JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN FULL AND OPEN

COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command Norfolk, Virginia 23511.

2. Description of Action Being Approved: This is a justification for a sole source commercial purchase of services for the Adaptive Force Protection (AFP) village build outs for the USNS Fall River (T-EPF 4), USNS Trenton (T-EPF 5) and USNS Brunswick (T-EPF 6) to C&T Marine. The government anticipates a firm fixed price award in the estimated amount of $350,350.00.

3. Description of the Supplies/Services: The build out of AFP village for the USNS Fall RIVER (T-EPF 4), USNS Trenton T-EPF 5), and USNS BRUNSWICK (T-EPF 6) modification of village boxes to prepare for shipboard integration and the development of a procedure for future build out of AFP modules.

4. Statutory Authority Permitting Other Full and Open Competition: This contractual action is executed under the authority of 10 U.S.C. 2304 (c) (1) as implemented by FAR 6.302-1. Only One Responsible Source and No other Services will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority:

Procurement of AFP village build outs for these ships is a unique and evolving mission requirement highly dependent on Original Equipment Manufacturer (OEM) knowledge and specifications affecting the structural fire protection, fire detection and general alarm/public address systems which are covered under the SMS critical ship equipment list. MSC does not own the specific proprietary procedures to deploy these modules or ensure their correct installation in the field. Given the highly specialized nature of these modules, incorrect installation or integration of the modules into critical ship systems could degrade performance of these systems. Any degradation of system performance could degrade ship system interfaces, pose unacceptable risk to the safety of mission personnel, and potentially compromise mission.

In order to maintain safe operation of these AFP packages and the corresponding ship systems, it is imperative that MSC use OEM certified representatives for these AFP build outs for the construction of the modules and integration to fire detection and general alarms. C&T Marine is the only SEABOX-recognized field representative for the build out and outfitting of SEABOX constructed adaptive force package village modules. C&T Marine is also a limited source OEM-recognized representative for the General Alarm (GA) and Public Address (PA) systems. In accordance with the SMS instruction, any work performed on the GA/PA systems must be completed by an OEM-recognized service representative. C&T Marine fills this role during the build out, providing additional efficiency to the build out process.

6. Description of Efforts made To Solicit Offers from as Many Offers as Practicable: The Government intends to synopsize when required and to post Requests for Quotation (RFQs) and Requests for Proposal (RFPs) at the Government Point of Entry, the FedBizOpps website, for each separate procurement, and intends to award a firm fixed price contract or purchase order, as appropriate.

7. Determination of Fair and Reasonable Cost: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulations (FAR) Part 13.106-3 or 15.404-1, as appropriate.

8. Actions To Remove Barriers to Future Competition: For the reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the type of services covered by this document.

If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
