PPI AND RESPONSES
1. Inquiry: If the ladders are missing the lower counterweight, are we required to find it on the bottom?
Response: This is not required.
2. Inquiry: How many ladders can we have removed at a time at each pier?
Response: Because Ladders are completely unusable, they may be removed all at once.
3. Inquiry: How many days is acceptable for a ladder to be removed before it is replaced?
Response: The number of days should be minimized, however there is not a requirement.
4. Inquiry: Are the 2 new upper ladder sections at KB dock required to be aluminum or match the existing steel?
Response: The upper ladder sections shall match lower sections: Aluminum. Shackles on top and bottom shall be Stainless Steel.
5. Inquiry: The scope calls for ladder material to be 2” SCH 40 square tubing and on section IX the material calls for 3/8” x 6” flat bar sides. Is the 2” tubing for the rungs or is this a mistake? Please confirm material sizes for the sides and rungs of the new ladders.
Response: The 3/8” x 6” flat bar is an error. This should be 2” tubing (round or square).
6. Inquiry: Is the 6” x 6” x 2’ solid square bar made of precast concrete? If yes, what is the PSI requirement?
Response: The solid square should be concrete. There is no PSI requirement. The mix design should be suitable for long term submergence in salt water. For example: A low water to cement ratio. The dimensions shall be 12” X 12” X 32” width.
7. Inquiry: If the solid bar is concrete does the #4 rebar and #3 rebar hoops need to be epoxy coated?
Response: The #3 rebar hoops shall be epoxy coated.
8. Inquiry: Is there a requirement or procedure for disposing of the sea life?
Response: Sea life is disposed of as Solid Waste, it cannot be put back in the water. Every effort shall be made to minimize sea life falling in the water.
9. Inquiry: Are there any 3rd party special inspections required for this job?
Response: None.
10. Inquiry: Does a rescue boat need to be onsite during our work hours?
Response: Yes. Per Em 385-1-1 05.K.
11. Inquiry: Please confirm if USL&H is required for this project
Response: It is required.
12. Inquiry: Do you concur that USL&H insurance is applicable for this RFP?
Response: Concur. USL & H Insurance is applicable.
13. The concrete ballast weights information is missing
a. Inquiry: Do we allow for the concrete ballast weight for every ladder?
Response: Yes.
b. Inquiry: What are the actual dimensions for the concrete weight?
Response: The solid square should be concrete. The dimensions shall be 12” X 12” X 32” width. With Stainless steel shackles on top and bottom.
c. Inquiry: What would the concrete mix design be for concrete in salt water?
Response: There is no PSI requirement. The mix design should be suitable for long term submergence in salt water. For example: A low water to cement ratio.

SECTION 00 20 00 - INSTRUCTIONS FOR PROCUREMENT
The following have been modified:
EVALUATION CRITERIA LPTA
Evaluation – Lowest Price Technically Acceptable
The Government will award a contract resulting from this solicitation to the responsible proposal, who’s Offeror conforms to the solicitation and is most advantageous to the Government, price and other factors considered. Within the continuum, the Government will employ a “Lowest Price Technically Acceptable” analysis of cost or price and non-cost factors in evaluating the proposals submitted. Evaluation of technical factors shall be on an acceptable/unacceptable basis. All factors are required to achieve an acceptable rating to be considered technically acceptable.
FACTOR 1 – TECHNICAL
Subfactor A - Technical Capability
i. The quality of detail to which the proposal demonstrates having been in business for more than 2 5 years in Commercial/Industrial applications in the state of working and the ability to perform same or similar work.
ii. The proposal will be evaluated for the offeror’s demonstration of understanding the requirement and it’s plan for meeting the specified requirements, including identification of journeyman qualified technicians and equipment operators. Demonstrated that any identified subcontractors meet the requirements of qualified technicians and equipment operators. Identifies and provides certifications for Quality Control Manager per General Requirements 5.21, Quality Control, Site Safety and Health
Officer (SSHO) per General Requirements 5.4, Site Safety & Health Officer (SSHO) Qualifications & Duties, and identify other qualified personnel to meet General Requirements 5.6, EM 385-1-1 Contents, paragraph 1.
iii. Washington State Department of Licensing – Contractor License will be reviewed for compliance with this requirement.
Subfactor B – Bonds.
i. Paymente Bond – The bondability will be verified with the Surety for bonding capacity suitable for this contract and verification that bonds will be provided after contract award.
Technical acceptability will be assessed according to Table M-1.
Table M-1: Technical Acceptable/Unacceptable Evaluation Ratings
Rating Description Acceptable Proposal meets the minimum requirements of the solicitation.
Unacceptable Proposal does not meet the minimum requirements of the solicitation.
FACTOR 2 – PAST PERFORMACE ACCEPTABILITY
Past performance will be evaluated based on the Offeror’s demonstrated ability to satisfy its customers, deliver products and services of high quality, meet delivery schedules, and comply with applicable Federal, State, and local laws and regulations.
The Government may contact some or all of the Offeror’s references to ask questions such as: (1) was the Offeror is capable, efficient, and effective; (2) did the Offeror’s performance conformed to the terms and conditions of its contract; (3) was the Offeror was reasonable and cooperative during performance; (4) was the Offeror was committed to customer satisfaction; (5) did the Offeror meet proposed subcontracting goals, if applicable; and (6) did the Offeror hire and retain qualified personnel necessary for successful completion of the contract requirements.
