Question #1 When ordering via task order in a given year the requirement is for the minimum. Is that the minimum quantity of each CLIN, or would the government be allowed to order the minimum of just one CLIN? In other words if Contractor A were awarded Lot 1 (MK84, Q36, Q53, Q62) could Contractor A expect at least the minimum of each to be awarded in each year (assuming a task award was made)?
Question #1, Answer:
The minimum quantity guaranteed to the contractor is 1,500, which will be the first order (base year) as identified in Clause 5252.216-9506 MINIMUM AND MAXIMUM QUANTITIES (NAVAIR) (MAR 1999). The minimum quantity for an order is governed by FAR Clause 52.216-19 ORDER LIMITATIONS (OCT 1995), which is a full pallet for each buoy type, but first the minimum priced quantity must be procured for the CLIN in any given year. There is no guarantee that the Government will order the minimum priced quantity for every CLIN per year (assuming an order(s) is issued). This is not true for Lots 2 and 3 since they are comprised of only one hardware CLIN per year. If the SSQ-101 or SSQ-125 is procured in a year, then it will be at least the minimum quantity priced in Section B. For Lot 1 and Pricing Scenario 4, the potential exists that some, but not all minimum priced quantities are procured in a year. Likewise, the probability exists that the ordered quantity will exceed the minimum priced quantity. In summary, not every CLIN is guaranteed to be ordered every year, but the minimum priced quantity for that CLIN will be procured if it is ordered.
