Source Selection Information – FAR 2.101 and 3.104

JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. IDENTIFICATION OF AGENCY AND CONTRACTING ACTIVITY.
The contracting activity is the NAVSUP Fleet Logistics Center Pearl Harbor, Contracting Department (Code 200), Joint Base Pearl Harbor-Hickam, HI. The requiring activity is NAVSUP Fleet Logistics Center (FLC) Pearl Harbor, Operations Department (Code 430), Joint Base Pearl Harbor-Hickam, HI.
2. Description of the Action Being Approved.
This action will be awarded as a firm fixed price contract on a sole source basis for two (2) Mulags for NAVSUP FLCPH Operations Department Code 430 from Fortbrand Services Inc.
3. Description of Supplies/Services.
Two (2) MULAG-Diesel Conveyor belt vehicle, Orbiter 12, Model MDF 12 and freight to JBPHH. The required delivery schedule and lead-time involved for the procurement and delivery of the requested MULAG conveyor belt vehicle is 4th Qtr, FY 2018. The total estimated dollar value of the procurement is .
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
Procuring the MULAG under the justification and rationale of the authority cited above would facilitate and eliminate the requirement to maintain separate sets of supply spare parts and other auxiliary attachments that are different than the existing MULAG conveyor belt vehicle spare parts and other auxiliary attachments used and maintained on a daily basis at NAVSUP FLCPH and all of the other NAVSUP Fleet Logistic Centers.
The MULAG Conveyor Belt Vehicle MDF12 naval version was especially designed for loading and offloading of military and commercial ships. The length and weight of this vehicle is a feature which enables the MDF-12 to move easily through the narrow piers at Joint Base Pearl Harbor Hickam (JBPHH). The weight of the MDF-12 at 9,480 lbs meets the minimum weight requirement of 10,000 lbs for these piers. Larger conveyor belt vehicles located in the market place would not work as they would not be allowed on some or all of the piers in JBPHH. The MDF-12’s maximum height of 20 feet in transport position was purposely fitted for ship use. Additionally, another feature is the loading ramp fixed to the front end of the conveyor boom with rollers which allows for the ship’s fragile provisions and supplies to be received and transported on a flat surface.
This is not required on conveyor belt vehicles made for airlines or the conveyor belt Telestacker manufactured by Superior. Also included by MULAG is a removable extension that is manually added to increase length. This extension is added when ships are unexpectedly further off the piers. The booms on the MULAG are special “made to order” for ships and are not comparable to those made for airfield operations.
There is no other manufacturer that provides a “special made” ship conveyor belt used for Naval ships and piers. All other identified conveyor belts support airfield operations and for larger commercial industrial operations.
Fortbrand Service, Inc. is uniquely qualified for fulfilling the requested contract requirements in that this company is the current sole source distributor for the United States that is capable of providing the requested Mulags, that is manufactured by German company Mulag Fahrzeugwerk, of procurement for parts support and auxiliary attachments for the current fleet of MULAG conveyor belt vehicles operated and maintained at the seven NAVSUP Fleet Logistic Centers worldwide. Confirmed with Mulag Fahrzeugwerk that the United States distributor is Fortbrand Services Inc. as indicated by the results of the sources sought notice N00604-18-Q- 4076.
Parts compatibility with MULAG conveyor belt vehicles are required. Avoiding procurement of a similar non-MULAG conveyor belt vehicle that possess different physical characteristics sourced from a different foreign or domestic heavy equipment company would help to curtail and minimize unnecessary increased financial cost to the Government by mandating the use of a different vendor’s conveyor belt car/vehicle. This would create additional financial burdens on the command by mandating & maintaining separate supply spare parts support, other auxiliary attachments required for provisions and material loading operations as well as undefined recurring training on the operation and maintenance of non- MULAG conveyor belt car/vehicles.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
All preferred and mandatory sources were screened and resulted with these sources not capable of providing the required vehicle or something similar. Further research done in March found efforts to source a domestic conveyor belt vehicle under an existing GSA Commercial Item Description (CID) contract (#A-A-50691C) was not successful. Market research indicated TUG Technologies Corporation has similar conveyor belts available. However, TUG Technologies Corporation only offers and has available off-road variant conveyor belt vehicles. TUG Technologies does not offer or build street capable/road capable conveyor belt vehicles for the market. In essence, their conveyor belt vehicles are designed for airfield/aircraft loading/offload evolutions. Other physical constraints of their domestically sourced conveyor belt vehicle include smaller physical dimensions that are shorter than what is required when operating conveyor belt vehicles on the waterfront. Conveyor belt only telescopes out to a distance of 30 ft (waterfront operations need conveyor belts that extend out a minimum of 50 ft).
A review of previous purchases revealed sole source procurements to Fort Brand Services for the MULAG vehicle from all NAVSUP FLC’s. Additionally, a sources sought notice was posted to the Government Point-of-Entry (GPE) in an effort to gain additional sources for the required supply. Source sought notice N00604-18-Q-4076 was posted from 30 Aug 2018 – 06 Sept 2018.
These efforts resulted in only one response by Fortbrand Service, Inc.
7. Determination of Fair and Reasonable Cost.
The Contracting Officer has determined the anticipated cost to the Government for the supply covered by this J&A will be fair and reasonable. This determination of anticipated cost for fair and reasonableness is made based on historical pricing information from contract N00604-12-P- 4028 in conjunction with the previous invoices for same or similar items.
8. Actions to Remove Barriers to Future Competition.
As noted above, a sources sought notice was posted to the Government Point-of-Entry (GPE) in an effort to gain additional sources for the required supply. Source sought notice N00604-18-Q- 4076 was posted from 30 Aug 2018 – 06 Sept 2018. These efforts resulted in only one response by Fortbrand Service, Inc. NAVSUP FLCPH will continue to assess the marketplace to determine if competition for future requirements is feasible.
