The solicitation is for engineering, technical, operational, test and logistics services in support of research programs at the Surface/Aviation Interoperability Laboratory in Maryland, including facilities maintenance, equipment purchases, travel support, and participation in exercises and demonstrations. AMENDMENT 0004
AMENDMENT 0004: Question & Answer Summary
31. The two below questions (No. 10 from Amendment 0002 and No. 28 from Amendment 0003) are associated with the same issue, but answered differently and appear to be in conflict with one another. Both answers are related to the Past Performance Attachment No. P4 and whether the offeror’s can reconstruct the Attachment P4 document into a MS Word document. The answer provided to Question 28 in Amendment 0003 seems to be more restrictive in nature and most likely will not allow the offeror’s to provide complete responses for the requested information. The answer to Question 10 under Amendment 0002 is the most flexible and will allow the respondents to provide complete answers. We are requesting clarification between the two previously provided answers.
Answer = Offerors shall provide the past performance reference information via the Government provided Attachment P4 in Adobe PDF format. Offerors may attach a one-page continuation sheet in MS Word to the Attachment P4 for additional information from the P4 where the text box may not allow for enough space. Offerors are reminded that the Government will also consider the information provided in Annex 1 (electronic copies of the Statement of Work/Performance Work Statement for each contract reference) in the evaluation of the past performance references.
32. Amendment 2 indicated a total page count of 20 pages for the past performance volume. Amendment 3 Q&A responses regarding page count are less clear. Please confirm we have 20 pages to address past performance in total (and we are not limited by individual reference).
Answer = The 20 page limit noted in Section L, Part A, parapgraph 3.0 is correct. The reference to page limits in Amendment 0003, question 28 is specific to the provision of a continuation page in addition to the Attachment P4. The page limit for the Past Performance volume is 20 pages, as noted in the table.
The following have been modified:
AMENDMENT 0003
AMENDMENT 0003: Changes
1. Sect. C, 4.7.15: Deleted “1”; labor category now entails two (2) Key Personnel.
2. Section H, 5252.228-9501 LIABILITY INSURANCE (NAVAIR) (MAR 1999) has been updated.
3. Sect. L, Volume 1, 1.1.d.: Added a bullet below 1.1.d.; bullet provides examples were of tasks that require quality assurance and mitigation strategies.
4. Sect. L, Part A, 3.0 (Table): Added verbiage providing further instructions on Annex II submission.
5. Sect L, Part B, 1.3.8 & 1.3.9: Note added below section 1.3.9.
6. Sect L, Part B, Volume 3, 3.6.2 Labor Hours (Table): BLS SOC 13-1111, Previously included a note that only one (1) position is key, this note has been removed. Both positions are now Key.
7. Removed the following sentence from Section M, paragraph 2.0: “Additionally, the Government will focus on past performance, similar to the following SOW paragraphs: 3.3.1, Engineering Services; 3.3.3. Software Engineering, Development, Programming and Network Services; 3.3.5 Information Systems (IS), Information Assurance (IA) and Information Technology (IT) Services; 3.3.6 Interoperability, Test and Evaluation, Trials Services.”
AMENDMENT 0003: Question & Answer Summary
(Previously unanswered question from Amendment 0002)
22. Will the Government please explain how they will focus on past performance similar to SOW 3.3.1, 3.3.3, 3.3.5, and 3.3.6? This infers that these sections carry more weight than the rest of the SOW. Are these sections of greater importance for evaluations purposes?
Answer = The “additionally” language has been removed from the RFP. Please see Section M, paragraph 2.0 Past Performance for further information.
28. Per Q&A 10, please confirm it is permissible to convert the entire Attachment P4 into an equivalent MS Word document to satisfy all of the requirements contained within the P4 document as well as all L/M requirements.
Answer = Yes, after first exhausting the space available on the provided form (Attachment P4), it is permissible to provide an additional – up to one (1) page – of information in a MS Word document.
29. Q&A 26 requires the Small Business Utilization Strategy to be included in the management section, not Annex 2. However, page 84 of the RFP titles Annex 2 as “Small Business Utilization Strategy.” Further, Part B Specific Instructions states, “Cost or Pricing information shall only appear in the Price/Cost Volume,” but the Small Business Utilization Strategy requires goals to be presented in both dollars and percentages in relation to total contract value. To be compliant with Section L requirements of Part B, will the government please consider moving the Small Business Utilization Strategy as a requirement of Annex 2 and therefore a part of the Price/Cost proposal?
Answer = Yes, the Government concurs with the rational of this question. Therefore, all Offerors are now instructed to now have Annex 2 (SB Utilization Strategy) accompany Volume III Price/Cost Proposal. However, the SB Utilization Strategy is still considered a Technical Factor and will be evaluated as such.
30. Q. Section 3.3.6(c), page 25, states: “Provide services in the areas of test equipment and test site preparation, assistance in conducting sea tests, and assistance in data collection. The Contractor shall analyze, compile, summarize and draw conclusions from test data gathered by DoD and other agencies as required. Test site preparation includes transportation and setup of avionics equipment. At least one of the Contractor’s personnel shall possess a Commercial Driver’s License (CDL) in order to transport avionics equipment and trailer. The Contractor shall accept responsibility for any damages incurred to commercial vehicles, installed systems, and all other equipment being transported. Contractor shall maintain appropriate insurance to cover total replacement cost of the vehicle and all other equipment.” Additionally, Section 3.2.7(g), page 20, states: “The COR and Contracting Officer are to be provided evidence of NTV liability insurance covering bodily injury and property damage protecting the Contractor and DoD against third-party claims arising from the ownership, maintenance or use of a NTV IAW FAR 28.307-2(c).”
The insurance requirements in Clause 5252.228-9501 Liability Insurance (NAVAIR) (MAR 1999) require minimums of “(a) Comprehensive General Liability: $ [$200,000] per person and $[$500,000] per accident for bodily injury. (b) Automobile Insurance: $[$200,000] per person and $[$500,000] per accident for bodily injury and $[$5,000,000 ]per accident for property damage.”
FAR 28.307-2 requires minimums of “(b) General liability. (1) The contracting officer shall require bodily injury liability insurance coverage written on the comprehensive form of policy of at least $500,000 per occurrence. (2) Property damage liability insurance shall be required only in special circumstances as determined by the agency. (c) Automobile liability. The contracting officer shall require automobile liability insurance written on the comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage. The amount of liability coverage on other policies shall be commensurate with any legal requirements of the locality and sufficient to meet normal and customary claims.”
Can the government either confirm that the minimum requirements in the FAR and NAVAIR clauses are sufficient for the requirements in Section 3.3.6(c) and 3.2.7(g), or else provide the appropriate level of property damage liability insurance per FAR 28.307-2(b)(2)?
Answer = After consideration, the Government has estimated that subparagraph (b) of NAVAIR clause 5252.228-9501 shall be $6,000,000 for proprety damage.