The Government will evaluate up to three references for the Prime and up to two references for each proposed major subcontractor. References exceeding the quantity requested shall be removed from the end of the volume and will not be evaluated.
The Government may consider information obtained from sources other than those identified by the Offeror, including Federal, State and local Government agencies, better business bureaus, published media and any other sources available to the Government, to include, but not limited to, Contractor Performance Assessment Reporting System (CPARS), Supplier Performance Risk System (SPRS), System for Award Management (SAM.gov), Electronic Subcontract Reporting System (eSRS), Federal Subaward Reporting System (FSRS), or other databases;
the Defense Contract Management Agency; and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.
The Government will consider recent (completed within the last 3 years) and relevant past performance information obtained in relation to the scope of this requirement. It is the Offeror’s responsibility to relate its past performance to the requirements of this solicitation. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort will be given higher consideration in determining the Offeror’s past performance acceptability/unacceptability.
Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the product, complexity, dollar value, contract type, and subcontract/teaming, or other comparable attributes of past performance examples and the solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.
If the Offeror does not provide past performance information with its proposal, the Contracting Officer need not pursue further information if it is clear that the Offeror’s price is not competitive.
NOTE: In the case of an Offeror without a record of relevant past performance, or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral shall be considered “acceptable.”
Past Performance acceptability will be assessed according to Table M-2.
Table M-2: Past Performance Evaluation Ratings
Acceptable Based on the Offerors performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See NOTE above.)
Unacceptable Based on the Offerors performance record, the Government does not have a reasonable expectation that the Offeror will be able to perform successfully the required effort.
The Offeror’s past performance must be rated “Acceptable” to be further considered.
FACTOR 3 - SAFETY
1. DART Rate:
Evaluation:
Evaluate any trends and consider changes that take the offeror from one risk level (or more) to the next up or down.
Increasing trends will require an acceptable explanation of any extenuating circumstances that caused the higher mishap rates. The Government will review for quality of detail and the degree to which any corrective action described in the Offerors proposal resolved or remedied the increasing trend or fatality.
a. Missing data without an explanation may be considered non-responsive and may render the offeror ineligible for award.
b. This chart correlates the DART rate to the level of risk:
Risk DART Rate:
Very Low Risk Less Than 1.0 Low Risk From 1.0 to 1.99 Moderate Risk From 2.0 to 2.99 High Risk From 3.0 to 4.0 Extremely High Risk Greater than 4.0
2. TCR Rate:
Evaluation:
Evaluate any trends and consider changes that take the offeror from one risk level (or more) to the next up or down.
Increasing trends will require the explanation of any extenuating circumstances that caused the higher mishap rates.
The Government will review for quality of detail and the degree to which any corrective action described in the Offerors proposal resolved or remedied the increasing trend.
a. Missing data without an explanation may be considered non-responsive and may render the offeror ineligible for award.
b. This chart correlates to the TCR rate and the level of risk:
Risk TCR Rate:
Very Low Risk Less Than 2.49 Low Risk From 2.5 to 3.49 Moderate Risk From 3.5 to 4.49 High Risk From 4.5 to 5.99 Extremely High Risk Greater than 6.0
Safety Evaluation Ratings based on DART and TCR Ratings
Safety acceptability will be assessed according to Table M-3.
Table M-3: Safety Evaluation Ratings
Acceptable Based on a stable “Very Low Risk to Moderate Risk” in both DART and TCR rating throughout the last 5 years or continual decrease in risk with “Moderate Risk to Very Low Risk” in the last 2 years.
Unacceptable Based on consistently “High Risk to Extremely High Risk” in both DART and TCR, unexplained erratic risk rates, or continually increasing risk from “High Risk to Extremely High Risk” in the last 2 years
PRICE: The Government will evaluate the Offeror’s price proposal for the following:
A. Completeness. The Government will evaluate the offerors’ Attachment 3, Schedule of Values and Attachment 4, Bid Form for completeness, accuracy, and alignment with the technical proposal. An Offeror’s price proposal may be deemed non-responsive if, in the judgment of the Government, the price proposal is incomplete or erred. Failure to submit a price on any item may result in the proposal being deemed non-responsive.
B. Reasonableness. The Government anticipates making a determination of fair and reasonable pricing based on adequate competition. However, the Government may use any of the analysis techniques in FAR 15.404-1, either individually or in combination with each other, to determine that the final price is fair and reasonable.
Written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.
The Government may accept an offer (or part of an offer) before the proposal expiration date regardless of negotiations after receipt of the offer, unless a written notice of withdrawal is received before award.
Failure to provide all required information from this solicitation and any subsequent amendment(s) may render the proposal non-responsive.
Performance under this contract requires the contractor to adhere to Attachment 9, Operations Security (OPSEC) requirements, which are attached to this solicitation and subsequent award and are also available online at:
http://www.navsea.navy.mil/Home/Warfare-Centers/NUWC-Keyport/Resources; click on OPSEC Guide for Defense Contractors on the left-hand side.

Offerors shall provide an email to james.k.wasson.civ@us.navy.mil requesting confirmation of Government receipt of the proposal submission. Offerors must receive confirmation of receipt to ensure proposals have been received by the Government.
Award will be made to the responsible Offeror submitting the lowest price, technically acceptable proposal. The Government intends to award a contract without discussions (except for clarifications as described in FAR 15.306(a)), as permitted by FAR 15.305(a) (3) and FAR 52.215-1. However, the Government reserves the right to conduct discussions to permit Offerors to revise their proposals.
