedBizOpps website, with the intent of awarding a firm-fixed-price contract. Any prospective contractor will be required to use the OEM or OEM authorized vendor(s) as a subcontractor to perform the work in the aforementioned WIs.
7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR Part 15.
8. Market Research: The USNS LEROY GRUMMAN (T-AO 195) is home ported on the East
Coast and therefore considered an East Coast asset. All non-emergent vessel repairs are performed on the East or Gulf Coasts. The purpose of market research was to collect historical information from the ship’s last three (3) CONUS availabilities. N3220519C4011, N3220518C4016, and N3220517C4001 were the contract numbers identified. In researching this information, it was discovered that the aforementioned acquisitions were solicited and awarded as 100% total small business set-asides under NAICS code 336611 with a standard business size of 1,250 employees.
9. A Listing of the Sources, if any that expressed, in writing, an interest in the Acquisition: No sources to date, have expressed an interest in any of the aforementioned WIs.
10. Actions to Remove Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to allow prime contractors to solicit these requirements competitively, other than synopsizing the requirements. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
