From:

2.3.1.3 No damage affecting functionality is acceptable e.g. cross-threaded connections or dents that impact IBC integrity.

2.3.1.4 Normal wear and tear associated with transportation is acceptable such as minor scratches, minor dings, and scuff marks.

To:

2.3.1.3 The contractor shall take protective measures during transporting, pumping, and cleaning operations to prevent damage affecting IBC functionality. Damage affecting functionality includes, but is not limited to, cross-threaded connections, punctures, dents, severed gaskets, and other damage preventing ability to pressurize the IBC or causing hazardous waste leakage during stowage and operation. Allowable damage affecting IBC functionality: NONE.

2.3.1.4 Normal wear and tear such as minor scratches, dings, and scuff marks associated with transportation is acceptable.

3) Update clause M-215-H004, BASIS OF AWARD (NAVSEA) (DEC 2018), PROPOSAL SUBMITTAL REQUIREMENTS, paragraph 1. Factor 1 – Technical Acceptability, subparagraph C. as follows:

From:

6) Provide answer to solicitation question #5.

The following have been modified:

QUESTIONS AND ANSWERS

Q1) Can you provide any information on the composition and potential contamination of the “soil” described in RFQ section 3.2 on page 25?

A1) Although soil is a possible material that would require disposal it is not likely. Contaminated soil requiring disposal should be minimal, i.e. less than one drum..

Q2a) Will any waste characterization analytical report be provided for each waste stream when a Task Order is issued?

A2a) Current practice is to provide analytical reports for a waste profile generation of each of the four waste streams at the start of the contract and then as required for renewing the profile (previously every two years). The waste is generated from a relatively unchanging maintenance environment so variation in analytical reports over the years has been minimal.

Q2b) If not, shall we assume the worst-case scenario: both liquid and solid wastes are: flammable (D001), containing reactive cyanide (D003), cadmium (D006), and lead (D008)?

A2b) Currently liquid waste streams are manifested with all four waste codes (D001, D003, D006 and D008) and solid waste streams are manifested with two waste codes (D006 and D008). It is possible that the contractor and generator will determine that these codes should change when a new waste profile is generated at the beginning of the contract and offeror should make allowances for that possibility.

Q3) Is the liquid in IBCs allowed to transfer to 55-gallon drums?

A3) If desired, transfer from IBC to 55-gallon drums must be accomplished at the contractor facility, i.e.

not on base.

Q4a) In the context of establishing pricing for the Contract Line-Item Numbers (CLINs), we are currently reviewing item number 0009 IN PAGE 7 OF N0025324Q0004 DOCUMENT , which pertains to the Contract Data Requirements List (CDRL). Could you please clarify whether this particular item should be included in our pricing structure?

A4a) As the line item for CDRLs is solicited as Not Separately Priced (NSP), any cost for CDRLs should be included in the service CLINs, and the division of CDRL cost among service CLIN pricing is at offeror discretion.

Q4b) Additionally, is it necessary to assign a price to the DD Form 1423-1 in Exhibit A -CDRLS as well in our proposal?

A4b) As the line item for CDRLs is solicited as Not Separately Priced (NSP), offeror should not assign a price to the DD Forms 1423.

Q5) Is it possible for NUWC to grant an extension for Solicitation# N0025324Q0004?

A5) Yes, see summary of changes for solicitation amendment 0002.

5.7.6 The SUBTORPIMA ADMIN/Security will notify the contractor when the DBIDS pass application has been approved and provide further guidance regarding JBPHH’s process for DBIDS pass issuance.

6 DISPOSAL COST

The quantity identified for each line item in the schedule is the estimated maximum amount of material that will be disposed of pursuant to Orders issued under the contract during the ordering period applicable to the line item. The UNIT PRICE represents the proposed price for disposal per unit disposed (e.g. drum, each). The AMOUNT represents the product of the UNIT PRICE multiplied by the QUANTITY. The UNIT PRICE shall include all costs for disposal not otherwise provided for by separate applicable line items (e.g. transportation line items). The amount to be invoiced and the amount the Government will pay for disposal will be determined by multiplying the UNIT PRICE by the number of corresponding units disposed of. One invoice will be prepared for each task order.

7 TRANSPORTATION COST

Line items designated for Transportation Costs provide a method to pay for transportation of the material to be disposed of. Each UNIT of transportation includes all transportation related costs for a complete round trip (i.e.

pickup, disposal, and return, as applicable). The rate for the transportation cost line items shall include initial delivery of a tank or truck to the pickup facility, loading IBCs/drums, and return transport to the pickup facility, if applicable. Transoceanic shipment may be accounted for in either the applicable transportation line item or the UNIT PRICE per gallon or UNIT PRICE per drum for disposal. Transportation line items shall include the price for Certificate of Disposal for all material disposed of.

