About this file

This is a NAVSUP Fleet Logistics Centers Commercial Only One Source Justification submitted in accordance with FAR 12.102(a) for a sole-source procurement.

The procurement is for Chloropac Cell Assembly replacement parts for the USS Miguel Keith (T-ESB 5), with a required delivery date of 26 August 2026. The requirement includes four part numbers: W3T105275 (0.5LB Chloropac Cell Assembly, quantity 3), W3T105276 (0.5LB Chloropac Cell Assembly, quantity 2), W3T105278 (1LB Chloropac Cell Assembly, quantity 3), and W3T105280 (1LB Chloropac Cell Assembly, quantity 3). Competition is restricted to Evoqua Water Technologies LLC, a large business manufacturer with CAGE code 89357. The manufacturer point of contact is Robert Weddle (+1 972 346 8159, robert.weddle@evoqua.com).

The justification for sole-source procurement centers on the Chloropac cells' critical role as direct substitutes for the ship's essential electrochlorination system, which produces sodium hypochlorite on-site to prevent marine growth in piping and cooling systems. The cells are integrated with a proprietary Power Supply Controller featuring Xylem's protected firmware, programming architecture, communication protocols, and interface hardware. Evoqua holds proprietary patents defining the specific engineering tolerances and specialized electrode coatings required for proper form, fit, and function. The document asserts that non-OEM parts would create severe risks including seawater leakage, electrical hazards, and diminished chlorine production, while voiding manufacturer warranties and system safety certifications. The justification certifies that only genuine Xylem replacement cells can maintain system integrity and operational readiness without costly system redesign.

NAVSUP FLEET LOGISTICS CENTERS (FLC) COMMERCIAL ONLY ONE SOURCE JUSTIFICATION

(NTE SAT) IN ACCORDANCE WITH FAR 12.102(a) firmware, programming architecture, communication protocols, and interface hardware, all protected under Xylem’s intellectual property rights. The control unit supplies a consistent, direct current to the chloropac cells within the system, therefore requiring components to be compatible.

Evoqua holds proprietary information and patents that define the specific engineering tolerances and specialized coatings of these electrodes. Obtaining non-Original Equipment Manufacturer (OEM) parts would jeopardize the necessary form, fit, and function for smooth integration, resulting in significant risks such as seawater leakage, electrical hazards, and diminished chlorine production.

Procuring non-Original Equipment Manufacturer (OEM) parts would fail to guarantee the precise form, fit, and function necessary for seamless integration, introducing severe risks of seawater leakage, electrical hazards, and diminished chlorine generation. Furthermore, utilizing third-party components would void existing manufacturer warranties and system safety certifications. Therefore, only genuine Xylem replacement cells can maintain the system's integrity, prevent catastrophic marine bio-fouling in critical cooling systems, and ensure operational readiness without requiring a costly and time-prohibitive total system redesign.
