About this file
This document is Amendment 0004 to a Navy solicitation for Shipboard Modular Berths (N0018925R0014). The amendment modifies the original solicitation to increase the number of potential contract awards from two to three commercial, indefinite-delivery, indefinite-quantity (IDIQ) contracts with firm fixed pricing. The Navy intends to award contracts using a Lowest Price Technically Acceptable (LPTA) source selection process, where proposals will be evaluated on technical acceptability and price. Offerors must submit technical and price proposals electronically by the specified date, with a 180-day proposal validity period covering a five-year ordering period plus a six-month optional extension. Technical proposals are limited to one page and must certify compliance with the Statement of Work and specified technical requirements, while price proposals have no page limit but must include detailed pricing information and supporting documentation.

The drawings listed above are posted on mscorphab.com or can be requested through the contracting office or the Subject Matter Expert (SME) identified in Delivery Orders. Limited Distribution drawings must be requested.
G. Many Military and Federal Specifications are being canceled and/or converted to commercial equivalents.
Referenced drawings have not in all cases been updated to cite the currently applicable specification. If a referenced specification has been canceled without replacement and the Contract Line-Item Description or this Requirements Statement do not cite an updated replacement specification, the Contractor may substitute a commercial equivalent. If there are option choices available within the cited specifications that are not specified by the contract, the Contractor shall select the grades and conditions etc. as the Contractor recommends. In the event there is an alteration to the drawing or specification after the Invitation for Bid, the supplier may, upon approval of the procuring activity, fabricate the item to the newer design.
H. All items shall be made strictly in accordance with the line-item descriptions and this Statement of Work except where a Request for Deviation (RFD), or Engineering Change Proposal (ECP), has been approved explicitly for this contract.
(1) RFDs and ECPs must be precisely defined. The government may require detailed sketches, drawings, data, or samples to clarify and document any requests. Due to the Habitability nature of the items, appearance is a factor in the evaluation of all RFDs and ECPs. Submittals shall include contract number, applicable CLIN and Find Number, description of the differences, reason for the differences, cost impact, schedule impact, identification of units which are affected, any effect on logistics support, action taken to prevent future recurrence of any non-conformance, reference to all previous correspondence that is related to the RFD or ECP or similar requests, and the contractor’s point-of contact including phone number and e-mail address. Submittals shall be in the contractor’s format. The submission of requests via electronic means (e.g., e-mail) is preferred.
(2) Reference to a manufacturer’s model number or item number is intended to be descriptive and not restrictive. The referenced items represent the required sizes, configuration, materials, finish, quality, and workmanship. Alternate proposals for items that are believed equal or a better value to the government are welcome.
(3) For any items, vendors may propose equivalent commercial items. For each alternate or substitute item, the vendor’s proposal shall include a detailed description and catalog cuts, including renderings or photographs. Additional detail, drawings, or even a sample, may be required to obtain approval if the catalog and description does not adequately describe the item.
(4) The SME, and approval of all Drawings, Substitutes, Deviations, RFDs, or ECPs shall be by the requiring activity, Mid Atlantic Regional Maintenance Center (MARMC), Code 310.2. Requests shall be e-mailed to Mid Atlantic Regional Maintenance Center TBD by the vendor at the same time they are submitted to the Contracting Officer. Individual Delivery Orders may indicate an alternate or additional SME.
(5) Mid Atlantic Regional Maintenance Center will forward the Government response to the vendor, the
PCO/ACO, not later than thirty (30) days after receipt. Time will not be added to the vendor's production or delivery schedule because of failure to identify and submit requested deviations, waivers, drawings, RFDs, ECPs, or requests for clarification.
(6) If quotations are requested for a Delivery Order, responses must be submitted within 8 business days of the request. The vendor shall email a copy of each Delivery Order within 72 hours of receipt to TBD or SME indicated in Delivery Order.
I. Estimated annual quantities in the basic solicitation are estimates only. The actual Delivery Order quantities for any Find Numbers may be more or less than the estimated quantity in the solicitation. Once the Government issues delivery order(s) up to the minimum guarantee of $500.00, the Government will no longer be obligated to purchase through this vehicle. The government intends to use this vehicle only to the extent that it is believed to be advantageous to the Government.
J. QUALITY MANAGEMENT SYSTEM - Higher-Level Contract Quality system compliance is required as indicated in the solicitation; including markings, inspections, packaging, etc.
Volume II: Price Proposal
1. Factor II: Price
This volume shall include completed solicitation documents and additional supporting documentation described below:
RFP Section “Schedule of Supplies/Services” completed by the offeror with the total ordering periods inclusive of the 6-month option period.
This volume shall also include a completed Attachment 1 – Material Price Spreadsheet (all items must be priced) for each ordering period, including 6-month option period (FAR 52.217-8) as well as a total summary for all ordering periods.
Unless completed in the System for Award Management (SAM), “Representations, Certifications and Other Statements of offeror’s” certification completed by the offeror.
A completed and signed page one (1) of the most current version of the solicitation and all amendments.