8 DEMURRAGE

When the Contractor reports to a designated pickup site, at the designated time, Government personnel will be present to perform functions necessary to facilitate the pickup. If Government personnel are not available to perform those functions or the Government fails to perform its obligations so as to otherwise cause the Contractor to stand-by, then the Contractor may invoice for demurrage subject to the conditions set forth as follows: The Contractor shall immediately report to the Government point of contact upon arrival at the pickup site. If the Contractor is on stand-by for between 30 and 60 minutes the Contractor may invoice for one (1) hour of demurrage.

The Contractor shall then telephone the Contracting Officer to report stand-by status and request instructions. The Contractor will then comply with the Contracting Officer’s direction. If the Contracting Officer directs the Contractor to continue to stand-by and the Contractor is in a standby status for between 90 and 120 minutes, the contractor may invoice for two (2) hours demurrage. Demurrage does not apply to delay(s) resulting from Contractor personnel noncompliance with PWS paragraph 5.7.

9 REPORTING REQUIREMENTS

The Contractor shall be required to submit the CDRLs identified in Exhibit A, which are summarized in the table below.

(End of Performance Work Statement)

M-215-H004 BASIS OF AWARD (NAVSEA) (DEC 2018)

ALL UNITS OF ALL ITEMS WILL BE AWARDED TO ONE OFFEROR. OFFERS, THEREFORE, MUST BE ON THE BASIS OF FURNISHING ALL UNITS OF ALL ITEMS TO THE SPECIFICATION(S) DETAILED IN

THIS SOLICITATION.

GENERAL INFORMATION

1. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.

The following factors shall be used to evaluate offers:

Factor 1 – Technical Acceptability Factor 2 – Past Performance Acceptability Factor 3 – Evaluated Price.

2. Lowest Price Technically Acceptable (LPTA) source selection procedures will be used for the evaluation of proposals received in response to this solicitation.

3. The Government may award to other than the Offeror with the lowest total price if the lowest price Offeror is found to be “Unacceptable” in any of the non-price factors.

4. If it is determined that a proposal exceeds a Factor’s page limit identified below, pages in excess of the specified page limit will be removed from the end of the submittal and will not be evaluated.

5. The Government intends to make award based on initial proposals without discussions but reserves the right to conduct discussions if determined necessary (see FAR 52.215-1). Accordingly, Offeror is advised to submit its most favorable terms and conditions in its initial proposal. If unexplained discrepancies are identified, the proposal may not be considered for award.

6. It is the Offeror’s responsibility to provide clear indications of how its proposal meets the requirements of the Performance Work Statement. If the proposal is not clear, it may be an indication that the Offeror does not understand the requirement.

7. The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal, conforming to the solicitation, will be most advantageous to the Government, price and other factors considered. Proposals are evaluated for acceptability, but not ranked, using the non-price factors. The Offeror must be determined to have an “Acceptable” rating for all non-price factors before further consideration will be given.

The LPTA non-price factors include Technical and Past Performance. The Contracting Officer will select the proposal, in conformance with the solicitation, which is determined “acceptable” for Technical and Past Performance, and offers the lowest evaluated price. A proposal that is rated “Unacceptable” for any non-price factor is unawardable. Therefore, if any non-price factor is rated “Unacceptable”, the Government reserves the right to not evaluate the remaining factors.

8. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

PROPOSAL SUBMITTAL REQUIREMENTS:

1. Factor 1 - Technical Acceptability: To determine technical acceptability, offerors must provide all necessary information for a comprehensive technical evaluation. The information must clearly demonstrate that the technical approach meets the requirements outlined in the Performance Work Statement. The technical proposal shall not contain any price-related information. Offerors must submit a technical proposal, consisting of no more than five (5) 8.5” x 11” pages, that clearly demonstrates the following:

A. The proposal provides the Offeror’s plan to perform requirements to collect, transport, and dispose of hazardous waste identified in the Performance Work Statement.

B. The proposal provides evidence certifying Offeror and proposed subcontractors can perform requirements to collect, transport, and dispose of hazardous waste identified in the Performance Work

Statement. Copies of permits, licenses, and documentation of Department of Transportation approval for all transportation vehicles are not included within the five (5) page limit.

C. The proposal provides Offeror’s plan to perform hazardous waste pickups at Joint Base Pearl Harbor- Hickam West Lock Annex via drivers with unescorted base access. Signed copy of “Unescorted Drivers Access Acknowledgement” (Attachment 4).

D. The proposal identifies the Offeror’s disposal sites and transporters established for performance. This is not included within the five (5) page limit.

If the services proposed do not meet all requirements of the Performance Work Statement, the offeror must identify any exceptions and state precisely how the offered services differ from the applicable paragraphs. Failure to comply with this requirement may result in rejection of the offer.

2. Factor 2 - Past Performance Acceptability: Offerors shall demonstrate past performance by completing the attached Past Performance Reference sheet for up to five (5) recently completed Federal Government contracts for like or similar items under this solicitation. Offerors shall include an accessible point of contact, including name and telephone number, for each reference provided. Offerors who have no Federal Government contracts may list state, local, or commercial contracts, in that order, to complete the Past Performance Reference sheet. Offerors are encouraged to submit brief and concise responses. Failure to submit the Past Performance Reference sheet may be considered certification that the contractor has no past performance for like or similar items for the Government to evaluate.

