Q&As_ 26 July 2016
120. Will payment be made on a per diem basis for dock trials?
A. As specified in Section B-1.15, dock trails will be paid as “per instance dock trial rates provided under this contract…” (i.e. dock trails will be paid at a lump-sum rate for the 5 day period).
121. If the dock trial runs longer than 5 days, will it be considered a second event?
A. It would be unusual for a dock-trial to extend beyond 5 days. If this were to occur, it would not be considered a second event, rather it would be handled on a case-by-case basis and the government will take into account the specific reason additional time was required.
122. If dock trial runs longer than 5 days, and it is not considered a second event, will payment be made at applicable per diem rate or is the contractor expected to cover additional costs?
A. During the course of a dock trial, the Contractor will continue to be paid the per diem rate applicable to the status of the ship, in accordance with B-1.15 that specifies “The entire dock trial evolution will be conducted within the ROS-5 or RAV per diem.”
123. The answer to question 113 is inconsistent with the overtime methodology from the rest of the solicitation. Does the answer to question 113 and section 1.2.3.1 override all other sections of the solicitation? For instance do other reimbursable costs (fuel, spare parts, etc.) become contractor’s responsibility during dock trials? The usage of the language "Any additional costs" as interpreted by the answer to question 113 indicates that would be the case, but, common sense would indicate not. Please clarify.
A. The response to Q.113 states, “Overtime associated with dock trials is not reimbursable.
Dock Trials are priced as a fixed price, lump-sum, all inclusive rate as specified in Section C-
1.15 which states: “Any additional costs that may be incurred above this per diem rate should be included in the Contractor’s fixed price per event for dock trials in Section B.”
The reference C-1.15 in the above response is incorrect; The correct reference is B-1.15. The “per diem rate” referenced in the context of B-1.15 pertains to the offerors ROS-5 or RAV per diem rate (which continues during the course of the dock trail (see response to Q. 122 above).
“Any additional cost” incurred above the ROS-5 or RAV per diem should be included in the offeror’s lump-sum dock trial rate. Other costs which are otherwise and explicitly reimbursable in the contract terms will remain reimbursable during dock trials.
124. If all overtime is to be added to “Form C - Dock Trial - Schedule of Total Daily Crew Costs” as indicated by the answer to question 113, please update the sheet to allow for overtime to be added for positions other than the 3rd Assistant Engineer.
A. Any additional crew overtime associated with dock trials can be added to Form A (as a lump sum for five days) under “Other Ship Expenses” with an itemized breakdown as an attachment.
125. Question 86 in the LMSR RFP stated “Section C-1.7.7.3 will be revised in a forthcoming Amendment to include a Chief Mate and Storekeeper for FOS turnover, and a Storekeeper to ROS turnover. However, Amendment 4 only added the SK to the FOS overlaps. It did not add the Chief Mate in FOS and the SK in ROS. As this issue impacts our pricing, we respectfully request that the issue be addressed
A. The intent was to have a two-day overlap for all Key Shipboard positions identified in Section C-1.7.2. Accordingly, a Chief Mate shall be added to FOS turnover and an Electronics Officer and Storekeeper will be added to ROS turnover. These revisions will be made in the next Amendment.