The proposal shall be valid for 180 days from solicitation closing date.
For the purpose of preparing a price proposal, the offeror shall assume that the period of performance consists of a five-year ordering period, plus a 6-month optional extension. Offerors shall use the periods established in the Schedule.
The completion and submission of the above items will constitute a proposal and will indicate the offeror’s unconditional assent to the terms and conditions of this RFP and any attachments and/or exhibits hereto. All price and price supporting information shall be contained in the price proposal. No price or pricing information shall be included in any other volume, including cover letters. Offerors are responsible for submitting sufficient information to enable the Government to fully evaluate their price proposal.
Offerors responding to this solicitation are advised that, prior to award, the Government may request proposals to submit additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items, sales history for the same or similar items, price lists with effective date and/or copies of catalog pages along with any applicable discounts. Failure to submit the requested information may result in disqualification of the submitted proposal.
ADDENDUM 52.212-2
FAR PROVISION 52.212-2, EVALUATION – COMMERCIAL ITEMS:
The Government will award no more than three (3) multiple contract award, commercial, indefinite-delivery, indefinite-quantity (IDIQ) contract with Firm Fixed Price (FFP) Provisions as a result of this solicitation and in accordance with the policies and procedures of FAR Part 12, Acquisition of Commercial Items, FAR Subpart 15, Contracting by Negotiations, FAR Subpart 16.5 Indefinite Delivery Contracts. Award will be made to the responsible offeror whose proposal conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate proposals: Technical and Price. The Government will utilize a Lowest Price Technically Acceptable (LPTA) source selection process in accordance with FAR Subpart 15.
The Government intends to award a contract without discussions. The establishment of a competitive range is not anticipated. Accordingly, each offeror should submit its most favorable terms from a price and technical standpoint.
However, the Government reserves the right to establish a competitive range and conduct discussions if later determined by the PCO to be necessary. The Government reserves the right to award a firm fixed price award to other than the lowest priced offeror; award a firm fixed priced without discussions; or award a firm fixed priced after discussions, whichever is in the best interest of the Government.
The Government will conduct a Lowest Price Technically Acceptable (LPTA) source selection. To determine LPTA, the Government will place all proposals in order of lowest total price to highest total price. Award will be made to the lowest priced proposal found to be Acceptable with respect to Technical. The selection of a proposal for award will be conducted in two phases:
Phase I will consist of the evaluation of Factor I, Technical. If the offeror receives a rating of “Acceptable” for Factor I – Technical, the offeror will proceed to Phase II of the evaluation i.e., evaluation of Factor II-Price. If the offeror receives a rating of “Unacceptable” for Factor I – Technical, the offeror will be considered un-awardable and will not be further evaluated. Thereafter, the next lowest total price proposal will be evaluated for acceptability in accordance with the evaluation criteria established in the solicitation.
Proposals will be evaluated for acceptability. Selection of a vendor for award will be based on two parts, as follows:
Technical Acceptability (Acceptable/Unacceptable) Price
In order to be considered awardable, proposals must receive an overall rating of ‘Acceptable’ for the non-price proposal.
Non-Price Proposal Evaluation Criteria:
The Non-Price proposal is comprised of the following Factors: Factor I – Technical Acceptability
1. Factor I - Technical Acceptability (Acceptable/Unacceptable):
Factor I – Technical Acceptability will be evaluated on an acceptable/unacceptable basis using the Acceptable/Unacceptable Ratings Table 1 below. Factor I will be evaluated on the offeror’s submission of the signed statement certifying that the offeror will meet requirements listed in the Statement of Work listed in the Addendum to FAR 52.212-1.
Table 1 –Technical Acceptable/Unacceptable Ratings Table Technical Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
NOTE: A rating of “Unacceptable” for Factor I means that the offeror’s proposal is not awardable and is not susceptible to correction without what would be tantamount to the submission of an entirely new proposal.
Price Proposal Evaluation Criteria:
The Price proposal is comprised of the following Factors: Factor II – Price.
Factor II – Price:
Price will be evaluated in accordance with FAR 13.106-3 Award and Documentation. For the purpose of preparing a price proposal, the contractor shall assume that the basic period of performance will be five (5) year ordering period, plus one (1) 6-month option period (FAR 52.217-8).
Ordering periods, to include FAR 52.217-8, will be evaluated pursuant to solicitation provision FAR 52.217-5, Evaluation of Options. The Government will evaluate proposals for award purposes by adding the total price for all ordering periods to the total price for the basic requirement. The Government may determine that a proposal is unacceptable if the ordering prices are significantly unbalanced. Evaluation of ordering periods shall not obligate the Government to exercise the additional ordering period(s).
The Government may evaluate any and all information submitted by the proposal to support the reasonableness of prices proposed. The method of evaluation used by the Contracting Officer is solely within the discretion of the Contracting Officer. Additionally, the government may request offeror to submit additional information/data to support price reasonableness such as copies of paid invoices for the same or similar items or uncertified cost and pricing data. Failure to submit the requested information may result in disqualification of the submitted proposal.