3. Factor 3 - Price: Offerors are required to submit prices for all line items included in the solicitation. Failure to submit a price for any line items may result in the offer being rejected as unacceptable.

4. Contents: Each Offeror’s proposal shall contain the following:

A. Cover letter

EVALUATION INFORMATION:

1. Factor 1 - Technical Acceptability: Offers must demonstrate the ability to perform the requirements described in the Performance Work Statement in the solicitation and any subsequent amendments. The offer must be determined to be technically acceptable before further consideration will be given. The ability to perform the work as specified in the proposal submittal requirements will be evaluated to determine if the proposed method(s) meets or exceeds the requirements as specified in the solicitation document. The proposal will be evaluated for completeness and accuracy of information and if the proposal addresses each specific area of the Performance Work Statement.

Evaluation will consider each offeror’s demonstration of the following:

A. The proposal described a realistic approach to how the Offeror will collect, transport, and dispose of hazardous waste identified in the Performance Work Statement.

B. The proposal provided evidence certifying the Offeror and all subcontractors maintain valid and current permits and licenses for collection, transportation, and disposal of hazardous waste identified in the Performance Work Statement, and that transportation vehicles meet Department of Transportation requirements.

C. The proposal included a signed copy of the “Unescorted Drivers Access Acknowledgement” (Attachment 4) and provided a realistic approach to how the Offeror will perform unescorted pickups at Joint Base Pearl Harbor-Hickam West Lock Annex, to include how the Offeror and all subcontractors will

D. The Offeror has designated approved disposal sites and transporters established for performance.

Should the technical information be insufficient to determine technical acceptability, the Government reserves the right to use other options such as internet research on company websites for services offered/proposed.

Technical acceptability will be rated using the method in the table below.

TECHNICALLY ACCEPTABLE/UNACCEPTABLE RATINGS

Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

2. Factor 2 - Past Performance Acceptability: Past performance will be evaluated on the offeror’s demonstrated ability to satisfy its customers, delivery products and services of high quality, meet delivery schedules, and comply with applicable Federal, State, and local laws and regulations.

The Government may contact some or all of each offeror’s references to ask questions such as: (1) was the offeror capable, efficient and effective; (2) did the offeror’s performance conform to the terms and conditions of its contract;

(3) was the offeror reasonable and cooperative during performance; (4) was the offeror committed to customer satisfaction; (5) did the offeror hire and retain qualified personnel necessary for successful completion of customer requirements; and (6) if given a chance, would they recommend award to the offeror.

The Government may consider past performance information obtained from sources other than those identified by the offeror, including Federal, State, and local Government agencies, better business bureaus, published media, and any other sources available to the Government including, but not limited to, the Contractor Performance Assessment Reporting System (CPARS), Supplier Performance Risk System (SPRS), Federal Awardee Performance and Integrity Information System (FAPIIS); and interviews with Program Managers, Contracting Officers, and Fee Determining Officials.

The Government will consider recent and relevant past performance information obtained in relation to the scope of this procurement. It is the Offeror’s responsibility to relate its past performance to the requirements of this solicitation. Past performance, either positive or negative, which is considered by the Government to be more closely related to the scope of this effort, will be given more consideration in determining the Offeror’s Past Performance acceptability/unacceptability.

If the Offeror does not provide past performance information with its proposal, the Contracting Officer need not pursue further information if it is clear that the Offeror’s price is not competitive.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.

Past Performance acceptability will be rated using the method in the table below.

PAST PERFORMANCE ACCEPTABLE/UNACCEPTABLE RATINGS

Adjectival Rating Description Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown (see note above).

Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

3. Factor 3 - Price: Offerors are required to submit prices for all line items included in the solicitation. Failure to submit a price for any line items may result in the offer being rejected as unacceptable. The Government will evaluate offers for award purposes by adding the total price for all contract line items. The prices will be compared to the Government Estimate, other offers received, and/or other independent price and cost information.

The Government will evaluate the Offeror’s price proposal for the following:

A. Completeness. An Offeror’s price proposal may be deemed non-responsive if, in the judgment of the Government, the price proposal is incomplete, erred, or does not accurately reflect the Offeror’s proposed effort in meeting the technical requirements, thereby indicating that the Offeror does not understand the scope of the technical requirements. Any inconsistency, whether real or apparent, between promised performance and price shall be explained in the price narrative. Failure to submit a price on an item may result in the proposal being deemed non-responsive.

B. Reasonableness. The Government anticipates making a determination of fair and reasonable pricing based on adequate competition. However, the Government may use any of the analysis techniques in FAR 15.404-1, either individually or in combination with each other, to determine that the final price is fair and reasonable. No award will be made at other than a fair and reasonable price.
