About this file

This is a Federal Supply Schedule (FSS) Sole Source Justification for a new task order award to Federal Prison Industries (UNICOR), a large business contractor with CAGE Code 1XFF6.

The requiring activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Business Department, with contracting activity at NAVSUP FLC Norfolk, Contracting Department, Fleet Directorate. The acquisition involves the design, installation, and replacement of current workstations that must match existing workstations in other NAVSUP spaces. The scope includes delivery and removal of existing workstations, design services, installation, and provision of all necessary personnel, management, equipment, and facilities by the contractor. The required delivery date is 90 days after receipt of award, with an estimated cost (IGE) listed as redacted. The justification for sole source is based on compatibility requirements—the new workstations must integrate seamlessly with existing systems in form, fit, and function. UNICOR is identified as the original manufacturer of the existing workstations, and using the same source enables cost savings through interchangeable piece parts and eliminates integration inefficiencies. Although other commercial manufacturers could potentially satisfy the requirement, none can effectively integrate with the current design provided by Federal Prison Industries. Market research was conducted in accordance with FAR Part 10, evaluating mandatory Government sources including Ability One, GSA Federal Supply Schedule, and UNICOR, with findings confirming that only UNICOR can provide the required supplies.

FSS SOLE SOURCE JUSTIFICATION

(MPT to < SAT)

Identification of Requiring Activity and Contracting Activity.

The requiring activity is NAVSUP Fleet Logistics Center (FLC) Norfolk, Business Dept. The contracting activity is NAVSUP FLC Norfolk, Contracting Dept., Fleet Directorate.

Nature and description of contract action. The acquisition of the supplies or services described below is a sole source action to be awarded as a new Federal Supply Schedule task order against a Federal Supply Schedule to the Federal Prison Industries, a large business. The placement of a firm-fixed-price order is anticipated.

The action is considered a new requirement.

Restricted to the following source.

☐ Service:

Contractor:

Cage Code:

☒ Supply:

Original Manufacturer Name: Federal Prison Industries (UNICOR)

Contractor: (if different)

Cage Code: 1XFF6

Description of the supplies or services required, the estimated price/cost, and required delivery date or period of performance.

NAVSUP FLCN has a requirement to design, install and replace current workstations. The new workstations MUST match the existing workstations currently in other NAVSUP spaces. This requirement includes:

• Delivery and removal of existing workstations

• Design

• Installation

• The contractor shall provide all necessary personnel, management, equipment, and facilities.

• The required delivery date is 90 days after receipt of award.

• The IGE is $XXXXX.

In conclusion, the requested supplies represent the minimum requirements of the government.

Describe in detail why only this source can furnish the requirement to the exclusion of other sources in accordance with GSAR 538.7104-3(a).

☒ The supplies or services must be compatible in all aspects (form, fit and function) with existing systems presently installed/performing. Describe the equipment/function you have

Source Selection Information – FAR 2.101 and 3.104 now and how the new item/service must coordinate, connect, or interface with the existing system.

The required items are particular to a certain manufacturer. The workstations being installed need to match the existing workstations provided and installed by the aforementioned manufacturer and dealer. New additions can be made at a significantly lower cost since the new workstations will integrate seamlessly with the existing layout. Additionally, because the same manufacturers are being used, the Government can realize cost savings when reconfiguring the workstations as the piece parts are completely interchangeable, thus reducing the need to purchase all new items.

Due to the aforementioned reasons, it is not feasible from an economic or timeframe standpoint to procure these workstations from manufacturers other than what is currently installed. The requirement is for the workstations to match the existing ones in other NAVSUP FLCN areas.

Although other commercial sources and manufacturers could potentially satisfy this requirement, none could integrate effectively with the current design provided by Federal Prison Industries.

Provide a description of the market research conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Market Research was conducted in accordance with FAR Part 10. All mandatory Government Sources were evaluated such as Ability One, GSA Federal Supply Schedule, and UNICOR. The market research determined that only UNICOR can provide the supplies needed in support of this action.
