MILITARY SEALIFT COMMAND NORFOLK

SP64 471 EAST C STREET

NORFOLK, VA 23511-2419

N104-14-T-1556

JUSTIFICATION AND APPROVAL (J&A)

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) - Norfolk.

2. Nature of Action: The action submitted for approval is the acquisition of parts for the USNS Tippecanoe (T-AO 199) under other than full and open competition as only one responsible source and no other supplier will satisfy the agency requirements. A sole source firm fixed price type contract is anticipate for award to Rolls Royce North America, Inc. (FAR 13.501 (a)). This procurement is a FAR Part 12 acquisition being conducted under FAR 13.5 Test Program.

3. Description of Supplies/Services: The acquisition is to provide the OEM replacement parts for No. 3 Ship Service Diesel Generator (SSDG) from Rolls Royce North America, Inc. for the USNS TIPPECANOE (T-AO 199). The required delivery date is November 17, 2014.

4. Statutory Authority: The authority permitting other than full and open competition is as implemented by Federal Regulations (FAR) 13.501(a) under the test program for commercial items, section 4202 of the Clinger-Cohen Act of 1996.

5. Rationale Justifying Use of Cited Authority: The determination for single source procurement for this requirement is based on vendor, Rolls Royce North America, Inc, having restrictive rights. OEM parts are required for all critical equipment onboard T-AO class ships. MSC does not have Manufacturing and technical information required to evaluate and determine weather non OEM Components and replacement parts offered are equivalent to the OEM Components and replacement parts. All OEM parts are in compliance with USCG and ABS IMO regulatory requirements. The Government does not own or have rights to the detailed drawings. SMS Procedure 10.6-002 All Ship’s Service Diesel Generator s are listed as L-4 equipment in SMS guidelines. If the loss of Ship Service Diesel Generator occurs the ship would be restricted to port and unable to perform its required mission. Rolls Royce North America is the OEM. OEM replacement parts are required for all critical equipment on board the T-AO class Ships.

6. Description of Efforts made to Solicit Offers from as Many Potential Sources as Practical: The Government intends to post a request for quote (RFQ) at the Government Point of Entry, FedBizOpps Website, with the intent of awarding a firm-fixed-price contract to Rolls Royce North America, Inc. as the required replacement parts are only available through the original equipment manufacturer.

7. Contracting Officer’s Determination for Fair and Reasonable Price: The Contracting Officer will determine that the price is fair and reasonable pursuant to Federal Acquisition Regulation (FAR) Part 13.106-3(a) (2).

8. Actions to Removed Barriers to Future Competition. For reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contacts for procurement for these parts. If another potential source emerges, MSC Norfolk will assess whether competition for future requirements is feasible.
